TERMS OF USE

These Terms of Use (“Terms”) govern access to and use of the SmokeZoomGo mobile application (the “App”).

By using the App, you confirm that you have read, understood, and accepted these Terms. If you do not agree with these Terms, please stop using the App.

1. Purpose of the App

SmokeZoomGo is intended for personal self-practice, mindful support, self-observation, habit work, motivational support, and sharing personal experience.

SmokeZoomGo is not a medical device, medical service, diagnosis, treatment, therapy, psychotherapy, or a substitute for professional help.

2. Age and eligibility

The App is intended for users 18 years of age and older. By using the App, the user confirms that they have reached the applicable minimum age and are entitled to make their own decisions regarding use of this service.

3. Account and access

Some features may require an account or a specific sign-in method.

The user is responsible for:

keeping their sign-in credentials secure;
actions performed through their account;
using the App within these Terms, platform rules, and applicable law.

The user agrees not to transfer the account to third parties, impersonate another user, or use another person’s sign-in method without permission.

4. Premium, subscriptions, and purchases

Some App features may be available only to users with Premium access.

If Premium is obtained through Google Play or the App Store:

payment, renewal, cancellation, refunds, and store billing are governed by the rules of the relevant platform;
the App does not process or store the user’s bank card details;
Premium access may depend on store-confirmed entitlement and technical verification of an active subscription;
after reinstalling the App, signing in again, deleting the account, or changing devices, restoring purchases, reauthorization, or renewed synchronization of entitlement state may be required;
deleting the account inside the App does not automatically cancel the subscription in Google Play or the App Store; cancellation is usually handled separately through the user’s account with the relevant platform.

5. Limited license

Subject to compliance with these Terms, the user is granted a limited, revocable, non-transferable, non-exclusive right to use the App for personal, non-commercial purposes within its ordinary intended use.

The user is not granted the right to:

copy, resell, rent, or distribute the App or any part of it;
decompile, hack, circumvent restrictions, or attempt to gain unauthorized access to the service, data, or infrastructure;
use the App for abuse, spam, scraping, impersonation, attacks on the service, or circumvention of limits and protection mechanisms.

6. User-generated content and community features

The App may allow users to publish text-based user-generated content, including comments and messages.

The user is responsible for the content they publish. By publishing content, the user confirms that:

they have the right to publish it;
such content does not violate these Terms;
such content does not violate the rights of others, platform rules, or law.

By publishing user-generated content, the user grants the developer a limited right to store, process, display, restrict, hide, remove, and otherwise use such content to the extent necessary for the operation of community features, safety, abuse prevention, and platform compliance.

7. Prohibited conduct

The user must not publish, transmit, promote, or use the App for:

threats, harassment, bullying, or stalking;
hate speech, discrimination, or incitement to violence;
sexually explicit, shocking, illegal, or otherwise prohibited content;
spam, advertising, intrusive promotion, flooding, or manipulation of the feed;
publishing another person’s personal data without permission;
publishing content that may be perceived as a medical diagnosis, treatment, dangerous advice, or misleading health claim;
circumventing quotas, limits, anti-spam rules, reporting and blocking systems, or other protection mechanisms;
impersonation, fraud, social engineering, phishing, or other misuse.

8. Limits and abuse-prevention measures

To protect the service and users, the App may apply limits to posting, reading, feature availability, action speed, content visibility, and other abuse-prevention measures.

Such restrictions may be temporary or permanent and may be changed without individual prior notice where necessary for safety, moderation, spam prevention, platform compliance, or service stability.

9. Reports, blocking, and moderation

The App may allow users to:

report content or users;
choose a report reason;
block another user;
limit visibility of unwanted user-generated content.

The developer may, without prior notice, at its reasonable discretion and for the purposes of user protection, platform compliance, service security, and enforcement of these Terms:

filter or refuse to publish content;
hide, restrict, or remove content;
restrict certain account functions;
temporarily or permanently restrict access to the service in cases of abuse, repeated violations, fraud signals, security risks, or platform-policy violations.

The existence of a reporting function does not mean that every report will be resolved in favor of the reporting user. Reports may be used for review and moderation decisions.

10. Account deletion and termination of use

The user may stop using the App at any time.

If the App includes an account deletion function, the user may use the built-in path:

Settings → Account → Delete account

The developer may also restrict, suspend, or terminate access to the App in whole or in part in the event of violations of these Terms, misuse, security risks, platform requirements, technical necessity, or discontinuation of the service.

11. Intellectual property

The App, its code, structure, logic, visual elements, branding elements, interface, service texts, legal texts, and other service elements are protected by applicable law.

Nothing in these Terms transfers ownership rights in the App or its elements to the user, except for the limited right of personal use expressly stated in these Terms.

12. Disclaimer of warranties

The App is provided on an “as is” and “as available” basis.

We do not guarantee:

that the App will be continuously available or error-free;
that any feature will always remain available in its previous form;
that use of the App will lead to a specific result, including quitting smoking, reducing cravings, improving well-being, or any other effect;
that user-generated content will always be accurate, useful, safe, or suitable for any particular user.

13. Limitation of liability

To the maximum extent permitted by law, the developer shall not be liable for:

decisions made by the user based on the content of the App or user-generated content;
direct or indirect losses, data loss, loss of access, loss of expected benefit, service interruptions, or reputational harm;
actions of other users, including their publications, reports, blocks, misuse, or violations;
temporary unavailability, bugs, infrastructure failures, platform-side billing issues, or failures of third-party services;
inability to use the App on a particular device, in a particular region, or with a particular sign-in method.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14. Changes to the App and the Terms

We may update, modify, suspend, or remove App features, and we may also update these Terms.

The current version of the Terms shall prevail from the date of publication.

Continued use of the App after an updated version takes effect means acceptance of the new Terms.
