KidTether Terms of Use

These terms are between you and NGN Consulting Corp. ("we," "us," "NGN Consulting Corp.") and govern your use of KidTether (the "app"). By installing or using KidTether, you agree to these terms. If you don't agree, don't use the app.
Who this is for
KidTether is set up and operated by a parent or guardian. You must be an adult, legally able to enter into these terms, to install, configure, or purchase KidTether. It is not intended to be downloaded or set up by a child.
What KidTether does
KidTether turns your Android phone into a single-purpose device for as long as you choose: you pick a mode (Toddler Kiosk, one app; or Kid Grid, a few apps), pick the app(s), and hand the phone over. Your PIN ends Kid Mode and gives the phone back.
KidTether contains - it does not guarantee. Kid Mode keeps the app drawer, Settings, and anything you didn't choose out of easy reach. It doesn't claim to be unbreakable, it is not a security product, and a determined teenager is not its target user. KidTether does not block phone calls, including emergency calls - the lock-screen emergency-call affordance is part of Android itself and cannot be removed by any app, including this one. Do not rely on KidTether as the sole safeguard for a child's safety or well-being.
Inside the apps you allow, KidTether doesn't control anything. KidTether only limits which apps can be opened. It does not monitor, filter, or control the content, communications, ads, or in-app purchases inside any app you choose to allow. You remain responsible for setting up each allowed app's own parental controls and content settings, and for requiring authentication for purchases in Google Play (Google Play -> Settings -> Authentication) so a child can't buy anything without you.
Your PIN is yours alone. It's stored on your device only, salted and hashed - we cannot see it, recover it, or reset it for you. If you forget it, there is no in-app or support-desk recovery. If Kid Mode is off, uninstall and reinstall KidTether; this clears its local data, including the PIN and the exit log. If Kid Mode is on, restart your phone in Android's Safe Mode, which starts the phone without KidTether running. Open the power menu (on Samsung Galaxy phones, press the side button and volume down together; on most other phones, press and hold the power button), then touch and hold "Power off" until "Safe mode" appears, and tap it. The exact steps vary by phone maker. In Safe Mode, uninstall KidTether from Settings -> Apps, then restart normally. Your phone and your other apps are not affected.
Purchases
KidTether offers a 3-day free trial, followed by a single one-time purchase (currently $6.99; Google Play may show a different amount in your local currency). This is a one-time purchase, not a subscription - it does not renew and does not charge you again.
- Starting the trial does not require payment details and does not charge you anything.
- The purchase itself is processed entirely by Google Play Billing, under Google Play's own Terms of Service and refund policies. We do not process payments, and refund requests should go through Google Play, not to us directly, though you're welcome to contact us as well.
- "Restore purchase" restores an unlock already paid for on your Google account; it does not create a new charge.
Your responsibilities
- You're responsible for keeping your PIN reasonably private from the child using the phone under Kid Mode, and for choosing which app(s) are appropriate to allow.
- You're responsible for complying with applicable law in how you use the app, including any laws about supervising a minor's device use in your jurisdiction.
- Don't use KidTether to restrict or monitor another adult's device without their knowledge and consent - it's built for a parent configuring their own phone before handing it to their own child, not for covert use against another person.
No warranty
KIDTETHER IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL SUCCESSFULLY CONTAIN EVERY POSSIBLE WAY A CHILD (OR ANYONE ELSE) MIGHT EXIT KID MODE ON EVERY DEVICE OR ANDROID VERSION.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NGN CONSULTING CORP. IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, KIDTETHER - INCLUDING A FORGOTTEN PIN, A MISSED EXIT ATTEMPT, ANYTHING A CHILD DOES, SEES, OR BUYS INSIDE AN APP YOU ALLOWED, OR RELIANCE ON THE APP FOR A CHILD'S SAFETY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO KIDTETHER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP.
Some jurisdictions don't allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
License
Subject to these terms, NGN Consulting Corp. grants you a limited, non-exclusive, non-transferable, revocable license to install and use KidTether on Android devices you own or control, for your personal, non-commercial use. You may not copy, modify, reverse-engineer, decompile, or disassemble the app, or sell, rent, sublicense, or redistribute it, except to the extent applicable law expressly permits this despite this restriction. This license ends automatically if you break these terms. Google Play's own terms also apply to your download and purchase of the app; if they conflict with these terms on the use of the app itself, these terms govern to the extent the law allows.
Intellectual property
KidTether, its name, and its design are owned by NGN Consulting Corp. and are licensed to you, not sold. These terms don't grant you any rights to our trademarks, branding, or source code beyond the license above.
Changes to the app or these terms
We may update KidTether or these terms from time to time, and we'll update the "Last updated" date above when we do. If we make a material change to these terms, we'll tell you in the app and ask you to agree before the change applies to you.
Termination
You can stop using KidTether at any time by uninstalling it, which removes its local data from your device. We may discontinue or modify the app at our discretion; if we do, we won't retroactively charge you again for a purchase already made.
Resolving disputes
If you have a problem with KidTether, please contact us first (details below). Before either of us starts a formal legal proceeding, we each agree to try to resolve the dispute informally for at least 30 days after one of us sends the other a written description of it. This doesn't stop either of us from going to small-claims court, or from seeking urgent relief to prevent immediate harm.
Governing law and venue
These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law principles. Any legal proceeding relating to these terms or KidTether will be brought in the state or federal courts located in Cook County, Illinois, and you and we consent to their jurisdiction. Neither of these sentences takes away any protection that the consumer law of the place where you live gives you and that can't be waived by contract.
