Terms of Service

 

General Services

 

1.1 Services

 

The Creation Station and its staff shall provide the following services to the members of the Creation Station in accordance with the terms and conditions of this agreement:

 

The Creation Station is a local MakerSpace in the city of La Quinta, California that offers classes to train individuals proper techniques to use technology that inspire creativity and collaborations.  Machines include 3D Printer, Soldering Iron, Heavy Duty Sewing Machine, CO2 Laser Cutter, Digital Embroidery Machine, Sublimation Printer, Cricut Maker 3, Vacuum Former, SLA Resin Printer, Heating Presses, Desktop Computers (using Fusion360 Computer Aided Design programs), Electric Drill, Drill Press, Bench/Disk Sander, Band Saw, and other common hand tools.

 

The Creation Station reserves the right to refuse service to anyone at any time if there is a noncompliance with safety and policy measures for the Creation Station.

 

Members and Guests agree not to adhere to posted safety and equipment guidelines, reporting damaged or unclean equipment, and asking for assistance when needed.

 

 

1.2 Memberships

 

The Creation Station offers membership to the public in order to allow access to machines that Members or Guests have successfully completed a training class on.

 

There are four membership classifications available at the Creation Station for persons 14 years of age or older:

1.      Hobbyist

a.       Regular annual membership that allows access to all machines, tool room and workspaces within the MakerSpace

b.      Currently costs $50 annually and includes one free Level 1 class.

2.      Student

a.       Discounted annual membership that allows access to all machines, tool room and workspaces within the MakerSpace

b.      Currently costs $10 annually and includes one free Level 1 class

c.       To qualify for Student Membership, a current form of Student Identification is required at time of registration.

  i. ex. Student ID, Report Card, Enrollment Letter

3.      Military

a.       Discounted annual membership that allows access to all machines, tool room and workspaces within the MakerSpace

b.      Currently costs $10 annually and includes one free Level 1 class.

c.       To qualify for Military Membership, a current form of Identification is required at the time of registration.

  i. ex. Military ID,

3.      Teacher

a.       Free annual membership that allows access to all machines, tool room and workspaces within the MakerSpace

b.      No cost to member and does NOT include a free class

c.       To qualify for the Teacher Membership, a current form of Educational Identification from an accredited institution is required at the time of registration 

  i.  ex. Teacher ID card, Pay Stub, Employment documentation.

ii. Educational roles accepted for Teacher Membership include the following:

1.      Teacher/Professor/Adjunct

2.      Teacher/Professor’s Aide

3.      Student Teacher

4.      Principal/Vice Principal, Dean

5.      Counselor/School Psychologist

6.      Librarian/LMT/Teacher Librarian/Media Technician

7.      Educational/Sports Coach

8.      Instructional/Curriculum Specialist

9.      Home-School Teacher (w/documentation)

10.  Speech-Language Pathologist

 

1.3 Non-commercial Use

 

By registering for membership with the Creation Station, members agree to our non-commercial policy.

1.  The intent of the Creation Station is for education and personal use.

2.  Commercial use of any equipment, material, and space of the Creation Station is prohibited.

a.   The Creation Station space and tools are not to be used for the purpose of running a small or large business.

b.      Education on the operation and function of machines is deemed acceptable, but membership can be revoked if members are found misusing the MakerSpace according to the terms of use agreement.

3.  All licensed files, images, or trademarks must be credited to the original creator if posted on social media if it is not an original creation.

 

1.4 Payments

 

All payments made for services and materials at the Creation Station must be made in person at the MakerSpace.

1.  The Member or Guest agrees to make all payments for classes, camps, or workshops prior to participation in the activity.

2.  Filament purchases for 3D Printing will be weighed by MakerSpace staff before a cost is assigned ($12.50/lbs.).

a.       The weight will include supports, platform additions, and failed prints.

3.  The method of payment for services available include:

a.       Check

 i.      Made out to the “City of La Quinta”

ii.      Driver’s License or Legal ID required

b.      Cash

c.       Visa

d.      MasterCard

 

1.5 Assumption of Risk

 

Members and guests acknowledge the risks of using equipment and materials such as the equipment provided in the MakerSpace, and that participation in activities and/or use of such equipment and materials may result in damage to Member/Guest property, injury, illness, or death. The Creation Station staff will do all they can to limit such risks. These risks may result from actions taken by Members or Guests, and may arise from foreseeable causes, which may include electrocution, burns, impalement, or tripping, among other things. Members fully assume all risks involved with participating in activities and/or using the equipment at the Creation Station.

 

Members will acknowledge the inherent risks in the use of tools, equipment, and hazardous materials of any kind commonly used in electronics construction, fabrication, and other technology related activities and that Member participation in such activities and/or use of such tools may result in injury, illness, death or damage to Member or Member’s personal property. Finally, such injury, illness, death, or damage to Member or Member’s personal property may arise from foreseeable or unforeseeable causes including, without limitation, electrocution, burns, impalement, or slip and fall injuries. Members hereby fully assume all such risks and any others which arise because of their association with the Creation Station.

 

1.5.1        Safety Guidelines

 

Main rules of the Creation Station are posted around the MakerSpace. Specific rules for each station and machine will be covered in the training classes. Other general rules include:

1.      Use the space and equipment safely.

2.      Leave the space and equipment in clean and working condition.

3.      Work and behave in a way that protects your own safety and the safety of others.

4.      Children under the age of 14 years must be accompanied and supervised by an adult.

5.      Ask for help if you are uncertain how to use equipment.

6.     Comply with the building, safety, and fire rules and regulations of the equipment, whether posted or otherwise     imposed by the City of La Quinta, Library Systems & Services, State and Federal agencies.

7.      Be aware of the locations of first aid, fire, and safety equipment.

8.      Never use a tool unless you’ve been trained to use it safely.

9.      Use a step stool to reach extension cords or tools which are out of reach. Do not climb on tables or chairs to reach for something.

10.  Any creation of functional weapons or self-defense accessories are prohibited.  This includes knives, switchblades, butterfly knives, firearms with firing pins, dart guns, muzzles, silencers, self-defense keychains and any other firearm accessories.

a.      Items such as long swords, daggers, and space blasters for the purpose of costume or replica use can be allowed with the consent of MakerSpace staff

 

Failure to comply with safety guidelines can result in temporary suspension of access to the MakerSpace or even termination of current or future membership.

 

1.5.2        Protective Gear and Dress

 

For safety reasons, please follow these standards of dress:

1.  No loose-fitting clothing, ties, necklaces, or lanyards that can get stuck in the machinery. 

2.  For those with long hair, please use a tie to move hair out of the path of hazards. 

3.  Suitable gloves must be worn when handling hot objects or sharp-edged items.

4.  No sandals or open-toed shoes can be worn while working in the MakerSpace.

5.  Protective eyewear is available from the MakerSpace staff and must be worn in designated areas (Soldering Station, 3D Printers, Laser Cutter, Tool Room)

 

1.5.3        Release of Liability

 

Member releases the Creation Station from any liability whatsoever arising out of any damage, loss or injury to Member or Member’s property while participating in any activity while in the MakerSpace and/or using any equipment owned by the Creation Station or another Member or Guest of the Creation Station regardless of whether such loss or injury is as a result of negligence of the Creation Station or its Members or Guests, or is a result of some other cause.

 

1.6 Photo Release

 

The Creation Station Staff will take pictures or videos of classes, camps, workshops, and machines in action for use on our social media accounts and portfolios. Creation Station staff will ask for permission before posting any such photos or videos on public websites. Members and Guests are welcome, and encouraged, to take pictures around the MakerSpace. Any Members or Guests 17 years of age or younger will require Parental Consent in the form of a completed liability form with photo release before a picture or video of their likeness can be posted.

 

1.7 Age Requirements

 

The Creation Station requires that all Members or Guests be 14 years of age or older to take part in Memberships, regular classes, or workshops, unless stated otherwise.

 

1.  This excludes MakerSpace Camps, which are available to Guests between the ages of 7 to 13 years, as well as all-age workshops.

 

1.8 Proprietorship

 

All physical projects and digital files worked on or stored in the Creation Station computers and workspaces may be visible to the public. We do not protect your intellectual proprietorship.

 

1.   Items left in the MakerSpace by accident can be set aside and held for members or guests to the best of our ability.

a.  Please note that we do not have a security safe but will do our best to make sure items are returned to the right owner.

2.   After two attempts of contact with the owner and three months of held item, the item will be transferred to the La Quinta Public Library’s lost and found.

3.   The Creation Station is not responsible for personal property or digital files.

 

1.9 Food and Drink

 

1.  No food is allowed in the Creation Station due to potential contamination of fumes or chemicals given off by the 3D printers, laser cutter, soldering iron and/or tool room.

2.  Drinks must be in a sealed container (i.e. Water bottle or tumbler)


1.10 MakerSpace Classes



 

MakerSpace Workstations

 

Prior to using the MakerSpace, adult Members or Guests must complete and sign a City of La Quinta Activity Waiver and verify their identity with a valid photo ID.

 

Minor members or guests must have an adult parent, guardian, or other person with appropriate legal authority to sign the City of La Quinta Activity Waiver. Parents/guardians are welcome to tour the MakerSpace area to become familiar with the facilities and equipment and evaluate use by a minor child, and the Creation Station staff are happy to answer questions.

 

Members need to check in with the front desk staff member on duty, using their Creation Station membership card each time before using the space. Guests are asked to check in at the front desk when they arrive in order to fill out the Activity Waiver and/or take care of class fees before taking part in the class.

 

Members or guests with disabilities who need special arrangements or accommodation should notify Creation Station staff in advance before their expected time of use so the accommodation can be ready for their class or visit.

 

The Creation Station staff reserves the right to deny Members and Guests access to stations if they are using those stations in a way that can harm themselves, other Members or Guests, or the equipment.

 

2.1 Worktables

 

Applying to all workstations, equipment, materials, and space of the Creations Station.

1.  Using workstation for inappropriate, unethical, or illegal activity is prohibited.

2.  Members are responsible for cleaning their workstation before leaving for the day.

 

2.2 Computers

 

1.  MakerSpace Members or MakerSpace Class Student are allowed to use Creation Station computers

2.  Not for personal use and unethical or illegal activity.

  3.  All activity can and will be monitored by Creation Station staff and the IT department.

4.  Only download files related to MakerSpace stations (.cad / .stl / .svg / etc.)

5.  The Creation Station will not be held responsible for changes to personal accounts if Members or Guests fail to log out when finished using computers.

 

The IT department and Creation Station do our best at creating a safe environment to work in but there are always vulnerabilities that can be hacked.

 

2.3 Electronics/Soldering Station

 

1.  Soldering Station must always be cleaned after each use.

2.  Members may bring their own tools and materials if the Creation Station Staff are informed ahead of time and are given time to check the tools and materials for safety concerns.

3.  Always wear eye protection when soldering.

4.  Overhead light must always be on when using this station. If soldering iron is cooling down from use, leave light on so everyone knows the iron is cooling.

 

2.4 3D Printers

 

1.  All materials must be reviewed by MakerSpace Staff before using 3D printers.

2.  Members must complete the level 1 class in order to use PLA or ABS filament.

3.  Members must complete the level 2 class in order to use specialty filament.

4.  The manufacturing of weapons of any kind is not permitted.

a.       Examples include guns, knives, switchblades, butterfly knives.

b.      Exception: Science fiction blasters (no firing pin), hollow swords, and Cosplay props which pose no physical danger.

c.       The Creation Station reserves the right to halt, delete, or disallow the creation of items that violate Library, MakerSpace, and Government policies, including the creation of weapons, obscene materials, or illegal items.

5.  3D Printers are usually available to members on a first-come, first-serve basis. However, Members are encouraged to call or email before stopping by in order to reserve a time or check for class conflicts.

6.  3D printer users must be physically present in the MakerSpace for the first 30 minutes of their print job in order to ensure the job is printing correctly, unless special permission is received from full-time MakerSpace staff.

7.  If you are not present when your 3D print job is completed, staff or other users may remove it from the printer so that the printer can be used by others.

8.  3D printed objects must be picked up within (7) days of printing or they will be considered abandoned, and either be recycled or become property of the MakerSpace, unless Creation Station staff has been notified of their absence ahead of time.

9.  The Creation Station is not responsible if a project is destroyed, does not print correctly, or does not work.

10.  When machines are out of order, staff will attempt to contact patrons with reservations. This courtesy cannot be guaranteed.

11.  When working with the SLA Resin Printer, Members are required to wear protective safety gear:

a. Respirator Mask

b. Nitrile Disposable Gloves

c. old clothing/apron

 

2.5 Sewing

 

1.      Sewing machines are available for Member use so long as there is space available. Sewing machines may be unavailable during certain classes or MakerSpace Camps.

2.      Members may bring their own machines into the Creation Station for personal use. Creation Station Staff cannot guarantee accurate training on personal sewing machines.

3.      Members must complete the level 1 class in order to use both the Industrial Zig-Zag machine and the Domestic machine, with the basic presser foot, as well as iron and cutting tools.

4.      Members must complete the level 2 classes in order to use additional sewing tools and accessories, including alternate presser feet.

5.      Donated material, such as fabric and thread, are available for Member use so long as supplies last. The Creation Station Staff reserves the right to restrict use of donated sewing material at any time.

6.      Members must bring in their own notions, such as zippers, buttons, and interfacing. Supplies at the Creation Station are dedicated to class use only.

7.      Members are responsible for making sure sewing machines are put away, the iron is unplugged and otherwise cleaning up after themselves after using equipment.

 

2.6 Laser Cutter

 

1.  All materials must be reviewed by MakerSpace Staff before using the Laser Cutter.

2.  Protective eye wear must be worn while the Laser Cutter is in use and when removing materials after the completion of a print.

3.  Members must complete level 1 class in order to cut acrylic and natural materials (Paper, Cardboard, Wood, approved fabric).

4.  Members must complete level 2 class in order to use the rotary tool and/or engrave painted metals or glass.

5.  Members must reserve Laser Cutter prior to use.  As there is only one laser cutting machine on site, classes have priority over member use. 

a.   Members can reserve the Laser Cutter up to 4 cumulative hours per week.

b.  Members must get approval to extend their time with front desk staff and that it is not using another Member’s reserved time.

6.  The Creation Station does reserve the right to deny reservations during special programming. (ex. MakerSpace Camps & MakerSpace Workshops)

7.  Members are only allowed to laser cut or engrave approved materials.

a.   If a member is caught working with banned materials, there is one warning documented on their membership profile, if the member is caught again, membership will be revoked for violating the safety policy.

 

2.7 Tool Room

 

1.  Creation Station members must participate in mandatory safety and use orientation in order to use the hand, power, and machine tools in the tool room. They may not use these tools until orientation has been complete, as confirmed by Creation Station staff.


2.8 Sublimation Printer

a. ex: Sublimation Vinyl, 20 oz Tumbles, Keychains, Coffee Mugs, Shirts and more.


2.9 Cricut Maker

a. Iron-On Vinyl

b. Card Making

c. Print & Cut Sticker (Can be used in combination with Sublimation Printing Class)

a. ex: Cardstock, Vinyl, Iron-On Vinyl, Sticker Paper and more.


2.10 Vacuum Former

a. ex: Approved thermoplastics, molds, designs

 

Special Programming

 

3.1 MakerSpace Workshops

 

The Creation Station will occasionally offer special workshops available in addition to regular MakerSpace classes that can cover a variety of topics and may require additional material fees.  It is encouraged that participants RSVP to reserve a spot.

 

3.2 MakerSpace Camps

 

      1.   Parent/guardian need to sign activity waiver.

2.   Participating child needs to agree to follow the Creation Station (4) main rules posted in the 

      MakerSpace.

3.   If a participating child is not following rules or misbehaving, then the parent/guardian of that child will        

   be contacted to pick up the child and will not be able to finish makerspace camp activity.

4.  All participants must wear closed-toe shoes to participate in the planned activity.

 

4.1 MakerSpace Field Trips

 

MakerSpace Field Trips must be arranged at least (1) month in advance of the intended date of the visit.  There is zero cost associated with a regular field trip that includes a tour of the Creation Station with demonstrations from staff.  If you require a planned activity during your field trip, the MakerSpace Supervisor will discuss options and estimated costs for materials.

 

1.   Field Trips for just the Creation Station are recommended for Middle School aged children and older.

2.   The max occupancy we can accommodate for a visiting party is up to 30 people.

3.   The time allotted for a visit to a party can be up to 3 hours.

 

 MakerSpace Donation Guidelines:

 

We are always appreciative to receive donated material items. For safety reasons any equipment/machines we receive will need to be professionally inspected first.

 

List of Approved Donation Items:

·         Sewing Materials

o   Fabric, Thread, Zipper, Ribbons, Patterns, other Sewing Notions, etc.

·         Untreated Lumber

o   Pine, Oak, MDF, Birch Bamboo, etc.

o   For Laser Cutting: 1/8” or 1/4” max

·         Acrylic Sheets

o   Continuous Cast, Extruded, Layered

·         New/Unused Batteries

o   AA, AAA, D, 9V, Coin/Button Cell, etc.

·         Kids Crafting Supplies

o   Googly Eyes, Pipe Cleaners, Popsicle Sticks, Shoe Boxes, Assorted Paper, etc.

·         PLA, ABS, PETG, and other FDM compatible filaments

o   No larger than 1.75mm in diameter and from a US supplier

 

List of Unapproved Donation Items:

·         Used Hand/Power Tools

o   Very old, rusty, in poor condition

·         Sewing Pins/Needles

·         Broken Electronics

·         Toxic Chemicals

·         Filaments from outside the US

 

If you are a member using our donated items, all we ask is that you please be conservative with the material and give back when you can.
