The Alabama Legislature established an agency known as The Alabama Real Estate Commission (AREC) and gave it the responsibility of establishing the rules and regulations governing the purchase and sale of real estate for the explicit purpose of protecting the interests of the buying and selling public. Under the state charter AREC is responsible for protecting the interests of the public in all matters relating to the sale and purchase of real estate. The State and AREC take their responsibilities very seriously or they would not require someone to become a licensed professional to assist others in a real estate transaction. The rules and regulations established by AREC are the laws that set the standards and govern everything from obtaining a license to practice, to every aspect of the actual practice of real estate.
It means that before you can do anything resembling the practice of the profession of real estate, you must get an education in the field, and you must be licensed by the State. As a Realtor (the professional designation of a real estate agent) you ARE A LICENSED PROFESSIONAL, and the responsibility for protecting the interests of your client accrue to you. You will be held to a higher standard by the State in all matters relating to real estate, because of your real estate education and training. A lack of professional knowledge or failure to perform your duties in a professional and or ethical manner can have serious, civil and/or criminal repercussions.
