Article 1 Purpose
This Terms of Service (hereinafter referred to as the "Terms") aims to specify the rights, obligations, responsibilities, and other necessary matters between Whyus Inc. (hereinafter referred to as the "Company") and users in the use of services provided through smart devices, including games and related services.
Article 2 Effectiveness and Modification of the Terms of Service
The Company will post the contents of these Terms within the service so that users can easily access them.
If reasonable grounds arise, the Company may amend these Terms within the scope not violating related laws and regulations.
When the Company amends the Terms, it will notify the users through the method specified in Article 12, at least 7 days in advance (30 days in advance for changes that are disadvantageous or significant to users), specifying the effective date, amended content, and reasons for the amendment.
After announcing the amended Terms, the Company will verify whether users agree to the application of the amended Terms. If users do not express their intention to agree or disagree, it may be deemed that they have agreed to the amended Terms by the effective date.
If users do not agree to the application of the amended Terms, either the Company or the user may terminate the game service contract.
Article 3 Other Rules and Operating Policies
To apply these Terms and protect users' rights and maintain the order of game service usage, the Company may establish operational policies (hereinafter referred to as the "Operating Policies").
The Company will make the contents of the Operating Policies available to users by posting them within the service or providing links for users to access.
These Terms, along with separate policies for individual services provided by the Company, apply, and matters not specified herein shall comply with the relevant laws and regulations of the Republic of Korea, including the Act on Promotion of Information and Communications Network Utilization and Information Protection.
Article 4 Definitions
"Content" refers to all digital services, including games and related applications, provided by the Company.
"Smart Device" means mobile phones, tablets, portable gaming devices, electronic devices, and any other devices through which Content can be downloaded, installed, or accessed via a network.
"Smart Service" refers to the game and content services provided by the Company that can be accessed on devices.
"User" refers to a customer who accesses the services operated by the Company, agrees to these Terms, and enters into an agreement according to the Terms.
"Service Agreement" refers to the contract entered into between the Company and the User regarding the use of the service.
"Virtual Currency" refers to paid virtual goods used within the game.
Article 5 Establishment of the Service Agreement
The Service Agreement is established when a customer who intends to become a "User" agrees to the contents of these Terms, applies for use, and the Company approves such application. By downloading the Company's game or accessing content via a network, the User is deemed to have agreed to these Terms.
Article 6 Application and Restrictions
Users can apply for and use the service by downloading and installing the application or by providing necessary information through the required forms.
The Company may not approve or may restrict the use of the service in the following cases:
1. If the User impersonates someone else.
2. If false information is provided in the service application form.
3. If the service is intended to commit a crime as defined by the Criminal Act.
4. If the service is intended to violate the Juvenile Protection Act.
5. If the service is intended to violate any other current laws.
6. If the service is intended for profit.
7. If a user, in competition with the Company, intends to undermine the Company's interests.
8. If it's necessary for operational purposes to restrict access from countries where the service is not provided.
9. Except for cases where a user lost their qualification due to these Terms, and one year has passed since then and the Company approves re-registration.
10. If a child under 14 years old does not have consent from their legal guardian (parent, etc.).
11. If the user's actions prevent approval, violate any stipulated terms, or have other reasons attributable to the user.
12. If the user violates any stipulated terms while applying.
The Company may restrict the application or use of the service for applicants or users in the following cases until the reasons for such restrictions are resolved
When there is no available equipment capacity.
When there are technical obstacles for the Company.
Article 7 Privacy Policy
The Company strives to protect the personal information of users, including registration information, in accordance with relevant laws. The protection and use of personal information are governed by the relevant laws and the Company's "Privacy Policy."
Article 8
The Company complies with relevant laws and faithfully performs the rights and obligations stipulated in these Terms.
The Company must ensure the security of personal information (including credit information) to allow users to safely use the service, disclose its privacy policy, and comply with it. Except as otherwise provided in these Terms or the Privacy Policy, the Company ensures that the user's personal information is not disclosed or provided to third parties.
To continuously and stably provide services, if there is a malfunction or data loss in the equipment while improving the service, the Company will make its best efforts to repair or restore it promptly unless there are unavoidable reasons such as natural disasters, emergencies, or technical limitations.
Article 9
Users must comply with the provisions of these Terms, other regulations established by the Company, and announcements made by the Company. Users must not engage in activities that hinder the Company's operations or damage its reputation.
Users must comply with relevant laws, including the Juvenile Protection Act. Users violating laws such as the Juvenile Protection Act will be punished according to the relevant laws.
Users cannot conduct business activities using the service without the Company's prior approval, and they will be responsible for any consequences of such activities. If such activities cause damages to the Company, the user is obliged to compensate, and the Company can restrict the user's service usage and pursue legal actions for damages through appropriate procedures.
Users are responsible for managing their user IDs and must not allow third parties to use them.
Users must not engage in the following actions, and if they do, the Company may restrict the user's service usage, delete relevant information (posts, photos, videos, etc.), and take appropriate legal actions:
Moreover, the responsibility for any problems arising from these actions lies solely with the user.
Registering false information or deceiving others during various applications, changes, or registrations.
Acts of impersonating others.
3. Modifying the company's program or information published by the company, hacking the company's server, altering any part or all of the website or posted information, or using the company's services for profit or in abnormal ways without explicit authorization or approval from the company.
4. Exploiting bugs in the company's program.
5. Illegally obtaining, transferring, or trading cyber assets (ID, character, items, in-game currency, etc.) through abnormal means.
6. Damaging the service or intentionally obstructing the service.
7. Conducting business activities through the service without prior approval from the company.
8. Replicating information obtained through the service for purposes other than service use, publishing, broadcasting, or providing it to third parties without prior consent from the company.
9. Transmitting, posting, or otherwise disseminating content that infringes upon the intellectual property rights of third parties, such as patents, trademarks, trade secrets, copyrights, and other intellectual property rights.
10. Transmitting, posting, or otherwise disseminating content that violates the Juvenile Protection Act or other laws, including violent, vulgar, obscene, or lewd content to third parties.
11. Transmitting, posting, or otherwise disseminating content that severely defames or infringes upon the honor or privacy of others.
12. Harassing or threatening other users, or persistently causing distress or discomfort to specific users.
13. Collecting or storing other users' personal information without the company's approval.
14. Engaging in activities objectively judged to be associated with crimes.
15. Engaging in acts that violate other related laws.
If a user becomes aware that their user ID and password have been stolen or are being used by a third party, they must immediately notify the company and follow the company's instructions. The company will not be held responsible for any disadvantages that arise if the user fails to notify the company or does not follow the company's guidance.
Article 10. Changes and Modifications to the Service
Users can use the game services provided by the company in accordance with this agreement, operational policies, and game rules set by the company.
The virtual world provided to users through the game service is a virtual world created by the company. The company has comprehensive authority over the creation, modification, maintenance, and repair of game content.
The company takes necessary measures to protect the game world from the real world and maintain order and gameplay within the game world.
The company may modify (patch) the game service based on operational or technical needs. In the event of such modifications, the company will provide prior notice through the respective game site or application. However, in cases like bug fixes, emergency updates, or other urgent changes that are not major, notices may be provided after the fact.
Article 11. Restriction on Service Usage
The company may restrict user access to the service without prior notice if the user violates the provisions of Article 9 of this agreement.
Article 12. Advertising and Transactions with Advertisers
Part of the service investment foundation that enables the company to provide services comes from revenue generated by advertising. By using the service, users are considered to consent to the advertisements displayed during service usage.
The company is not responsible for any losses or damages resulting from users participating in or engaging with advertiser promotional activities through the service.
Article 13. Copyright and Management of Posts
Users hold rights and responsibilities for the content they post while using the service.
The copyrights and other intellectual property rights of content created by the company belong to the company.
If a particular post is deemed to infringe upon honor, privacy, or other rights, the company may take 'temporary measures' against the relevant post or material without prior notice. Subsequently, based on agreements between parties and relevant laws and company policies, the content may be deleted or restored.
User posts within the service may be displayed in search results, promotions, or other service-related areas. In such cases, within the necessary scope for display, some modification, replication, or editing may occur. The company adheres to copyright laws, and users can request actions such as deletion, exclusion from search results, or making content private through customer support or service management features.
Article 14. Payment
The purchase price for content is primarily determined by policies and methods set by mobile carriers and application stores. Payment methods must also be made according to the specified methods. Limits may be set or adjusted based on the company's policies, payment agencies (mobile carriers, application stores), or government policies.
Article 15. Ownership of Rights, etc.
Copyrights and industrial property rights related to the service belong to the company. However, user "posts" and works provided under partnership agreements are excluded.
The company grants users the right to use accounts and content based on conditions set by the company. Users may not transfer, sell, or provide as collateral.
Article 16. Withdrawal of Subscription
Paid content purchased by users is categorized into content where withdrawal is possible and content where withdrawal is limited. This distinction is made clear when users purchase paid content. Withdrawal for content where it's possible is based on policies of mobile carriers or application stores and follows relevant laws and the company's "Withdrawal of Subscription."
Events, free applications, and content (ID, items, in-game currency, licenses, etc.) provided by the company are excluded from subscription withdrawal.
Article 17. Effects of Subscription Withdrawal
If a member returns goods, the company refunds the amount within 3 business days. If the company delays the refund, it pays delayed interest calculated using the rate set by e-commerce laws for consumer protection.
Article 18. Refund of Overpayment
If users are overcharged, refunds are made based on policies of mobile carriers or application stores.
Charges incurred from application downloads or network services (call charges, data charges, etc.) are excluded from refunds.
Article 19. Compensation for Damages
The company compensates users for damages if significant defects in the service cause content to be damaged, altered, or deleted. However, the company is not liable for any damages to users without its intent or negligence.
The company handles refunds and compensations due to contract termination according to content user protection guidelines.
If a user's access is restricted or terminated, all rights to content are lost, and the company is not responsible for refunding the purchase price of such content.
If a member violates these terms, they are responsible for compensating the company for any resulting damages.
If specific digital content is lost due to service changes or discontinuation, the company announces it for over 30 days within the service or on its website. For users who purchased the content, the company compensates with equivalent new content or virtual currency. The remaining usage period is based on the remaining duration of the content.
Article 20. Exemption Clause
The company is exempt from responsibility in cases where it cannot provide services due to reasons such as war, civil unrest, natural disasters, emergencies, or technological defects that cannot be resolved with current technology.
The company is not responsible for interruptions, service failures, or contract terminations caused by the user's fault.
The company is exempt from liability if users suffer damages due to a telecommunications service provider's interruption or failure to provide the service, unless the company has intent or gross negligence.
The company is not liable for the reliability, accuracy, or other content-related issues of information, data, or facts posted or transmitted by users unless there is intent or gross negligence on the part of the company.
Article 21. App Permissions
Permissions required by the content are used for the following items:
Allow phone calling and management
The device needs to be verified to provide rewards through advertising tools included in the content.
Permissions to identify the device are required. Without this permission, there may be instances where rewards cannot be received.
Allow access to device photos, media, and files
This permission is necessary to store files required to run the game on the device.
Without this permission, reading/writing necessary information for game use becomes impossible.
Allow access to contacts
This permission is required to verify a user's Google account during the login process.
2 .Without this permission, Google login cannot be performed.
3. If not using Google login, the game does not access contacts.
The content uses these permissions only for the mentioned functions, and the names of permissions may vary depending on the device.
Article 22. Jurisdiction and Governing Law
Matters not specified in these terms are governed by relevant laws and regulations.
In the event of disputes arising from the use of the service, the court as stipulated by the law and its procedures shall have jurisdiction.

Article 23. Effective Date
These terms are effective from October 29, 2023.
