Family Cases

Matters arising out of marriages, inclusive of but not limited to:

1. Annulment of marriage.

2. Restitution of Conjugal Rights (in case one spouse leaves the other without proper cause, court can issue a direction to the such person to reside with the other spouse again.

3. Judicial separation (Court can order a couple to stay apart for a fixed period of time before discussing the matter of dissolution of marriage etc.)

4. Dissolution of marriage, generally by divorce, which can be mutual as well as initiated on motion of one party to marriage. 

5. Declaratory suit for validity of marriage/matrimonial status of party to marriage.

6. Pertaining to property of the parties to marriage.

7. Any order or injunction in circumstances arising out of a marriage 

8. Declaratory suit as to legitimacy of any person.

9. Suit for maintenance.

10. Guardianship/custody/access to/of person/child

11. Maintenance of wives/children/parents

12. Other matters.

it is the duty of a family court to preserve the institution of marriage in society and to make every effort to help the parties to reach a settlement.

विवाह से उत्पन्न होने वाले मामले, इसमें शामिल हैं लेकिन इन तक सीमित नहीं हैं:

1. विवाह को रद्द करवाना ।

2. वैवाहिक अधिकारों की बहाली (यदि एक पति या पत्नी बिना उचित कारण के दूसरे को छोड़ देते हैं, तो अदालत ऐसे व्यक्ति को दूसरे के साथ फिर से रहने का निर्देश जारी कर सकती है।

3. न्यायिक अलगाव (विवाह के विघटन आदि के मामले पर चर्चा करने से पहले अदालत एक जोड़े को एक निश्चित अवधि के लिए अलग रहने का आदेश दे सकती है)

4. विवाह का विघटन, आम तौर पर तलाक द्वारा, जो आपसी हो सकता है और साथ ही विवाह के लिए एक पक्ष की गति पर शुरू किया जा सकता है।

5. विवाह की वैधता/विवाह के पक्षकार की वैवाहिक स्थिति के लिए घोषणात्मक वाद।

6. विवाह के पक्षकारों की संपत्ति से संबंधित।

7. विवाह से उत्पन्न परिस्थितियों में कोई आदेश या निषेधाज्ञा

8. किसी व्यक्ति की वैधता के बारे में घोषणात्मक वाद।

9. रखरखाव के लिए दावा।

10. व्यक्ति/बच्चे की संरक्षकता/हिरासत/पहुंच के लिए दावा 

11. पत्नियों/बच्चों/माता-पिता का भरण-पोषण/रखरखाव के लिए दावा

12. अन्य मामले 

न्यायालय का यह कर्तव्य है कि वह समाज में विवाह की संस्था को बनाए रखे और पक्षकारों को समझौते तक पहुँचने में मदद करने के लिए हर संभव प्रयास करे।
