The reason they are legal to use are for parental controls / child monitoring and employee management / monitoring, and you'll see them marketed as such. Unfortunately, some people hold the incorrect presumption that legally-operating (spyware) businesses will hold all legal responsibility for their actions with the SaaS provided, so they proceed to invade another adult's privacy and/or interfere with their wellbeing; potentially committing several crimes along the way.

Every legitimate provider of these "spy" apps and devices are highly detailed in their terms of use about the legalities concerned with using their services, and about the potential risk for committing crimes when used maliciously.
