GEOGRAPHIC LIMITATIONS:
The Services are currently available only within the municipal limits of Gauribidanur Chikkaballapur dist. BRISKO reserves the right to restrict or expand this service area at its sole discretion without prior notice.
1. Acceptance of Terms
Please read these Terms carefully. By accessing or using the Brisko Platform, you are agreeing to these Terms and concluding a legally binding contract with us.
By accessing or using the BRISKO mobile application, website, or any related services (“Platform”), you agree to be bound by these Terms and Conditions.
In order to use the Services, you must first agree to the Terms. You can accept the Terms by:
Clicking to accept or agree to the Terms, where it is made available to you by Brisko in the user interface for any particular Service; or
Actually using the Services. In this case, you understand and agree that Brisko will treat your use of the Services as acceptance of the Terms from that point onwards.
You hereby represent and warrant that you are at least eighteen (18) years of age or above and are fully able and competent to understand and agree the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.
Compliance with Laws. You are in compliance with all laws and regulations in the country in which you live when you access and use the Services. You agree to use the Services only in compliance with these Terms and applicable law, and in a manner that does not violate our legal rights or those of any third party(ies).
DEFINITIONS AND USER CONTENT
DEFINITIONS (The "Who")
"You," "Your," or "Customer" refers to any person who accesses or uses the BRISKO Platform to browse restaurants or place an order.
"BRISKO," Ownership & Operation: The BRISKO Platform is legally owned by Ashfaq Ulla Khan G F. The Platform is operated and managed by its authorized Administrative Team. For the purpose of these Terms, 'We', 'Us', or 'Our' shall refer to the Owner and the Platform's Administration collectively."Restaurant(s)" or "Restaurant Partner(s)" refers to the independent third-party food business owners who list their menus on our Platform.
"Restaurant"/ “Restaurant Partner” means the restaurants listed on Brisko Platform.
"Delivery Partner(s)" refers to the independent service providers who pick up orders from Restaurants and deliver them to Customers.
II. THE SERVICES (The "What")
BRISKO provides a technology marketplace that enables Customers to view menus, place orders, and track deliveries.
Important: BRISKO does not own, prepare, or handle food. We are an intermediary connecting three parties: You, the Restaurant, and the Delivery Partner.
Ownership of Your Content: You remain the owner of the reviews, photos, and ratings you post. However, by posting them on BRISKO, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and share that content for marketing and quality purposes.
Guidelines for Photos/Reviews:
Truthful: Reviews must be based on actual experiences.
Original: You must not upload photos stolen from other websites or apps.
Appropriate: Any content that is abusive, offensive, or contains "junk/spam" will be removed immediately.
Disclaimer of Content: BRISKO does not verify the accuracy of restaurant-provided photos (e.g., "Menu Photos"). As stated before, images are for illustrative purposes only.
IV. TERMS OF USE FOR CUSTOMERS
Account Responsibility: You are responsible for keeping your phone number and OTP secure. Any order placed from your account is considered "Your" order.
Accuracy of Address: You must provide an accurate GPS location and address. If the Delivery Partner cannot reach you because the address is wrong, you may still be charged 100% of the order value.
Payment and Billing:
Payments are made via Razorpay (Online) or Cash on Delivery (COD).
You agree to pay the "Total Bill" shown at checkout, which includes GST and Delivery Fees.
No Advertising/Bookings: As per your request, BRISKO is strictly for food delivery. We do not support third-party ads, table reservations, or gold memberships.
PLATFORM EVOLUTION & UPDATES
Continuous Improvement: BRISKO is constantly evolving to provide the best possible experience. We reserve the right to modify, update, or discontinue certain features of the Platform at any time to improve service for our Customers and Partners.
Software Updates: To use the Platform, you may be required to download and install updates. These updates are designed to improve, enhance, and further develop the Services and may take the form of bug fixes, enhanced functions, or entirely new versions.
SUSPENSION & TERMINATION
Account Suspension: We reserve the right to selectively suspend or permanently terminate your account without notice if we detect suspicious activity, including but not limited to:
Creation of multiple accounts to exploit promo codes.
Harassment of Delivery Partners or Restaurant staff.
Frequent cancellations after an order has been accepted.
Any fraudulent use of payment methods.
Consequences: If your access is stopped due to suspicious behavior, you are prohibited from creating a new account. Any pending refunds or credits may be forfeited at our sole discretion.
DISCLAIMER OF QUALITY & PRICING
Food Quality: BRISKO is a delivery aggregator. We do not guarantee the quality, taste, or safety of the food products provided by Restaurants. While we ensure all partners are FSSAI-registered, the final responsibility for food preparation and hygiene lies with the Restaurant. We will ensure that customer will get refund in case of bad food quality.
Menu Pricing: Prices listed on the menu are provided by the Restaurant. Unless stated otherwise, prices are subject to change without notice based on restaurant updates or seasonal availability.
FSSAI Compliance: We take all legal FSSAI requirements seriously. If you have concerns regarding food safety, please contact us immediately so we can investigate the Restaurant Partner.
PROMOTIONS & REFERRALS
Offers & Codes: BRISKO may, from time to time, introduce referral codes, promo codes, and special offers. These are subject to specific terms (such as minimum order value or expiry dates).
Right to Revoke: We reserve the right to cancel or modify any offer or referral reward if we believe the system is being gamed or used fraudulently. Referral rewards cannot be exchanged for cash.
USER ACCOUNT, PASSWORD, AND SECURITY
Account Creation: To access the features of BRISKO, you must create a "Customer Account." You agree that you are solely responsible for all activities that occur under your account.
Truthfulness of Information: By creating an account or claiming any business listing, you represent and warrant that all information provided by you is true, accurate, current, and correct. You agree to maintain and promptly update your account information to keep it accurate at all times.
Account Security: You are responsible for maintaining the confidentiality of your login credentials and OTP. You agree to notify BRISKO immediately of any unauthorized use of your account or any other breach of security so that we may take necessary corrective actions.
Communications: By creating an account, you provide your irrevocable consent to receive communications from BRISKO (via SMS, Email) in connection with the platform services. This includes:
Order confirmations and delivery updates.
Account recovery and security alerts.
Comments or feedback from other customers or restaurants regarding your orders or reviews.
Responsibility for Activities: BRISKO shall not be liable for any loss or damage arising from your failure to comply with this security obligation. You may be held liable for losses incurred by BRISKO or any other user of the platform due to someone else using your account.
TELEPHONE SERVICES & CALL RECORDING
Value-Added Calling: In order to connect you directly to certain Restaurant Partners, we may provide a telephone service through our own lines displayed on the restaurant's listing page.
Consent to Recording: By using these calling features, you agree and acknowledge that these calls may be recorded and stored for quality assurance, training, and to resolve any order-related disputes. You consent to the collection of call metadata (time, duration, and phone numbers) as part of our service.
RESTRICTIONS ON USE (The "Do Not" List)
Permitted Use: You agree to use the Services only for purposes that are permitted by these Terms and any applicable law, regulation, or generally accepted practices in India.
Access to Services: You agree not to access (or attempt to access) the Services by any means other than through the interface provided by BRISKO. You specifically agree not to access the Services through any automated means (including the use of scripts, bots, or web crawlers).
Robots.txt: You shall ensure that your use of the platform complies with the instructions set out in any robots.txt file present on the Services.
No Interference: You agree that you will not engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services).
No Reverse Engineering: You shall not decompile, reverse engineer, or otherwise attempt to derive the source code of the Platform.
Integrity of Content: You shall not delete, modify, or reverse any material or information posted by any other Customer or Restaurant Partner on the BRISKO platform.
DATA & API OWNERSHIP
Proprietary Rights: You acknowledge and agree that BRISKO owns all legal rights, titles, and interests in the Services, including any intellectual property rights (such as API keys and software code).
Data Privacy: Your personal data is governed by our Privacy Policy. We ensure that your personal data is handled securely and is not shared with unauthorized third parties, except as required to fulfill your order (e.g., sharing your details with the Restaurant and Delivery Partner).
DELIVERY COORDINATION & COMMUNICATION
Facilitating Fast Delivery: To ensure the fastest possible delivery, BRISKO facilitates direct communication between the Delivery Partner, the Restaurant, and the Customer.
Data Shared for Pickup: Once a Delivery Partner accepts an order, BRISKO provides them with the Restaurant’s Name, Exact Address, and Contact Number. This is strictly for the purpose of locating the pickup point and clarifying order readiness.
Data Shared for Drop-off: To ensure the order reaches the correct doorstep, the Delivery Partner is provided with the Customer’s Name, Exact Delivery Location (GPS & Landmark), and Phone Number.
Purpose-Bound Communication: * Delivery Partners may call the Restaurant or Customer only for delivery-related queries (e.g., "I have reached the gate," or "The item is out of stock").
Any use of these contact details for personal reasons, harassment, or outside the scope of the specific order is a violation of these Terms and will lead to immediate termination of the Partner's access.
Background Location Tracking: Customers acknowledge that the Delivery Partner’s precise GPS location will be tracked in the background and displayed to the Customer from the moment the order is picked up until it is marked as "Delivered." This is a core feature of the BRISKO experience to provide security and transparency
OWNERSHIP & PROPRIETARY RIGHTS
BRISKO Content: All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, and artwork on the Platform (collectively, "BRISKO Content") are owned, controlled, or licensed by Ashfaq Ulla Khan G F.
Protection: BRISKO Content is protected by copyright, patent, and trademark laws. You may not copy, republish, or distribute any part of the app or its code without our express written consent.
Proprietary Rights: You acknowledge that you do not acquire any ownership rights by using the Services or downloading any material from the Platform.
YOUR CONTENT & LICENSE
Your Content: This includes any reviews, ratings, or photos you upload. You represent that you own the rights to anything you post.
License to BRISKO: By posting content, you grant BRISKO a non-exclusive, royalty-free, perpetual, and worldwide license to use, host, store, reproduce, and display your reviews and photos for the purpose of operating and promoting the business.
Content Removal: BRISKO reserves the right to remove or edit any User Content that violates our guidelines or that we find objectionable, without prior notice.
CONTENT GUIDELINES (Google Play Compliance)
To maintain a safe community, you agree not to post content that:
Is harmful, offensive, or contains hate speech.
Contains viruses or malicious code.
Is clearly fake or intended to mislead other customers.
Infringes on the intellectual property of others (e.g., using a restaurant's private logo as your own profile picture).
THIRD-PARTY CONTENT & LINKS
The Platform may contain links to third-party websites (like Razorpay or Google Maps). We do not control and are not responsible for the content or privacy practices of these third parties.
FEEDBACK & SUGGESTIONS
If you provide us with any feedback or suggestions, you agree that we can use them to improve BRISKO without any obligation to compensate you.
GOVERNING LAW & DISPUTES
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Karnataka.
FOOD ORDERING & DELIVERY
1. Ordering with Restaurant Partners
BRISKO provides a marketplace to connect you with Restaurant Partners. Each order you place is a legal agreement between You and the Restaurant. We facilitate the delivery, but we do not prepare the food.
2. Pricing, Taxes, and Fees
Menu Prices: All prices are set by the Restaurants. BRISKO does not control these prices.
Taxes: All applicable taxes (GST, etc.) will be clearly displayed at checkout before you pay.
Delivery Charges: A delivery fee is added to each order. This fee covers the cost of our Delivery Partners bringing the food to your location and is calculated based on distance and demand.
Packaging Charges: Restaurants may charge a small fee for containers and bags, which will be visible in your bill summary.
Platform Fee (Customer)
BRISKO charges a flat Platform Fee of ₹12.00 (inclusive of GST) on every order placed through the Platform. This fee is charged to the Customer to maintain the app's infrastructure, security, and technology services. This fee is non-refundable and will be clearly displayed in the "Bill Summary" before checkout.
Delivery Fee Structure
Delivery fees are calculated based on the distance between the Restaurant and the Customer's delivery location, and other factors like demand and weather.
Base Delivery Fee: A standard fee applies for the first 3 (three) kilometers.
Distance Surcharge: For orders exceeding 3 km, an additional per-kilometer fee will be applied.
Surge Pricing: During periods of high demand or adverse weather, a surge fee may be applied to incentivize Delivery Partners.
The final Delivery Fee is shown to the Customer at the time of order placement.
Restaurant Partner Commission
BRISKO operates on a commission-based model with Restaurant Partners.
Standard Commission: A service fee of 18% to 25% (as per individual partner agreement) is charged on the base food value of every order.
Payment Collection Fee: A fee of 2% is charged for processing electronic payments via third-party gateways (e.g., Razorpay).
Settlement: Net proceeds, after deducting the BRISKO commission, payment fees, and applicable taxes (TDS/GST), are settled to the Restaurant's registered bank account on a weekly basis.
For Restaurant Partners
Service Commission: BRISKO shall charge a service fee ("Commission") ranging from 18% to 25% on the gross value of food orders (excluding taxes and delivery fees).
GST Compliance (Section 9(5)): In accordance with Section 9(5) of the CGST Act, BRISKO is responsible for collecting and remitting 5% GST on the food services provided by the Restaurant.
Income Tax (Section 194-O): As an E-commerce Operator, BRISKO shall deduct TDS at the rate of 0.1% (as per 2026 Budget updates) on the gross sales of the Restaurant. If a valid PAN is not provided, the TDS rate will be 5%.
Settlement: All net payments (after deducting Commission and TDS) will be settled to the Restaurant’s bank account on a weekly basis.
For Delivery Partners (Riders)
Payer of Fees: Delivery charges are collected by BRISKO from the Customer on behalf of the Delivery Partner.
GST on Delivery: As per 2026 rules, 18% GST is applicable on the Delivery Fee portion of the bill. BRISKO handles the collection and filing of this tax.
Payment Structure: Delivery Partners are paid based on a "Per-Order" or "Distance-Based" model. Any incentives or surge fees are clearly displayed in the Rider App before task acceptance.
Platform Usage Fee: BRISKO may charge a nominal technology fee to the Delivery Partner for the use of the navigation and assignment systems, which will be deducted from the earnings before payout.
3. Delivery Timing (No "On-Time" Promise)
Best Effort Basis: BRISKO does not guarantee a specific delivery time. Any "Estimated Time of Delivery" shown in the app is an approximation only.
As Soon As Possible (ASAP): Our goal is to deliver your food as quickly as possible. However, delivery speed depends on restaurant preparation time, traffic, weather, and distance.
Delays: By using the service, you acknowledge that delays can happen. In the event of a significant delay, BRISKO will prioritize getting your food to you as quickly as possible. We do not offer compensation for delays caused by external factors (traffic, rain, etc.).
4. Order Tracking
To provide transparency, we provide live GPS tracking. This allows you to see the real-time progress of your order from the restaurant to your doorstep.
2. Platform Nature
BRISKO is a technology platform that facilitates ordering of food and related items from independent restaurants and delivery partners. BRISKO does not prepare, cook, store, or handle food directly.
3. User Eligibility
Users must be at least 18 years old or must use the Platform under parental supervision.
4. Account Responsibility
Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted through their account.
6. Delivery Location Validation
Delivery confirmation is allowed only when the delivery partner is physically present within the system-defined delivery radius of the customer’s registered location.
7. Photo Proof (When Applicable)
BRISKO may require delivery partners to upload delivery photo proof to validate handoff in some cases
Delivery photo proof, when collected, is used strictly for order verification and fraud prevention and is processed in accordance with BRISKO’s Privacy Policy.
Images & Representations:
All food and beverage images displayed on the BRISKO platform are for illustrative purposes only. These images are intended to provide a general idea of the dish and may not be an exact representation of the actual food parcel delivered. The final appearance, packaging, and garnishing of the product may vary depending on the Restaurant Partner’s preparation and seasonal availability of ingredients.
8. Pricing & Payments
All prices are inclusive of applicable taxes unless stated otherwise. Payments are processed through authorized third-party payment gateways.(Razorpay/COD)
9. Cancellations & Refunds
Refunds, cancellations, and order disputes are governed by BRISKO’s Refund & Cancellation Policy available on the Platform.
10. User Conduct
Users agree not to misuse the Platform, provide false information, abuse delivery partners, or attempt to manipulate delivery verification systems.
11. Limitation of Liability
BRISKO shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform.
12. Modification of Terms
BRISKO reserves the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of revised Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of India.

RESTAURANT TERMS OF SERVICE

Restaurant Responsibilities
Restaurants are responsible for:
Accuracy of menu, pricing, and availability
Food quality and hygiene standards
Timely order preparation
Settlements
Payouts will be processed to the registered bank account as per the platform’s settlement cycle.
Account Suspension
The platform reserves the right to suspend or terminate restaurant accounts in case of false information, policy violations, or legal non-compliance.
DELIVERY PARTNER TERMS OF SERVICE
Eligibility
Delivery partners must provide valid Aadhaar, driving licence, RC, and bank details.
Partner Responsibilities
Delivery partners must:
Follow delivery and safety guidelines
Maintain valid documents
Complete deliveries responsibly and professionally
Payments
Earnings will be credited to the registered bank account as per the payout schedule defined by the platform.
Account Suspension
Accounts may be suspended or terminated for policy violations, fraudulent activity, or unsafe conduct.
BRISKO shall not be liable for failure or delay in performance due to events beyond its reasonable control including natural disasters, network failures, government restrictions, strikes, or technical outages.
