Regular Hearing Location and Schedule
The Board of Zoning Appeals (BOZA) conducts hearings, when necessary, on the first Wednesday of every month, at 5:00 p.m., County Office Building, 701 Kelly Road, Cumberland, unless otherwise publicized. Applications petitioning BOZA proceedings must be complete and hearing fees are to be paid, in full, prior to a hearing being scheduled.
Generally, filing deadlines occur three (3) to four (4) weeks prior to a hearing. For a precise deadline date for any given month, please contact the P&Z office at 301-777-5951 or email tdinicola@alleganygov.org.
When a hearing is scheduled, the Board will publish notice of the time and place of the hearing within a newspaper of general circulation at least 15 days prior to a scheduled hearing date. The Board will notify, in writing, all known property owners adjacent to or adjoining the property in question at least five days prior to a scheduled hearing. Adjacent property owners include those separated from the property in question by roads, railroads and other rights-of-way. Adjacent and adjoining property owners of the property subject to a BOZA case will be identified and contacted by utilizing the most current tax account information available. Proper, timely and adequate legal notification to all parties prescribed by law is the responsibility of the Applicant.
After a BOZA case is in order and deemed sufficient to conduct a hearing, the Applicant will be notified by the Board when and where to present his/her case. The Applicant is also responsible for posting a Zoning Notice placard. This placard shall be displayed at the site and visible from the public road at least five (5) days prior to the date of the hearing and remain through the date of the hearing. Prior to the hearing date, the Board of Appeals members will make an inspection of any site where an appeal is pending. This inspection shall be done in a manner that allows public participation.
BOZA hearings are always open to the public. Any interested party may attend.
