That's a question that has, as of yet, not been settled in Canada. According to Parentcentral.ca "technically, some sexting cases could fall within Canada's child pornography provisions, says Jane Bailey, a professor in the faculty of law at the University of Ottawa. But she says Canadian crown attorneys are taking a more reserved approach than some in the U.S." where "aggressive law enforcers have charged teens for sending naked photos of minors under distribution of child pornography laws." How a case is handled seems to depend as well on whether a person is of legal age.
