The Great Debate About Online Platform Liabilities

Online platforms are quickly becoming powerful economic agents in our technologically advanced society. We rely on giants like Airbnb and Uber daily to help us navigate our lives. These companies dominate the market and often play a major role in shaping tech-focused business standards in hospitality, transportation and C2C sales. Because of this, we must explore the legal responsibility for duty of care and whether they fall under ISP legislation. This webinar will tackle the following issues:

  • Legal status of platforms

  • Active obligations of platforms

  • Specific obligations of platforms in existing legislation

  • Drafted legislation for platforms.

Participants will be invited to engage in a debate about whether platforms should benefit from ISP status and subsequent liability limitations.

Our Presenters

Guest Speaker : Radim Polčák

Radim Polcak is the vice-rector of Masaryk University (MU), the head of the Institute of Law and Technology at the Law Faculty at MU (Czech Republic) and a visiting lecturer at the University of Göttingen (Germany). He is the general chair of the Cyberspace conference and the founder of the Masaryk University Journal of Law and Technology and the Review of Law and Technology (Revue pro právo a technologie). He is a founding fellow of the European Law Institute and the European Academy of Law and ICT, a panellist at the .eu Arbitration Court and a member of various governmental and scientific expert and advisory bodies and project consortia around the EU. He also served as a Special Adviser for Robotics and Data Protection Policy to the European Commission. Radim authored or co-authored over 150 scientific papers, books and articles namely on topics related to cyberlaw and legal philosophy.

Pablo Iannello is the Chair of the Museo Social Law School, the director of the Law and tech Program at UADE, and a visiting professor at University of Dayton School of Law since 2013. He has also served as a visiting Fellow at the UNIDROIT Institute, in Rome throughout 2012. Professor Iannello's main areas of research include: Comparative Law, International Economic Law, IP, Law and Tech, Antitrust, Legal Theory and Law and Economics.
