Process/Procedure for FMLA
Employee uses the FMLA Leave Request Form to inform the employer (HR) that they are planning to take FMLA leave. Should complete this as soon as they determine they may be in need of FMLA. Provide as much notice as possible.
Within 5 business days, HR will provide form WH381 identifying if an employee is eligible for FMLA leave and what their rights/responsibilities are. HR may use WH380E or F for additional information to be provided as needed.
HR will also provide the employee with the Strafford FMLA Policy (GCCAC) and the FMLA Information form (WH1420), to ensure the employee understands the process and their rights/responsibilities.
Once everything is provided to HR, form WH382 will be completed by HR (within 5 business days) to inform the employee if their FMLA leave request has been approved or denied. Both the employer and employee should retain a copy of this completed form.
If the Employee is Approved for FMLA:
If at any point in time, the employee anticipates running out of paid leave, they will have to work with HR to complete a FMLA Benefits Explanation Sheet and potentially set up a payment schedule for the employee portion of health insurance.
HR and the Employee will need to communicate with each other every 15 work days that an employee is out on FMLA leave. During these conversations, the employee will clarify if there have been any anticipated changes to their return date.
Should the full 12 weeks be used and additional time required, the employee will need to work with HR to identify if there are any other forms of leave available. ie. Americans with Disabilities act (ADA).
