Our association is governed by several types of governing documents, defined here in descending order of authority:
Declaration
The Declaration contains the Covenants, Conditions & Restrictions (or CC&Rs) that regulate resident behavior. They bind all the owners to the association, establish association responsibilities, and define owners' rights and obligations.
Articles of Incorporation
Articles of Incorporation initially create the corporation under state law and define the association's basic purposes and powers. They may specify such things as the number of directors, terms of office, and other specifics about how the board functions.
Bylaws
Bylaws are provisions for how the association operations, such as meetings, electing bard members and officer, and general duties of the board. Exhibit A of the bylaws outlines the maintenance responsibilities of the association and the unit owners.
Book of Resolutions
The board may adopt policies and rules as formal resolutions at a board meeting. These written resolutions may be policy resolutions, regulatory resolutions, special resolutions, or special resolutions.
Rules and Regulations
The Board adopts the rules and regulations. They must be consistent with the declaration, bylaws, and state law. See Rules and Regulations page.
