1. Explain the hierarchy of Criminal Courts and their powers to
pass sentences in India.
10 (ten) marks.
2. How cognizance of an offence is taken by a Magistrate? When
can the Magistrate direct the police to register the offence?
10 (ten) marks.
3. a) For every distinct offence there is separate charge and every
such charge will be tried separately. What are the exceptions of the above said rule?
b) Under Cr.P.C. how many types of trials are being conducted? Explain briefly.
5 (five) marks each.
4. a) Person once convicted or acquitted not to be tried again for
the same offence. Explain.
b) Who is an accomplice and what is the evidentiary value of his statement?

5. Explain the distinction between —
1) Wrongful restraint and wrongful confinement
2) Afray and Rioting
3) Common object and common intention
4) Criminal misappropriation and criminal breach of trust

6. Define and give a detailed account of essence of cheating with
illustrations?
10 (ten) marks.
7. a) What are the newly incorporated sections in Evidence Act
with regard to presumptions and explain?
b) Who is a hostile witness and whether his evidence can be relied upon? If so to what extent?

8. a) What is the purpose of the examination of the accused u/s
313 Cr.P.C? b) What is the effect of delay in lodging F.I.R.? c) How much of information received from the accused may be
proved against him? d)' What is the conclusive proof?
e) All confessions are admissions but all admissions are not confessions - Explain.

9. a) What is consent and how consent discharges a person from criminal liability?
b) What are the essentials of kidnapping how is it different from abduction?

10.a) What will be the effect if a cheque is issued for a time barred debt and its dishonour?
b) Whether a complaint with regard to dishonour of a cheque is not maintainable on the ground that the accused had already filed an insolvency petition?

11. Explain the legal effect of a dying declaration. What would be the legal consequences when different dying declarations are made to different persons?

13. What are the ingredients to constitute an offence u/s 498A IPC?
