HIGH COURT - 2 OCT-21 DEC 2015 (COURTS AUTUMN MICHAELMAS SITTING)
July 27 2015 - In the High Court at the Four Courts Dublin RASA was represented by John Hennessy, S.C. in an application to have the claim against the State regarding the unlawful reductions imposed on pensions entered into the Commercial Division List of the High Court. The Judge decided that, as the case also relates to Constitutional matters and potential breaches of EU Law that it would be more appropriately dealt with in the High Court list (Four Courts, Dublin)
Over the next few weeks (during the Court Long Vacation period) our Solicitors, LK Shields, will continue to try to reach agreement with the Chief State Solicitors regarding proceeding by way of representatives plaintiffs.
22 July 2015 - LKS advised Application Lodged to have case heard for listing in the Commercial Court
There is still an opportunity to join the large number of those who sent their Signed Papers to LK Shields, Solicitors, to be part of the Pension Reduction Legal Case being progressed by RASA. Aer Lingus shareholders at the AGM were reminded that 99% of them voted to unilaterally and without consultation to cut the income of pensioners in receipt of pensions to the value of €174m to resolve the IASS MFS actuarially calculated debt without ANY COMPENSATION FOR PENSIONERS.
This vote deliberately excluded one third of IASS members (those on pension) from mitigation

Clarification regarding Coordinated members on early retirement pensions
If you are an IASS coordinated member on pension in January 2015 who has not yet reached normal retirement date/state pension age your pension in payment will be further reduced.
This is in addition to your pension levy and S50 Debt cuts imposed on your pension income by Employers/Trustees/Pension Authority in January 2015 without consultation. For some pensioners that can be an additional reduction of 50%. Individuals are being informed by the Secretary of the IASS scheme in the month before the cuts are being implemented. There is no mitigation or compensation for these cuts - compensation only available to active and deferred members of IASS not in receipt of pension on January 1 2015.
Clarification regarding Non ROI pensionable service. If you have outside Republic of Ireland pensionable service please contact the Pension Scheme office or email pensionqueries@aerlingus.com if you have any queries.

March 24 2015 CDaly TD query statement of Minister to Q116 of Mar 10: .deficit support from the employers !! see written ans 990-mitigation only for non pensioners - benefit cuts only mitigated for non pensioners.
Reply....... I said that the fund has received additional support from the employers involved totalling €260 million. The funding I referred to was provided by the employers outside of the IASS and is intended to mitigate the benefit cuts under the approved IASS funding proposal. The funds were not put into the IASS fund directly and I hope this clarifies my previous comments.

Dec 4 2014 - RASA met with the Pensions Authority along with RASA's legal and actuary advisors.
RASA representatives outlined concerns and issues of members relating to the Draft Section 50 benefit reduction proposals planned to come into effect on Jan 1 2015.
Regulator said that each and every issue raised in the hundreds of submissions from members will be examined.
