Kanyakumari District Temples – Land Records
Case filed to transmit settlement of temples registers of Kanyakumari and Tirunelveli district, from Kanyakumari District Collector- Temple Ownership documentation not completed for 60 years by TN Govt Kanyakumari District Collectorate.
Land Records of all the temples in Kanyakumari District and certain taluks in Tirunelveli District were handed over by the Public Department (Central Records), Trivandrum in 1960 to the Kanyakumari District Collector. However, till this date, the temples do not have settlement registers establishing ownership with them and in the absence of such ownership document, temples are not able to reclaim / recover the lands from the possession and enjoyment of untheorized people.
Mr.Periya Nambi Narasimha Gopalan has filed WP MD No.8551 of 2020 through his counsel S. Sridharan for directing the District Collector to transmit a copy of settlement registers to each temple in Kanyakumari and certain taluks in Tirunelveli. The Writ Petition came up today before the division bench of Justices M. Sathyanarayanan and P. Rajamanickam. The Hon’ble Court admitted the WP and posted it to 1.9.2020 for counter by the Respondents.

T R Ramesh on his fight for Brihadeeswara Temple Tanjore
Big victory for True Bhaktas. Missionary backed Tamil detractors petition to conduct Tanjore Temple Consecration - Dismissed by Madurai Bench of MHC. Shri T R Ramesh on how he ensured that Brihadeeswara Temple Kumbha-bhishekam was done as per the Agama Sastras by getting High Court to dismiss a mischievous petition.
The said Petition was filed before the Supreme Court and was listed on December 18, 2019 as Item No. 26 before the three-Judge Bench presided by the Hon’ble Chief Justice of India Shri S. A. Bobde. The Hon’ble CJI has tagged the said Writ Petition with pending Writ Petitions challenging TNHRCE Act 1959. The pending Petitions were filed by late Shri Swami Dayananda Saraswathi ji W.P. (C) No. 476/2012 & Podu Dikshitars of Chidambaram Nataraja Temple, W. P. (C) No. 544/2009
All the three Petitions will now be taken up together.
The custodians of the Tiruchendur Temple and @indiccollective were represented by Senior Advocate Shri Mohan Parasaran and Advocate Shri @jsaideepak. Shri K. V. Muthukumar is the Advocate on Record for the Petitioners. As part of reliefs sought in the Petition, the Petitioners have also sought constitution of a Special Investigation Team by SC to investigate into the conduct of officers of HRCE department and elected representatives with respect to Hindu religious institutions in Tamil Nadu
Today the Govt informed Court that out of Rs.37 crores released [subsequent to filing of our petition], only Rs.13 crores has been t/f to Temple A/cs and balance is in process. ShreehariK submitted that despite Court following up every week, the Govt is taking too long to send money.
ShreehariK further submitted that merely because temples are opened, a conclusion cannot be drawn that Archakas begin to earn income. An affidavit was filed in this regard. It was submitted that in rural areas there is little footfall in temples even on regular days.
That now as a result of Corona, people are refraining from visiting temples. Further, the Govt has prohibited performance of Sevas, therefore the source of income is completely curtailed & hence some form of assistance is necessary.
ShreehariK submitted that Govt had announced the supply of free ration kits to all Archakas vide its order dated 20/04/2020 but not even half Archakas have received it & entire northern Karnataka has been deprived of it.
On the earlier hearing, it was observed by the Chief Justice that the Court cannot assume that all Archakas are dependent on Archaka as a sole income source and that they may have other vocation also. ShreehariK disputed the same, and an affidavit has been filed in support.
It has been submitted that Archakas are engaged in religious service from morning 7 till 1pm & evening 5pm to 8pm & there is no time left for pursuing other vocation. Further, Archakas are ineligible for pursuing Pourohitya as per Shastras. Thus there is no scope for other vocation.
The Chief Justice asked the Govt why it can't provide monetary relief to Archakas if it can help the Advocates? [Govt has contributed Rs.5crores to Advocate relief fund]. The Chief Justice further directed the Govt to supply ration kits to all Archakas to help them sustain themselves during corona pandemic, as the Archakas are in bad condition. While directing that amounts be disbursed to all the temples at the earliest, the matter has been adjourned to 07/07/2020. Consider helping temple priests, HC tells govt .
