このページは、「みまもり」アプリ(以下「本アプリ」)をご利用いただくにあたり、必ず知っておいていただきたいことを、丁寧にご説明するものです。本アプリは、一人暮らしのご高齢の方の見守りをお手伝いするアプリですが、安全や生命を保証できるものではありません。本ページの内容をご了承いただいたうえでご利用くださいますよう、お願い申し上げます。
⚠️ 重要:緊急のときは、本アプリだけに頼らず、必ず 119 番(消防・救急)へご連絡ください。
本アプリ「みまもり」は、ご家族による見守りを補助するためのソフトウェアです。スマートフォンに搭載された加速度センサーや GPS などの情報をもとに、ご高齢の方の不活動・転倒・SOS を検知し、ご家族(ガーディアン)に通知します。
ただし、本アプリは:
医療機器ではありません。健康状態の診断・治療・予防を目的としたものではなく、薬機法(医薬品医療機器等法)上の医療機器としての承認・認証も受けていません。
緊急通報サービスではありません。119 番や 110 番のような公的な緊急通報インフラと直接連携しているものではなく、本アプリの通知がご家族(ガーディアン)以外に届くことはありません。
安全保証サービスではありません。本アプリを導入したことで「絶対に異変に気付ける」ことを保証するものではなく、後述するさまざまな理由により検知や通知が遅れたり、行われない可能性があります。
本アプリは、「気付ける可能性」を高めるための補助ツールとお考えください。
なお、本アプリは 16 歳以上の方を対象としており、見守られるシニアユーザーご本人の同意のもとでご利用いただくことを前提としています。
本アプリは、技術的にどうしても完全な検知・通知を保証できません。以下のような状況では、検知や通知が遅れる、または行われないことがあります。具体例を挙げてご説明します。
通知は、お使いのスマートフォンから Google のクラウドサーバー(Firebase)を経由して、ご家族のスマートフォンに届きます。経路のどこかで通信が途絶えたり遅延したりすると、通知が届かない・遅れることがあります。
例:ご高齢の方の自宅が電波の弱い地域である
例:Wi-Fi ルーターの故障・電源切断
例:通信会社の障害(数年に一度発生する規模の大規模通信障害も含みます)
端末の電源が入っていなければ、本アプリは動作しません。バッテリーが切れた・電源が切られた・端末が壊れた、というときは、検知も通知も行われません。
本アプリには「バッテリー残量低下」のお知らせ機能があります(既定 5% 以下で通知)。ご家族(ガーディアン)が気付きやすくなる工夫はしていますが、通知到着の前に電源が切れることもあり得ます。
Android OS は、バッテリーを節約するためや動作の安定のために、アプリの動作を自動的に制限することがあります。
例:「バッテリー最適化」機能により、バックグラウンドでの動作が制限される
例:Android が本アプリを強制終了する(メモリ不足時など)
例:「アプリの強制停止」をご本人や別のアプリが実行する
例:一部のメーカーの端末には、標準の Android より強力な独自の省電力機能・「アプリ自動終了」機能が搭載されており、「バッテリー最適化の除外」を設定済みでも見守りが停止することがある
本アプリは、初回起動時に「バッテリー最適化の除外」をお願いしていますが、設定が正しく適用されていないと動作が止まる場合があります。メーカー独自の省電力設定がある端末では、その設定でも本アプリを除外し、アプリ内の見守り稼働表示を定期的にご確認ください。
位置情報は GPS 衛星からの電波を受信して取得します。以下のような場所では、正確な位置を取得できない、または位置情報そのものが取得できないことがあります。
屋内(特に地下、鉄筋コンクリート建造物の中、エレベーター内)
高層ビル街(電波の反射により誤差が大きくなる)
山間部・トンネル内
端末が機内モードになっている、位置情報サービスが OFF になっている
なお、SOS 等の通知に添付される位置情報は「最後に取得できた位置」であり、最大で約 15 分前(それ以降取得できていない場合はさらに前)のものであることがあります。実際の位置と異なる場合があります。
不活動検知・転倒検知は、端末に内蔵された加速度センサーの値をもとに判定しています。
検知漏れの例:端末がカバンや上着の中に入っていて動きを十分に拾えない/転倒したが端末は手から離れて動かなかった/不活動の判定しきい値より短い時間で「動いた」と認識される動きがあった
誤検知の例:端末を落とした・激しく振った・乗り物の急ブレーキの揺れを「転倒」と判定した
転倒検知については、誤検知を踏まえて「大丈夫ですか?」確認画面を 60 秒表示し、ご本人が「大丈夫です」と応答できる猶予を設けていますが、それでも防ぎきれない誤検知・検知漏れがあり得ます。
本アプリには、利用者ご自身で調整いただける設定があります。設定によっては、検知・通知の挙動が変わります。

役割(シニア/ガーディアン)の切り替え
たとえば、シニア側で「不活動検知 OFF」「位置情報 OFF」にすると、ガーディアン側に通知や位置情報が届かなくなります。本アプリは「設定を OFF にした」ことをガーディアン側にも表示しますが、設定の意味をご家族で共有しておくことを強くお勧めします。
本アプリは、以下の外部サービスを利用しています。これらのサービス側で障害が発生した場合、本アプリの一部または全部の機能が停止することがあります。
Google Firebase(認証、データベース、通知配信)
携帯電話会社・インターネットプロバイダ
地震・台風・大雪などの自然災害、戦争、テロ、大規模停電、その他、当社の支配下にない事由により、本サービスの全部または一部が利用できなくなることがあります。
本アプリは、リアルタイムの警報装置ではありません。
不活動の判定はサーバー側で約 15 分ごとに行われ、お客様が設定したしきい値(30 分〜48 時間)を経過してはじめて通知されます。しくみ上、実際の異変から通知まで数時間以上かかることがあります。
転倒の通知は、端末上の「大丈夫ですか?」確認(60 秒)などの手順を経たあとに送信されます。
通知の配信は Google のプッシュ通知基盤(Firebase Cloud Messaging)を利用しており、回線状況や受信側端末の省電力状態によって遅延することがあります。配信時間の保証はありません。
本アプリは、正しく設定・維持されてはじめて役に立ちます。次の事項は、シニアユーザーとご家族(ガーディアン)の皆さまご自身で行っていただく必要があります。
シニアの端末を充電し、電源を入れ、ご本人の身近に置いておくこと
端末をモバイル回線または Wi-Fi につないでおくこと
必要な権限・設定(センサー・位置情報・通知・バッテリー最適化の除外・メーカー独自の省電力設定の除外)を許可し、維持すること
利用したい検知機能を ON のままにし、各設定の意味を理解しておくこと
アプリ内の見守り稼働表示を定期的(毎日を推奨)に確認し、ガーディアン側の画面でシニアの活動状況が更新されていることを確認すること(週 1 回、および機種変更・OS アップデート・設定変更のあとを推奨)
本アプリに頼らない、日ごろの直接の連絡(電話・訪問など)と緊急時の連絡手段を維持すること
本アプリは、直接の連絡・介護・公的な緊急サービスの「代わり」には決してなりません。あくまで補助としてお使いください。
ここまで述べてきたとおり、本アプリには技術的・サービス的な限界が多くあります。これを踏まえ、本アプリのご提供形態と、開発者の責任の範囲について、以下のとおり明記します。
本アプリは「現状有姿(AS IS)」かつ「利用可能な状態(AS AVAILABLE)」で提供されます。当社は、本アプリについて、明示・黙示・法定を問わず、いかなる保証も行いません。これには次の保証を含みます(ただしこれらに限られません):
商品性(特定の品質を備えていること)
特定目的への適合性(お客様の目的に役立つこと)
検知・通知の正確性・確実性・即時性
中断のない継続的な動作
第三者の権利を侵害しないこと
また、当社は保険会社ではありません。本アプリの利用料金(無料でご利用いただく場合を含みます)は、生命・身体・財産の価値に応じて算定された保険料ではなく、万一の損害を当社が引き受けるための対価でもありません。万一に備えた補償が必要な場合は、保険等を別途ご準備ください。
本アプリは、以下のいずれにも該当しません:
医療機器(薬機法(医薬品医療機器等法)上の医療機器)
緊急通報サービス(消防法・電気通信事業法上の緊急通報番号)
個人緊急対応システム(PERS:Personal Emergency Response System)
医療・安全・介護の専門サービスの代替
本アプリは、日本の薬機法上の承認・認証を受けておらず、米国 FDA をはじめ、いかなる国の規制当局による審査・承認も受けていません。
医療上の判断・治療方針の決定に本アプリを用いないでください。
本アプリの利用または利用不能によってお客様または第三者に生じた損害に関する当社(開発者であるウォーター株式会社)の責任は、法的拘束力を持つ責任の制限条項を定める利用規約 第 11 条(責任の制限)に定める範囲に限られます。本免責事項は、これに重ねて独自の全部免除を宣言するものではなく、技術的・サービス的な限界(前章で述べた、検知・通知が遅れる・行われないことがある等)をご理解いただくための説明です。
利用規約 第 11 条のとおり、当社が責任を負う場合であっても、賠償の総額は同条所定の上限(無料でご利用の場合は 1,000 円)が適用されます。次のような損害は、法令で認められる範囲において、当社は責任を負いません(ただしこれらに限られません):
健康被害
精神的苦痛・慰謝料
財産的損害・逸失利益
直接損害・間接損害・特別損害・派生的損害・付随的損害
これは、当社が損害発生の可能性をあらかじめ知らされていた場合であっても同様です。
ただし、当社の故意または重大な過失による損害については、この限りではありません(消費者契約法 第 8 条 第 1 項に基づき、当社の故意または重過失による責任を全部免除する条項は無効とされるため、本条項はこれを除外します)。また、当社の過失(軽過失を含む)による生命・身体の侵害(人身傷害・死亡)については、本免責事項および利用規約 第 11 条の損害賠償の制限は適用されません。【弁護士判断:軽過失による人身損害の留保文言の最終確定】
本アプリをご利用いただくことにより、お客様は、本アプリの上記の限界をご理解いただいたうえで、ご自身の判断と責任において本アプリをご利用いただくものとし、本アプリへの依存に伴う一切のリスクをお客様ご自身でお引き受けいただくものとします。
本アプリについてご不満やトラブルがあるときは、訴訟その他の法的手続をとられる前に、まず「9. お問い合わせ」の窓口(water.inc.holdings@gmail.com)へ、内容とご希望の解決方法をお知らせください。当社は、ご連絡をいただいてから 60 日間を目安に、誠実に協議のうえ解決に努めます。多くの問題は、この話し合いで速やかに解決できると考えています。
本免責事項は、利用規約の一部を構成します。本免責事項には、利用規約に定める準拠法(日本法)、合意管轄および分離可能性(可分性)に関する条項(利用規約 第 14 条・第 15 条)が同様に適用されます。本免責事項のいずれかの条項が無効または執行不能と判断された場合でも、残りの条項は引き続き有効に存続します。本免責事項の各条項は、アカウント削除後も、その性質上存続すべき範囲で引き続き適用されます。
繰り返しになりますが、緊急のときは本アプリだけに頼らないでください。
生命に関わる緊急時:迷わず 119 番(消防・救急)へご連絡ください(海外でご利用の場合は、お住まいの国・地域の緊急番号へ)
事件・事故:110 番(警察)へご連絡ください(海外でご利用の場合は、お住まいの国・地域の警察番号へ)
健康相談:かかりつけの医療機関、または「#7119」(救急相談センター・地域により異なる)
本アプリは、ご家族が「気付くきっかけ」を増やすためのツールです。気付いた後の対応は、ご家族や公的サービスのお力に委ねられます。
緊急番号について:本サービスは現在、日本国内向けに提供しているため、本免責事項では日本国内の番号(119・110・#7119)を中心に記載しています。海外でご利用の場合は、お住まいの国・地域の緊急番号をご利用ください(英語版では各国の代表的な番号を併記しています)。
本アプリの利用は、ご本人(シニアユーザー)の同意のもとで行われることを前提としています。以下のような目的での利用は、本アプリの利用規約で禁止されており、当社では対応できません。
配偶者・家族・知人を当人の同意なく追跡・監視する目的
ストーカー行為など、他人の自由・安全を脅かす目的
業務上の従業員管理・行動追跡など、本アプリの想定用途を外れる利用
本アプリの見守り連携は、原則として、見守られる側のシニアユーザーがアカウントを作成し、招待コードをご家族に渡すというご本人の能動的な操作によって成立します。詐取された招待コードや、ご本人の意思に反する連携については、当社では検知・防止することができません。利用者ご自身の責任において、招待コードの管理と連携先の確認をお願いします。
ただし、初回の招待コード連携が成立した後は、代表ガーディアンが QR コード等で追加する共同管理者(追加の管理者)や、施設プランをご利用の場合の施設職員も、シニアユーザーご本人の個別の同意を都度求めることなく、シニアユーザーの情報(位置・音声・活動状況等)にアクセスし得ます(詳細はプライバシーポリシー §6.1 https://sites.google.com/site/keicesoftjp/mimamori/mimamori_privacy をご参照ください)。【弁護士判断:シニアユーザー本人の個別同意を都度求めない共同管理者・施設職員の追加運用の適法性(個人情報保護法上の第三者提供/共同利用のいずれで整理するか)】
ここまでお読みいただいたとおり、本アプリには技術的・サービス的な限界が多くあります。それでも、私たちは、
「もしものとき、もう少し早く気付ければ…」というご家族の思い
「離れて暮らす親が心配だけれど、毎日電話するのは負担…」というご家族の状況
「一人暮らしだけれど、家族には心配をかけたくない…」というご本人の気持ち
——こうした方々の助けに少しでもなれればという思いで、本アプリを提供しています。
本アプリは「気付ける可能性を高めるツール」です。安全を保証するものではないこと、検知が遅れる・届かないことがあり得ること、緊急時は本アプリだけに頼らないでいただくこと——これらをご家族の間でも共有のうえ、ご活用いただければ幸いです。
当社は、必要に応じて本免責事項を変更することがあります。重要な変更を行う場合は、変更の効力発生日の少なくとも 30 日前までに、本アプリ内またはウェブ上で告知します。重要な変更の場合、変更後に本アプリの初回起動時等に再度のご同意をお願いすることがあります。本免責事項の版(バージョン)および発効日は、本文冒頭のヘッダおよび末尾の「改訂履歴」で管理します。

This page explains, in plain language, what you need to know before relying on the Mimamori app. Mimamori helps families keep an eye on elderly relatives who live alone, but it cannot guarantee safety or life. Please read and accept what is described on this page before you use the App.
PLEASE READ THIS PAGE CAREFULLY. IT CONTAINS DISCLAIMERS OF WARRANTIES, AN EXPRESS ASSUMPTION OF RISK, LIMITATIONS OF LIABILITY, AND DISPUTE-RESOLUTION TERMS — INCLUDING A CLASS-ACTION WAIVER AND A ONE-YEAR TIME LIMIT FOR BRINGING CLAIMS, WHERE PERMITTED BY LAW — THAT AFFECT YOUR LEGAL RIGHTS.
⚠️ IMPORTANT: In an emergency, do not rely on the App alone. Please call the appropriate public emergency service for your location — in Japan dial 119, in EU countries dial 112, in the United States dial 911, in the United Kingdom dial 999, in Australia dial 000, and elsewhere please use your country's emergency number.
Mimamori is software that helps families monitor their elderly relatives. Using the smartphone's built-in accelerometer, GPS, and other sensors, the App tries to detect inactivity, falls, and SOS events, and to notify a Guardian (a linked family member).
However, the App:
Is not a medical device. It is not designed for diagnosing, treating, or preventing any health condition, and it is not authorized as a medical device under any country's medical device regulations.
Is not an emergency-dispatch service. It is not directly connected to public emergency response infrastructure such as 119 / 112 / 911 / 999, and notifications from the App are sent only to the Guardian Users you have linked.
Is not a safety guarantee service. Installing the App does not guarantee that you will always notice a problem. As described below, detection and notification can be delayed or may not happen at all.
Is not a monitoring center. No person at the developer watches, reviews, or responds to your data or alerts. The Service is fully automated software: detections and notifications are generated and delivered by machines, without human review. We do not undertake any duty to observe any User, to detect any particular event, to deliver any particular notification, or to summon, dispatch, or provide help.
Please think of the App as a supplementary tool that improves the chance of noticing a problem, not as a guaranteed safety net.
Geographic scope. The Service is currently offered and directed solely to users located in Japan. We make no representation that the App is appropriate, lawful, or available for use in any other country, and we do not target or solicit users outside Japan. If you nevertheless install or use the App from outside Japan, you do so on your own initiative and at your own risk, and you are responsible for compliance with your local laws. This English text is provided for the convenience of English-speaking users located in Japan.
The App is intended for users aged 16 or older, and is to be used with the consent of the Senior User who is being monitored. If you are under the age of majority in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian. If you set up the App for, or accept the Terms of Service or this Disclaimer on behalf of, a Senior User, you represent and warrant that the Senior User consents to being monitored and that you have the authority to accept these documents on the Senior User's behalf (for example, with the Senior User's informed consent, or as the Senior User's legal representative); in that case, references to "you" include the Senior User.
We cannot, in technical practice, guarantee perfect detection or delivery of notifications. Below are concrete examples of situations in which detection or notification may be delayed or may not happen at all.
Notifications travel from the Senior User's phone, through Google's cloud servers (Firebase), to the Guardian User's phone. If communications fail or are delayed anywhere along that path, notifications may not arrive — or may arrive late.
Example: the Senior User's home is in an area with poor mobile signal.
Example: the home Wi-Fi router malfunctions or is unplugged.
Example: a large-scale outage at the mobile carrier (the kind that affects a whole country once every few years).
The App cannot operate if the device is off. If the battery is depleted, the device is switched off, or the device is broken, no detection or notification will occur.
The App includes a low-battery notification feature (the default threshold is 5%) to help Guardians notice before the battery is fully depleted. However, the device can run out of power before that notification arrives.
Android may restrict the App's background activity to save battery or to keep the system stable.
Example: the "Battery optimization" feature restricts the App from running in the background.
Example: Android forcibly stops the App (e.g., under low-memory conditions).
Example: the user, or another app, executes "Force stop" on the App.
Example: some device manufacturers ship proprietary battery-saving or "app cleaning" functions that terminate background apps far more aggressively than standard Android — on some models, monitoring can stop even after the standard Battery Optimization exemption has been granted.
The App requests an exemption from Battery Optimization during first-run setup, but if this setting is not granted (or is later changed), operation can stop. Where your device has manufacturer-specific power-management settings, please also exempt the App there, and check the App's monitoring-status display regularly.
Location is obtained from GPS satellites. In some places, accurate location cannot be obtained, or location data cannot be obtained at all.
Indoors (especially basements, reinforced concrete buildings, elevators)
High-rise urban areas (signal reflection introduces large errors)
Mountainous areas or tunnels
When the device is in airplane mode, or when location services are turned off
Also note: the location attached to an SOS or other alert is the most recently stored location, which may be up to about 15 minutes old (or older, if no newer location could be obtained). It may therefore differ from the User's actual location at the time of the event.
Inactivity and fall detection are based on the values read from the device's accelerometer.
Missed detection examples: the device is in a bag or coat and cannot pick up motion well; the user fell, but the device became separated from the user and stopped moving on its own; activity within the inactivity threshold causes the system to consider the user "active."
False positive examples: the device was dropped or shaken hard; a vehicle's sudden braking shook the device and was classified as a fall.
For fall detection, to allow for false positives, the App shows an "Are you okay?" check for 60 seconds before alerting the family, giving the user time to dismiss the alarm. Even with this safeguard, false positives and missed detections cannot be fully eliminated.
The App has settings that you can adjust. Depending on those settings, the App's detection and notification behavior changes.

For example, if the Senior turns off "Inactivity detection" or "Location sharing," notifications and location data will no longer reach the Guardian. The App tries to show the Guardian that the Senior has turned a feature off, but we strongly recommend that families discuss the meaning of these settings together.
The App relies on the following external services. If any of these services experiences an outage, some or all of the App's features may be unavailable.
Google Firebase (authentication, database, push notifications)
Mobile carriers and internet service providers
Earthquakes, typhoons, heavy snow, wars, terrorism, large-scale power outages, and any other events outside our reasonable control may cause all or part of the Service to become unavailable.
The Service is not a real-time alarm system.
Inactivity is evaluated periodically on the server (approximately every 15 minutes) against the threshold you configure (30 minutes to 48 hours). By design, an inactivity alert arrives only after the configured period has elapsed — potentially many hours after the underlying event.
Fall alerts are sent only after the on-device confirmation window ("Are you okay?", 60 seconds) and any escalation steps have passed.
Notifications are delivered through Google's push-notification infrastructure (Firebase Cloud Messaging), which is a best-effort service: delivery can be delayed by the network or by the receiving device's power-saving state, and no delivery time is guaranteed.
The App can help only if it is set up and maintained correctly. The following are things that you — the Senior User and the Guardian Users, together as a family — are responsible for doing:
keeping the Senior User's device charged, powered on, and carried on or near the Senior User;
keeping the device connected to a working mobile or Wi-Fi network;
granting and maintaining the required permissions and settings (sensors, location, notifications, the Battery Optimization exemption, and any manufacturer-specific power-management exemptions);
keeping the detection features you rely on turned ON, and understanding what each setting does;
checking the App's monitoring-status display regularly (we recommend daily), and confirming on the Guardian's screen that the Senior User's activity status is updating (we recommend weekly, and after every device change, OS update, or settings change);
maintaining regular direct contact with the Senior User (calls, visits) and independent emergency arrangements that do not depend on the App.
The App is a supplement to — never a replacement for — direct human contact, caregiving, and professional emergency services.
Building on the technical and service-level limitations described above, we set out below the basis on which the App is provided, and the scope of the developer's liability.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER (WATER INC.) AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND CONTRACTORS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION:

THE DEVELOPER IS NOT AN INSURER. ANY FEES FOR THE SERVICE ARE NOT INSURANCE PREMIUMS: THEY ARE NOT RELATED TO THE VALUE OF THE SENIOR USER'S LIFE, HEALTH, OR PROPERTY, AND THEY DO NOT COMPENSATE THE DEVELOPER FOR ASSUMING ANY RISK OF LOSS. IF YOU WANT PROTECTION AGAINST SUCH LOSS, YOU SHOULD OBTAIN APPROPRIATE INSURANCE. THE DISCLAIMERS AND LIMITATIONS IN THIS DISCLAIMER AND IN SECTION 11 OF THE TERMS OF SERVICE REFLECT THIS ALLOCATION OF RISK, WHICH IS A PART OF THE BARGAIN BETWEEN YOU AND THE DEVELOPER AND IS REFLECTED IN THE PRICE (INCLUDING A FREE PRICE) OF THE SERVICE.
The App is NONE of the following:
A medical device under any country's medical-device, drug, or health-product regulations (including but not limited to the U.S. Food, Drug, and Cosmetic Act; EU Medical Device Regulation (EU) 2017/745; Japan's Pharmaceuticals and Medical Devices Act; UK MHRA regulations)
An emergency-dispatch or 911 / 112 / 999 service, or any other public emergency-response infrastructure
A Personal Emergency Response System (PERS)
A substitute for professional medical, safety, or caregiving services
The App has not been reviewed, cleared, or approved by the U.S. Food and Drug Administration (FDA), by Japan's PMDA, or by any other medical-device regulator. It is offered as a general family-awareness aid and makes no medical, diagnostic, therapeutic, or preventive claims.
DO NOT USE THE APP FOR ANY MEDICAL DECISION, DIAGNOSIS, OR TREATMENT, OR AS YOUR PRIMARY MEANS OF SUMMONING EMERGENCY HELP.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER (WATER INC.) OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR CONTRACTORS BE LIABLE FOR ANY:
DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
DAMAGES FOR PERSONAL INJURY, DEATH, OR LOSS OF LIFE
DAMAGES FOR EMOTIONAL DISTRESS OR MENTAL ANGUISH
DAMAGES FOR LOSS OF PROFITS, REVENUE, BUSINESS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
DAMAGES FOR LOSS OR DAMAGE TO PROPERTY
ARISING OUT OF OR RELATED TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE APP, OR YOUR RELIANCE ON ANY DETECTION OR NOTIFICATION (OR THE ABSENCE OR DELAY THEREOF), WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Where, despite the foregoing, the developer is found liable, the developer's aggregate liability is subject to the monetary cap set out in Section 11.3 of the Terms of Service (which is the legally binding limitation-of-liability provision).
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE APP, THE SERVICE, OR THIS DISCLAIMER IS TO STOP USING THE APP AND DELETE YOUR ACCOUNT (TOGETHER WITH ANY REFUND EXPRESSLY PROVIDED FOR BY THE STORE'S REFUND POLICY, FOR PAID PLANS).
To the fullest extent permitted by applicable law, the exclusions and limitations in this Section 3 and in Section 11 of the Terms of Service also apply to claims brought by or on behalf of a User's heirs, estate, executors, family members, successors, or assigns — including wrongful-death and survival claims — and each User accepts these provisions on their own behalf and, to the extent permitted, on behalf of those persons.
Mandatory-law carve-out. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities (for example, for personal injury caused by negligence, or for fraud or willful misconduct). In those jurisdictions, the exclusions and limitations above apply only to the extent permitted by applicable law, and the developer's liability is limited to the minimum permitted by law. In particular, under the Consumer Contract Act of Japan (Article 8, Paragraph 1), provisions that fully exclude the developer's liability for damages caused by the developer's willful misconduct or gross negligence are void; the provisions above are not intended to, and do not, exclude such liability. Notice to New Jersey residents: the exclusions and limitations in this Disclaimer are intended to apply to you only to the extent permitted by New Jersey law, and nothing in this Disclaimer limits or waives any right or remedy that New Jersey law does not permit to be limited or waived.
BY USING THE APP, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ AND UNDERSTOOD THE LIMITATIONS DESCRIBED IN THIS DISCLAIMER, THAT YOU USE THE APP AT YOUR OWN RISK AND AT YOUR OWN JUDGMENT, AND THAT YOU EXPRESSLY AND VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH YOUR USE OF, AND RELIANCE ON, THE APP, INCLUDING WITHOUT LIMITATION THE RISKS THAT:
A FALL, A PERIOD OF INACTIVITY, AN SOS, OR ANY OTHER EVENT IS NOT DETECTED, OR IS DETECTED LATE;
A NOTIFICATION IS DELAYED, MISDELIVERED, OR NEVER DELIVERED;
LOCATION INFORMATION IS INACCURATE OR OUTDATED (INCLUDING UP TO ABOUT 15 MINUTES OLD, OR OLDER);
MONITORING STOPS OR DEGRADES BECAUSE OF DEVICE, BATTERY, NETWORK, OPERATING-SYSTEM, MANUFACTURER POWER-MANAGEMENT, CONFIGURATION, OR THIRD-PARTY SERVICE CONDITIONS;
FALSE ALARMS OCCUR; AND
INJURY, DEATH, OR PROPERTY DAMAGE OCCURS THAT MIGHT HAVE BEEN AVOIDED IF DETECTION OR NOTIFICATION HAD OCCURRED EARLIER OR AT ALL.
THIS EXPRESS ASSUMPTION OF RISK IS A MATERIAL PART OF THE BASIS ON WHICH THE DEVELOPER OFFERS THE APP. IT IS MADE BY EACH USER ON THEIR OWN BEHALF AND, TO THE EXTENT PERMITTED BY APPLICABLE LAW, ON BEHALF OF THE USER'S HEIRS, ESTATE, AND SUCCESSORS.
You agree to indemnify, defend, and hold harmless the developer (Water Inc.) and its affiliates, officers, employees, agents, and contractors from and against any and all third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the App, your violation of this Disclaimer or the Terms of Service, or your violation of any applicable law or the rights of any third party.
The developer provides automated software only. The developer does not operate a monitoring center, does not employ or engage any person to watch, review, or respond to Users' data or alerts, and does not undertake to protect the safety of any person. Nothing in the Service, this Disclaimer, or the Terms of Service creates any fiduciary, custodial, caregiving, bailment, or other special relationship between the developer and any User or monitored person, and the developer assumes no duty of care beyond the express commitments stated in the Terms of Service. No voluntary act by the developer (for example, answering a support inquiry) shall be construed as an undertaking to render protective services or as an assumption of any such duty.
(a) Talk to us first (mandatory informal resolution). If you have any concern, complaint, or claim, you agree to contact us first at water.inc.holdings@gmail.com (subject: "Mimamori — Dispute Notice") with a written description of the issue and the remedy you seek, and to try in good faith to resolve the matter with us informally for at least 60 days before starting any court or other formal proceeding. Most issues can be resolved this way, quickly and at no cost to you.
(b) Individual capacity only. To the fullest extent permitted by applicable law, any claim against the developer must be brought in your individual capacity only, and not as a plaintiff or member of a class in any purported class, collective, consolidated, or representative proceeding.
(c) Jury waiver. To the extent a dispute proceeds in a court that gives effect to pre-dispute jury-trial waivers, you and the developer each waive any right to a trial by jury. (This waiver does not apply where such waivers are not enforceable — for example, in California state courts.)
(d) Time limit for claims. To the fullest extent permitted by applicable law, any claim arising out of or relating to the App, the Service, or this Disclaimer must be filed within one (1) year after the claim accrues; claims not filed within that period are permanently barred. This limit does not apply where prohibited by mandatory law.
(e) Forum and governing law. Except where mandatory consumer-protection law of your place of residence provides otherwise, disputes are governed by Japanese law and are subject to the exclusive jurisdiction of the Tokyo District Court, as set out in Section 14 of the Terms of Service.

This Disclaimer forms part of the Terms of Service. The governing law (Japanese law), jurisdiction, and severability provisions of the Terms of Service (Sections 14 and 15) apply equally to this Disclaimer. If any provision of this Disclaimer is held invalid or unenforceable, the remaining provisions will continue in full force and effect. Sections 3-1 through 3-7 of this Disclaimer survive any deletion of your Account and any termination of the Terms of Service.
We have said this above, but it is worth saying again: in an emergency, do not rely on the App alone.

The App is a tool that increases the chance that families will notice a problem. The response after noticing depends on the family and the public services in your country.
The App is designed to be used with the consent of the Senior User. The following uses are prohibited by the Terms of Service, and we cannot support them:
Tracking or monitoring a spouse, family member, or acquaintance without that person's consent
Stalking or any other conduct that threatens another person's freedom or safety
Workplace employee monitoring or movement tracking, or any other use outside the App's intended purpose
As a rule, linking happens when the Senior User actively creates an account and shares an invite code with their family. We cannot detect or prevent linking that occurs through stolen invite codes or against the Senior User's will. Please manage your invite code carefully and verify who you are linking with.
However, after the initial invite-code link has been established, co-managers (additional administrators) added by the representative Guardian via QR code, and — under the Facility Plan — facility staff, may also access the Senior User's data (location, audio, activity status, and so on) without the Senior User's separate, per-instance consent (see Privacy Policy §6.1 for details: https://sites.google.com/site/keicesoftjp/mimamori/mimamori_privacy). 【弁護士判断: Lawfulness of adding co-managers / facility staff without the Senior User's per-instance consent (APPI third-party provision vs joint use)】
Audio recordings. When an SOS is triggered, the App records about 10 seconds of ambient audio, which may capture the voices of people nearby. You are responsible for using the App — including its recording feature — in compliance with the laws that apply to you, including any laws that require the consent of the persons being recorded.
As you have read, the App has many technical and service-level limitations. We have built it nonetheless, in the hope that it can help:
families who think, "If only we had noticed a bit earlier..."
families who think, "I worry about my distant parent, but calling every day is a burden..."
elderly users who think, "I live alone, but I don't want to worry my family..."
The App is a tool that increases the chance of noticing. It is not a safety guarantee. Detection may be delayed or may not happen at all. In an emergency, please do not rely on the App alone. We hope that families will discuss these limits together and use the App with that understanding.
We may amend this Disclaimer as needed. If we make a material change, we will give notice at least 30 days before the change takes effect, in the App or on the web. For material changes, we may ask you to consent again (for example, via the first-launch modal). The version and effective date of this Disclaimer are tracked in the header above and in the Revision History below.
