In partial modification of this Department Order No.6853-J dated 20.11.2006, I am directed to say that the Governor has been please to sanction w.e.f. 1st day of November, 1999 reimbursement in respect of water and electricity charges consumed by the Judicial Officers of this State as aforesaid at their residence subject to the limit specified as under:-
Designation of the Judicial Officer
All members of the West Bengal Judicial Service including erstwhile members of West Bengal Civil Service (Judicial) and West Bengal Higher Judicial Service.
Electricity Charges
50% charges of electricity to be paid on quarterly basis subject to production of bills.
Water Charges
50% charges of water consumed, where levied to be paid on quarterly basis subject to production of bills from the concerned Municipal Corporation as the case may be.
The charge will be debited under the detailed head “14-R.R.T.” & the sub-detailed head “13-Office Expenses -01 -Electricity” under the major /minor heads from which salaries of the members of the Judicial Officers are drawn.

I am directed to say in super session of all previous orders issued in this respect, the Governor is pleased to order that evetry member of the West Bengal Judicial Service will be provided with a telephone at his Court and residence with STD facilities except Civil Judge (Sr. Divn.) and Civil Judges (Jr. Divin.) with effect from 1.11.1999 at the rates given below:-
Provided further that retired Judicial Officers including members of erstwhile Higher Judicial Service or those who are elevated from State Judicial Service will also be entitled to get the benefit from 1.11.1999 till date of their retirement or elevation as the case may be and draw reimbursement from which the salaries of the Judicial Offcers was last drawn.
Provided further that the concerned office shall bear the expenses of the installation and bimonthly payments of the telephone bills upto the aforesaid ceiling and that the excess calls if any, shall be borne by the concerned Judicial Officers.
The charges shall be met from the sub-detailed head '02-Telephone' subordianate to the datailed head '13- Office Expenses' under the major/minor heads from which the salaries of the concerned Judicial Officers are being drawn.\

Sir,
I am directed by order of the Governor to say that a member of West Bengal Judicial Service who owns car and does not use pool car will be entitled to 75 litres of petrol or diesel in 'A' and 'A1' city and 50 litres of petrol or diesel in all other district and sub-divisional centres or equivalent price thereof per mensum. A Judicial Officer who owns a scooter and does not use pool car will also be entitled to 25 litres of petrol or equivalent price thereof per mensum irrespective of his place of posting.
It is also clarified that the classification of the cities on the basis of population criteria as adopted by the State of West Bengal will be the criteria for determining the status of 'A' and 'A1' city mentioned above.
This order is issued in compliance with the direction of the Hon'ble Supreme Court of India dated 06.12.2005 read with order dated 07.02.2006 passed in Writ Petition (Civil) No.1022 of 1989 and with the concurrence of the Finance Department vide their U.O. I am directed by order of the Governor to say that Governor has been pleased to allow all Judicial Officers of West Bengal Judicial Service with retrospective effect from the 1st November, 1999 to encash leave not exceeding one month in a block period of two years.
Provided further that member os erstwhile West Bengal Higher Judicial Service will also be entitled to such benefit w.e.f. 01.11.1999 till the date of their retirement or elevation to High Court as the case may be.
The bills of retired Judicial Officers or those who are elevated to High Court may be sent drawn from the establishment where their last pay bills were drawn.
The Governor has also been pleased to decide that notwithstanding anything contained in any other circular/Rule framed by the State Government in this matter the benefit of availing encashment of leave will be extended to all Judicial Officers of the West Bengal Judicial Service without insisting on the availment of leave simulteneously.
The charge will be debitable from such detailed/sub-detailed head of accounts as will be assigned by your office.

I am directed to invite a reference to above and to say that in supersession of all previous orders issued in this respect, the Governor has been pleased to sanction with retrospective effect from the 1st April, 2007 Leave Travel Concessuion to all member of West Bengal Judicial Service once in four years to any place in India. For entitlement of first LTC one must have put in not less than 5 years of continuous service. No LTC shall be allowed within one year before retirement.
Provided further that there shall not be any carry forward of LTC beyond retirement and the rate of such concession will be admissible as per the prevailing LTC Rules of the Central Government.

Sir,
I am directed to invite a reference to the above and to say that in supersession of all previous orders issued in this respect the Governor has been pleased to sanction Composite transfer grant with retrospective effect from 1st April, 2007 to all members of West Bengal Judicial Service. The Composite Transfer grant shall be equal to one month's Basic Pay in case of transfer involving change of station located at a distance more than 20 kms from each other.
In case of transfer to stations which are less than 20 kms from the old station or transferred within the same city, the Composite transfer grant will be restricted to one third of the Basic Pay provided a change of residence is actually involved.
This excludes incidental expenses of the Government Servant and members of his family and expenses to go from the residence to Railway Station, Bus Stand/Air Port.

Sub : Admissibility of medical facilities to the serving and retired Judicial Officers
of the West Bengal Judicial Service.
Sir,
I am directed to say that in supersession of all previous circulars issued regarding medical facilities of all serving judicial officers and in partial modification of Memo No.10771-F dt. 29.11.2004 the Governor has been pleased to grand the following medical facilities to both the serving and retired Judicial Officers of the West Bengal Judicial Service:-
I All serving and retired judicial Officers shall get medical allowances @ Rs.100 per mensem.
II The serving and retired Judicial Officers and Membners of their family shall be given medical benefits that are provided to the members of the West Bengal Legislative Assembly subject to the following conditions:-
i. That such medical facilities shall be available if the same is rendered by Government Hospitals and dispensary that all Government Hospitals, District Hospitals and Sub-Divisional Hospitals and Hospitals at Block Levels run by the State or West Bengal or in any Private Hospital or Nursing Home to be notified later on.
ii. That such Judicial Officers shall be entitled to claim expenses incurred by them for the medical attendance and the treatment obtained by them and their family members in such notified Hospitals/Dispensaries.
The expenses shall be inclusive of the charges for accommodation in the place where such treatment is taken.
iii. That such Judicial Officers shall be entitled to reimbursement of the expenses incurred by them or for their family members for the medical attendance and treatment obtained by them or for their family members for the in any place other than in a hospital or dispensary maintained by the Stage Government and other than the hospitals or dispensary maintained by the State Government, to the same extent as they are entitled to under the rules for reimbursement of expenses incurred by them for medical attendance and treatment obtained in the notified Hospital or Dispensary. Expenses shall be inclusive of charges for accommodation.
iv. There should not be any restriction on reimbursement exept to the extent of in-patient room entitlement. Further, there should not be any ceiling on reimbursement of expenditure on expensive treatment like kidney transplant, open heart surgery etc; full reikbursement of actual expenses should be allowed.
v. All District Judge, Chief Judge, City Civil Court, Calcutta, Chief Judge, City Sessions Court, Calcutta, Regostrar General, High Court, Calcutta and the Heads of the department in which Judicial Officers are on deputation should be notified as the competent authority for passing the bill for reimbursement of medical attendance and expenses of Judicial Officers under him and in case of District Judges, the High Court should be the sanctioning authority.
vi. All claims of reimbursement of the expenses incurred by Judicial Officers for themselves or for their family members should be accompanied by an “Essentiality Certificate” issued by the Authorized Medical Attendant with the ills for reimbursement, supported by the prescription and vouchers or cash memos.
vii. Judicial officers shall be entitled to advances to meet the medical erxpeses for treatment upto 80% of the estimate and the balance to be paid after approving the bill when it is produced.

It has come to the knowledge of the Govt. that the retired Judicial Officers of West Bengal Judicial Service have been facing problems regarding drawal of medical reimbursement benefit as residence after retirement in many cases is far away from their last work places. This matter has been under active consideration of the Government and after careful consideration of the matter it has since been decided to modify partially the provision of the Department’s Order No.1313-J dt. 17.03.06 for overcoming the problem in question.
Accordingly, in partial modification of this Department Order No.1313-J dt. 17.03-2006 on the subject noted above, I am directed to say that the Governor has been pleased to order that the District Judge of the District where a retired Judicial Officer resides after his retirement and in case of a Judicial Officer residing after retirement in Kolkata, the Chief Judge, City Civil Court/ City Sessions Court as the case may be, would be the competent authority for passing the bills for reimbursement of medical attendance and expenses incurred by him for self and other members of his family and would also act as D.D.O. All other terms and conditions as laid down in this Department’s Order No.1313-J dt. 17.03-06 will remain unaltered as before.
This order will be effective from the date of its issue.
This Order issues with the concurrence of the Finance Deptt. Vide their U.O. NO.m-509 Gr. P (Service) dt. 21.7.08.

Such allowances shall be included in the revised P.P.O. of the pensioner concerned and the payment shall be made on the basis of a certificate to be issued by the pensioner himself/herself to the satisfaction of the disbursing authority of the pensioner benefit.

After careful consideration of the matter in partial modification of this Department’s G.O. No.5282(18)-J dated 2nd September, 2003 the Governor has been pleased to order that all Judicial Officers in the rank of Civil Judge (Jr.Divn.), Civil Judge (Sr. Divn.) and and District Judge of the West Bengal Judicial Service shall be entitled to one national and one regional Newspaper and one Magazine as per his entitlement through his local hawker upon payment at the first instance and the officer would claim reimbursement from the office after purchasing the original bill.

I am directed to invite a reference to the above and to say that the Governor is pleased to order that w.e..f. 1.11.99 all members of the West Bengal Judicial Service shall be entitled to concurrent charge allowance irrespective of their place of posting at the rate of 10% of the minimum of the time scale of the additional post held when they are placed in charge of another court continuously beyond that period of ten working days provided they perform appreciable judicial work of that court.
Retired Judicial Officers including members of erstwhile Higher Judicial Service of those who are elevated from /state Judicial Service will also be entitled to get the benefit from 1.11.99 till date of their retirement or elevation as the case may be and draw the arrears from the establishment from which their last pay was drawn.

In compliance with the directions of the Supreme Court of India in respect of providing residential accommodation to all Judicial Officers in the State of West Bengal the Governor has been pleased to lay down the following guidelines:
Top-most priority should be given for allotting Govt. Quarters to the Judicial Officers;
Attempts should be made for requisitioning the private house in the event Govt. accommodations are not available readily;
Attempts should be made for requisitioning the private houses which are occupied by Judicial Officers and in case, it is not possible to make such requisition of those house/flats, the amount of rent paid by such officers for the hired house in excess of House Rent Allowance admissible to them under normal rules would be borne by Govt. till they are provided with accommodation owned/hired by Govt. In such cases, the floor space of the hired house shall not be much in excess of the admissible limit.
This order issues with the concurrence of Finance Department vide their U.O. No. Group P (Service) No.2542 dated 30.8.95.

Sub: Implementation of the recommendation of the Shetty Commission for the STENOGRAPHERS attached to the different sub-ordinate courts in the State - Regarding recruitment rules, promotion policies, qualifications, and traveling allowances etc..

In compliance with direction of the Hon’ble Supreme Court of India dt. 11.2.09 passed in I.A. No.s 71A, 135-136, 137-138 and 142 in w. p. ( c) No. 1022/1989 and as per the decision taken in the matter in the meeting held in the chamber of the Principal Secretary, Finance Department of West Bengal on 30.3.09, I am directed by order of the Governor to say that the Governor has been pleased to decide to implement the following recommendations w.e.f. 01.4.03 :-
1) Stenographers in court will be classified into three grades :-
(i)Stenographer Grade-III ( Grade-C)
(ii)Stenographer Grade-II ( Grade-B)
(iii)Stenographer Grade-I ( Grade-A)
However, retention of the existing pay scales of Stenographer Grade-I ( Grade-A) is to be maintained hierarchical structure in the court administration.
2) Method of Recruitment , Promotion, Seniority and Status.
The existing method of recruitment and promotion to these three cadres will be continued but exclusively by the District Court Administration without any reference to the State Government.
There shall be a separate seniority list District wise for the Stenographers working in the Courts and promotion will be made in accordance with the said seniority list. Court Stenographers should not be included in the general seniority list maintained by the Government.
3) Personal Assistant to the Principal District & Sessions Judge and Principal City Civil Court Judge.
The incumbent of this post is to be selected by the Principal District Judge/ Principal City Civil Judge according to his choice amongst the Stenographers Grade-I. The post is designated as Executive Assistant to Principal District & Sessions Judge/ / Principal City Civil Court Judge. A special allowance of Rs. 200/- p. m. inclusive of Travel ling and Compensatory Allowance is recommended.
4) No. of Stenographers to be given to each Judge.
(a) Civil Judge ( Jr. Div.)/ Magistrate---- One Grade-III Stenographer
(b) Civil Judge( Sr.Div.)/CJM/CMM—One Grade-II Stenographer
(c) Principal Dist. & Sess. Judge---One Grade-I Stenographer and the Principal City Civil Court Judge—One Executive Assistant.
5) Pool of Stenographers.
In City Civil courts and in district Headquarters, where there is cluster of Courts, each Judge is to be provided with a Stenographer and there may be a pool of Stenographers to be determined by the High Court to meet the requirements.
6) Permission to switch over to ministerial / supervisory cadre:-
May be permitted after completion of a minimum period of service ( to be determined by the high Court).
7) This order is issued with concurrent of the Finance (A) Department vide there U.O. No. 156 Gr.’P’ (Service) dt. 01.06.09.
All concerned including all Treasury Officers, Calcutta Pay & Accounts Office-I & II, W.B. are also informed accordingly.

HIRING OF VEHICLES

MEMORANDUM
Sub:- Delegation of power to Heads of Departments to sanction retention of vehicles.
The undersigned is directed by the order of the Governor to say that the Governor is pleased to authorize the Additional Chief Secretary/Principal Secretary/Secretary of the Department to sanction retention of hiring of vehicles of that Department and its Subordinate offices on existing terms and conditions subject to the condition that the vehicle was originally hired with the approval of Finance Department and also subject to the condition that continuance of hiring is required in the interest of public service.
2. The undersigned is further directed to state that the Governor is also pleased to authorize the Additional Chief Secretary/Principal Secretary/Secretary of the Department to allow hiring of a new vehicle (Non-AC) as replacement of an existing one provided the existing vehicle was hired with the approval of Finance Department.
3. In all cases retention of a hired vehicle has to be sanctioned for a period not exceeding one year at a time.
4. While issuing sanction orders for retention of hiring of vehicles and allowing hiring of a new vehicle as replacement of existing one in exercise of the powers delegated under this memorandum, the following sentence should be inserted in such orders “The order issues in exercise of the powers delegated under Finance Department Memo No.1232-F(Y) dated 09-02-2012.”
5. For fresh hiring of vehicles concurrence of Finance Department will be required.
6. This order shall take immediate effect.

MEMORANDUM
In terms of Rule 3(6) of the West Bengal Services (Duties, Rights and obligations of the Government employees) Rules, 1980, a Govt. employee (other than a Group-D employee) is required to submit, once in a year, in the prescribed form to the appointing authority a return of movable and immovable property and other assets owned, acquired or inherited by him or any member of his family. s no form has been prescribed so long according to the provisions of the aforesaid rules, the state government employees have been submitting the return of movable and immovable property and other assets in the form prescribed in the Annexure-I to the West Bengal Government Servants’ Conduct Rules, 1959. As per instructions for filing up the said Form for ‘Declaration of Assets’ read with Memo. No.3571-F dated 30.03.2001, movable articles costing less than Rs.10,000/- for each item need not be mentioned. But for articles or materials costing Rs.10,000/- and above, declaration should be made for each item. On the other hand, in terms of Rule 5(2) of the West Bengal Services (Duties, Right and Obligations of the Government employees) Rules, 1980, read with Memo No.3571-F dated 30-03-2001, a Govt. employee is required to seek permission of his appoint authority in case of sale or purchase of movable property exceeding Rs.10,000/- in value subject to the conditions laid down therein.
2. References are being received from various concerns for increasing the above two figures viz. Rs.10,000/- in the Form for Declaration of Assents and Rs.10,000/- in rule 5(2) of the West Bengal Services (Duties, Rights and obligations of the Government employees) Rules, 1980, suitably in the present day context. The matter has been drawing attention of the Government for sometime past.
3. After careful consideration of all aspects, the Governor is pleased to decide as follows:-
(a) Until a separate form is prescribed as stated under rule 3(6) of the West Bengal Services (Duties, Rights and obligations of the Government employees) Rules, 1980, the Government employees other than Group-D employees shall continue to submit a Declaration of Assets as on the 1st January of the year by the 30th April of that year at the latest in the form prescribed in Annexure to the West Bengal Government Servants’ Conduct Rules, 1959.
(b) While submitting a return of movable articles in the Declaration Form of Assets, articles costing less than two months Basic Pay (Band Pay + Grade Pay) as on 1st January of the concerne4d year for each item need not be mentioned. However, for articles or materials costing two months Basic Pay (Band Pay + Grade Pay) and above each item should be mentioned in the relevant column of the form.
(c) Subject to the conditions laid down in the rule 5(2) of the West Bengal Services (Duties, Rights and Obligations of the Government employee) Rules, 1980, in the case of sale or purchase of movable property exceeding two months Basic Pay (Band Pay + Grade Pay) as on the date of such transaction a Government employee shall take prior sanction of his appointing authority, where necessary.
4. This order shall take immediate effect.
5. Formal amendment in the relevant rules shall be made in due course.
