Lack of Trustee: failure to name a trustee shows lack of intent and could cause the trust to fail. Settlor retains control over the trust assets by not segregating the funds from her personal funds that shows lack of intent and the trust fails. If the Settlor actively manages the trust assets, this shows lack of intent.
