ORDINANCE NO. 1310

 

AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE NO. 484 REGARDING THE ABATEMENT OF NUISANCES IN THE CITY OF GYPSUM, KANSAS, AS PREVIOUSLY AMENDED BY ORDINANCE NO. 973 (TO PROHIBIT THE RAISING, HARBORING, KEEPING OR MAINTAINING OF ANY LIVESTOCK WITHIN THE CITY LIMITS) BY FURTHER AMENDING SECTION 5 OF ORDINANCE NO. 484 TO PROVIDE AN EXCEPTION FOR CERTAIN MINIATURE AND/OR DWARF HOOVED ANIMALS BY PERMIT AND ANNUAL REGISTRATION; REPEALING SECTION 5 OF ORDINANCE NO. 484; AND REPEALING ORDINANCE NUMBER 973.

 

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF GYPSUM, KANSAS:

 

Section 1.  Amendment.  Section 5 of Ordinance No. 484 as previously amended by Ordinance No. 973 is further amended to read as follows:

 

  HOOVED LIVESTOCK PROHIBITED; EXCEPTION.   Sec. 5. 

 

(a)    General Prohibition.  The raising, harboring, keeping, or maintaining of any hooved livestock (including, but not limited to, cattle, swine, sheep, horses, and goats) within the corporate limits of the City is prohibited, subject only to the exception allowed pursuant to this section.

 

(b)   Exception; Permit.  The raising, harboring, keeping, or maintaining certain miniature and/or dwarf hooved animals is allowed within the corporate limits of the City subject to (1) application to the City by the person or persons responsible for the care of the subject animal(s) for a permit to be considered by the City’s governing body for issuance by the City; (2) approval of the application by the governing body for issuance of the permit by the City; and (3) as a condition of maintaining the permit, the annual registration of the subject animal(s), including a report on any change in the information upon which the permit was issued.

 

(c)    Criteria.  The governing body shall base its consideration of a permit application submitted pursuant to this section upon the following criteria:

 

(1)   Breed of each animal;

(2)   Current height and weight of each animal;

(3)   Estimated height and weight of each animal when fully grown;

(4)   Premises upon which the animal(s) are to be housed and cared for;

(5)   Size and characteristics of shelter provided for the animal(s);

(6)   Size and characteristics of the enclosed pen in which the animal(s) are to be kept; and

(7)   Proximity of the pen in relation to neighboring residences and public rights-of-way.

 

The governing body reserves the right to grant, deny, or precondition the granting of a permit based upon its evaluation of the permit application in relation to these criteria.

 

(d)   Proper maintenance.  It shall be unlawful for any person to keep or maintain any animal allowed pursuant to this section in a pen that is not (i) clean, dry, and sanitary; (ii) free from debris and odors which are offensive to a reasonable person of ordinary sensibilities and which adversely or unreasonably interfere with the use and enjoyment of property by emanating or crossing any property line; and (iii) free from rodents and vermin.

 

(e)    Inspection.  The premises upon which animals are kept or maintained pursuant to this section shall be subject to inspection by an authorized representative of the City or the Saline County Health Department.

 

(f)    Repeal or Suspension of Permit; Removal of Animal(s). If the responsible persons fail to annually register any animal(s) kept or maintained pursuant to this section in violation of this section or if an inspection of the premises results in the identification of a violation of this section, the responsible persons shall be given notice of the violation and a reasonable period of time under the circumstances to correct the violation.  If the violation is not corrected within the time period allowed, the responsible persons must appear before the governing body at its next regular or special meeting for a hearing to show cause why the permit issued pursuant to this section should not be suspended or revoked by the governing body and the animal(s) kept or maintained pursuant to this section be removed from the corporate limits of the City within a period of time determined by the governing body.  If the governing body determines that the violation of this section has not been timely corrected, the governing body may either suspend the permit (with conditions) or revoke the permit and order the responsible persons to remove the animal(s) from the corporate limits of the City no later than a deadline determined by the governing body.

 

Section 3.  Effective.  This ordinance shall be in full force and effect from and after its adoption and publication once in the official city newspaper by the following summary:

Ordinance No. 1310 Summary

On February 10, 2025, the Governing Body of the City of Gypsum, Kansas, passed Ordinance No. 1310.  The Ordinance amends Section 5 of Ordinance No. 484 regarding the abatement of nuisances in the City of Gypsum as previously amended by Ordinance No. 973 to prohibit the raising, harboring, keeping or maintaining of any livestock within the corporate limits of the City.  The Ordinance maintains the general prohibition against hooved livestock but adds an exception for certain miniature and/or dwarf hooved animals by permit and annual registration to be considered for approval by the governing body of the City based upon specific criteria outlined in the Ordinance.  The Ordinance repeals Section 5 of Ordinance No. 484 and Ordinance No. 973.
