Minutes of the 2024 Annual Members Election/Voting Meeting - 14 SEP 2024
Call to Order: The Board of Directors (BoD) President (Mark Freres) called the Bohicket
Landing Homeowners Association (BLHOA) Annual Members Election/Voting meeting to order
at 203 Dorovan Court and motioned that the meeting begin. The motion was seconded by the
attending members and the meeting began at approximately 9:37am.
Old Business: Members were reminded that the purpose of this meeting was to hold the election
for the two Board of Directors positions, treasurer and secretary.
1. Nominations: The floor was opened for nominations. Jack Tolman offered to continue to
serve on the BoD as a write-in and voting commenced.
2. Quorum: The quorum of 26 (60% of 44 members on the Record Date of 08 July 2024)
voting members/proxies was not met at the Annual Meeting on 13 July 2024, causing an
election/voting meeting to be held. The quorum needed for this election/voting meeting was
now 13 (50% of the original 26). 17 voting members/proxies were at this election/voting
meeting; 12 members present and 5 eligible proxies. One proxy was voided with the sale of
house between the 2024 Annual meeting and this Election/Voting meeting.
3. Voting: The ballots were counted by BLHOA Secretary (Barbie Shedd). BLHOA President
(Mark Freres) verified the votes.
4. Continuing Board of Directors members: Robbie Castro, Adam Todd, and Jack Tolman
were voted in by unanimous votes. Adam Todd will serve as the BLHOA President, Robbie
Castro will serve as the BLHOA Vice-President, and Jack Tolman will serve as the BLHOA
Member-at-Large.
Adjournment: The BLHOA President motioned that the meeting be adjourned. The motion was
seconded by attending members and the meeting ended at approximately 9:47am.

Minutes of the Annual Members Meeting of 13 July 2024
Call to Order: The Board of Directors (BoD) President (Mark Freres) called the Annual Members Meeting of the Bohicket Landing Homeowners Association (BLHOA) to order at 203 Dorovan Ct and motioned that the meeting begin. The motion was seconded by the attending members and at approximately 10:09am the meeting commenced. 14 homeowners/lot owners were present and 3 were represented by proxies; all 17 homeowners were eligible to vote.
Old Business: The following old business was discussed:
Reading of Minutes from Last Meeting: The minutes from the 2023 meeting were read.
Assessments: The date of record for this annual meeting was 08 July 2024. 5 homeowners /lot owners were not eligible to vote due to unpaid annual dues that were due on 30 June 2024.
Re-occurring/Open Compliance Issues: There are no open compliance issues at this time. Overall, the neighborhood looks a little rough with several houses needing to be pressure washed, fences needing maintenance, and general upkeep to yard areas to name a few issues. Letters will be mailed out the week of 15 July 2024 to homeowners with the specific areas that need to be addressed.
Boat Ramp Improvements: 2 bids have been received for the nautical themed poles with roping along the boat ramp roadway. Homeowners raised concern about the width of the roadway if this is completed; the road might be too narrow in a couple of places to accommodate a vehicle and trailered boat. There was discussion among the homeowners and this design has been tabled. A different design will be developed in the future.
Front Entrance Sign Updates: The front entrance signs were replaced. This was a cost of $5247.60 which included delivery and installation.
Tax Year End Report for 2023 / Financial Expenditures for 2023-2024: The Secretary, in the absence of the Treasurer, reviewed the current funds in the BLHOA bank account, and the expenses paid during FY 2023-2024. Due to privacy concerns, those sums will not be listed in the publicly posted minutes but are available for review in the BLHOA records. Please contact the Treasurer, in writing per the By-Laws, if you wish to review the association’s financial records.
New Business: The floor was opened for new business, and the following topics were discussed.
Line-Item Review of the Budget Proposal for 2024-2025 covered all expenses with the following being highlighted:
39 lot owners have paid their annual dues with 5 still owing annual dues amount
Insurance – covers indemnity and boat ramp decreased with new company
Landscape Contract – contract includes trimming of trees twice a year and weeding/trimming shrubs as needed
Attorney Fees – HOA has banked unused monies
Electricity – basic inflation increases
Contingency Fund – emergency funds if needed
Reserve Funds – Goal is $30k in 7-year period. This total represents boat ramp reserve funds of $10k and storm water permit reserve funds of $20k. Currently in year 6.
Budget Vote: Motion was made to approve/pass the 2024-2025 budget. The motion was seconded, and the budget passed.
Assessment for 2025-2026: It is anticipated that the annual dues will not increase for 2025-2026.
HOA Authority: Homeowners were reminded that the Board of Directors are elected volunteers and the committees such as the Architectural Standards Committee (ASC) are strictly volunteers. It was asked numerous times during meetings and in correspondence with homeowners for volunteers to serve the community.
Management Company: There is a strong possibility that the day-to-day running of the HOA will be turned over to a management company in the coming years. 2 quotes were received, with the cheapest increasing the annual dues to $503, an increase of $181. Even with a management company, the homeowners must still have a Board of Directors. This is a real possibility with the lack of volunteers to serve the community.
Boat Ramp Sign: A sign will be placed at the 4th pole showing the end of the boat ramp.
Motions from Floor / Members’ Remarks:
Restrictive Covenants: A homeowner requested that a Restrictive Covenants Committee be established to review and rewrite the Restrictive Covenants in anticipation of their expiration. This committee will be chartered and the following homeowners volunteered to serve on it: Mark Little, Scott Morrison, Robbie Castro, Jack Tolman, and Eric Shedd.
Elections: A quorum of 26 owners/proxies was needed to vote per the HOA bylaws. There were 14 homeowners and 3 proxies, for a total of 17 homeowners represented at the meeting. Per the bylaws, the vote cannot happen and will have to take place at a future date. (14 Sept 2024 at 9:30am)
Board of Directors vote: Three Board of Directors positions need to be filled. Two nominations were emailed or mailed to the BoD, and there were no nominations from the floor. It was asked multiple times during the meeting for members to serve on the BoD, and no one stepped forward or was nominated.
Adjournment: The President motioned that the meeting be adjourned. The motion was seconded, and the annual meeting ended at approximately 11:18am.

Dear Owner:
Below is the statement of your property’s general assessment for the Bohicket Landing Homeowners Association (BLHOA) for JUN 2024 - MAY 2025.
The assessment billing is now due and payable. Please remit a check or money order in the amount of THREE HUNDRED TWENTY-TWO DOLLARS AND ZERO CENTS ($322.00) payable to Bohicket Landing HOA. The checks can be mailed to the below mailing address.
The authority to charge or increase an annual or special assessment is listed in the North Carolina Planned Community Act (NC G.S. 47F-3-115), the Declaration of Restrictive and Protective Covenants (Articles 5, 6, 7, and 8), and the Associations By-Laws (Sections 4.5.(c) and 4.5.(o)).
The Board of Directors follows the below procedures for collecting HOA dues:
· An annual assessment notice is mailed to each owner at least 30 days in advance with a due date of 30 JUN.
· Dues not paid by the due date will be subject to a 10% late fee for each month plus an interest rate of 10% per annum for as long as they remain delinquent.
· A late notice will be sent for any overdue assessments and a final notice with intent to file a lien will be sent to the property owner by registered mail for any overdue assessments. That notice will also state that if the assessment and the late fees are not paid within 15 days, the account may be turned over to an attorney for collection.
· In accordance with NC G.S. 47F-3-116, if an assessment remains unpaid for 30 days or more, the HOA may foreclose a claim of lien in a like manner as a mortgage or deed of trust on real estate.
· The owner is responsible for the dues, late fees, attorney fees, legal costs, and any court costs if a delinquent account is turned over to an attorney for collection, filing of a lien, and/or a foreclosure.

Good morning. I’m sending out a request for nominations to the Board of Directors (BoD) and volunteers for the Architectural Standards Committee (ASC) for the Bohicket Landing Homeowners Association (BLHOA).
We have three (3) opening positions on the BoD. Mark Freres, who has served as President has reached term expiration. Jack Tolman, who currently serves as Vice President, was elected to the BoD in 2021 his term expires this year. Jack has also served as a board member in numerous capacities since the board was first founded. Angie Todd currently serves a board member and her term expires this year.
Directors serve for a term of three years, unless they resign or otherwise removed prior to their term expiring. Having served as president (Twice) and as a former member of the Architectural Standards Committee, I can tell you first hand serving on the BoD takes a willingness to occasionally perform tasks that you may not always agree with and will require a time commitment on your part. I spend 6-18 hours a week of my free time on HOA business. My BLHOA time is spent on many things, from answering phone calls/emails/in person questions from members, potential buyers, realtors, closing agents, mortgage companies, and government officials, to attending or presiding over board and committee meetings, and managing the day-to-day operations of a legally incorporated entity. The other officer positions (vice president, secretary, and treasurer) spend at least 4-16 hours a week performing the duties associated with their positions. BoD members are not compensated in any way for their time or efforts.
Once elected to the BoD by the association members, the BoD meets and elects its officers. Those officers are required by several NC laws, as well as, the association Bylaws, to enforce the requirements of the Declaration of Restrictive and Protective Covenants (DRPC) and any other HOA governing documents. Not doing so, opens those officers to be held personally responsible, both financially and legally, if found to be “negligent in performance of duties” or “acting in bad faith”. Director or committee members who neglect their duties also put the entire BLHOA and all other members at risk if the association were found liable in any judiciary or arbitration proceedings. The BLHOA does maintain an insurance policy to protect directors and members, but again it excludes coverage for any willful negligence or misconduct by any member.
I mention the above, not to scare anyone from serving, but to make sure you are aware of the time commitments and responsibilities for serving on the BoD before you volunteer. You can read about the full responsibilities for the BoD officers in NC General Statute 55A-8 and the association Bylaws. Copies of those documents can be downloaded from the Resource Center on the HOA website (www.bohicketlanding.com/resource-center).
We will also have openings on the ASC. ASC members serve for two years and their appointments automatically renew unless they resign or are removed by the BoD. Eric Shedd, currently serves as chairperson for the committee. He spends about 4-8 hours a month in that position. You can read about the responsibilities for ASC members in Article 11 of the DRPC and the Architectural Standards and Guidelines (Resolution 15-01), both of which are also available on the Resource Center page of the HOA website.
As per the Section 3.7 of the BLHOA Bylaws, I will work with the association secretary to set the Record Date to Determine the List of Eligible Members by 30 JUNE 24. To be eligible to serve on the BoD or the ASC and/or vote in the election, a BLHOA member cannot have any outstanding BLHOA financial obligations, to include fines or special assessments. I’m urging anyone who has a desire to serve or vote in the election to come to some sort of resolution with the current BoD before we set the record date if you have any overdue assessments or any pending fines.
If you wish to serve or nominate someone else to serve on either the BoD or ASC, please respond to this email with the full name and address of the nominee and whether the nomination is for the BoD or the ASC. The nominee must accept the nomination in writing. If you are nominating someone else, please CC that person in your email response, so that they can also respond and indicate that they are accepting the nomination. Please be advised that the rescheduled annual meeting of the Bohicket Landing Homeowners Association (BLHOA) will take place on Saturday, 23 September 2023 from 9:00 AM - 10:00 PM at 203 Dorovan Ct. Hubert, NC.
The only business to be transacted at this rescheduled HOA annual meeting is: (1) Elections for two Board of Directors positions. A meeting agenda is attached to this notice as Enclosure (1) and can be downloaded from the Resource Center page on the HOA website (www.bohicketlanding.com).
Also included as Enclosure (2) is a Proxy Appointment Letter. Those that already submitted a proxy for the 23-24 year, those proxies are still valid, and will be honored. Anyone who cannot attend the annual meeting may a designate a proxy to vote on their behalf (per section 2.8 of the HOA By-Laws).
If you cannot attend the meeting and want to designate someone else to be present and vote on your behalf, please complete the enclosed Proxy Letter and sign and date it. I hope you and your families are doing well. Please see below for recent updates.
1. On October 8, 2022 at 9:00 AM a owners meeting was held at 203 Dorovan Ct. All owners received notice via metered mail to the address they have on file with the Bohicket Landing HOA. An additional reminder was sent via email.
2. The purpose of the meeting as stated in the letter and email was to adopt and ratify a working budget for the HOA for the fiscal year 2022-2023. This meeting did not require a quorum as set forth in our By- Laws.
3. The results of the meeting were an approval to adopt the proposed budget without changes. Also, as part of the budget meeting the board and owners present, voted on next year’s annual assessment. The owners voted to approve a ten percent (10%) increase to the 2023-2024 annual assessment. Since it is the Board of Directors policy to not post any financial information on the website, to obtain a copy of the budget and or a copy of the current assessment with the projected 10% increase you may email the Board at hoa@bohicketlanding.com

Please be advised that the annual meeting of the Bohicket Landing Homeowners Association (BLHOA) will take place on Saturday, 13 August 2022 from 9:00 AM - 11:00 PM at 203 Dorovan Ct. Hubert, NC.
The only business to be transacted at the HOA annual meeting is: (1) Any open Old Business; (2) New Business as outlined in the meeting agenda; (3) Ratification of the 2022-2023 Budget. A meeting agenda is attached to this notice as Enclosure (1) and can be downloaded from the Resource Center page on the HOA website (www.bohicketlanding.com).
Per section 3.4 of the HOA By-Laws, any other matter that a member wishes to discuss must be submitted to the Secretary of the BLHOA. Time permitting, this matter may be added to the annual meeting agenda. Otherwise, the Secretary will schedule a discussion on the matter at the next Board of Directors (BoD) meeting or a Member’s Special Meeting will be scheduled if required.
Pursuant to NCGS 47F-3-103 (c), the budget proposal for the 2022-2023 year was distributed in the newsletter dated 17 MAY 21. Copies of the budget proposal will also be distributed at the meeting and are available for download from the Resource Page on the BLHOA website. The budget may be, by law, ratified without a quorum. Per section 4.5.(n) of the BLHOA By-Laws, the budget is considered ratified unless a majority of the members present at the meeting rejects the budget.
Also included as Enclosure (2) is a Proxy Appointment Letter. Anyone who cannot attend the annual meeting may a designate a proxy to vote on their behalf (per section 2.8 of the HOA By-Laws).
If you cannot attend the meeting and want to designate someone else to be present and vote on your behalf, please complete the enclosed Proxy Letter and sign and date it. Completed Proxy Appointment Letters may be mailed to the business address listed at the bottom of this notice, filed in person with the Secretary of the BLHOA, Barbie Shedd, at 104 Lafitte Dr, or signed electronically and emailed to the HOA email address (hoa@bohicketlanding.com).
The BoD sincerely hopes that the date of 13 August 2022 at 9:00 AM will be convenient for all owners. We are also equally sure that the date will not be convenient for some, but it is simply impossible to choose a date which would be satisfactory for all members. If you can not attend, please be sure to forward your Proxy Letter prior to the meeting.

1. The election that was postponed at the annual meeting will be held this Saturday, 28 AUG 21 at 0900 in the Frere’s driveway (203 Dorovan Ct). Please plan on attending or submit a proxy so someone can vote on your behalf. If you previously submitted a proxy, you do not need to submit another one. Your participation is important. The election was postponed at the annual meeting because we did not have enough members attend to reach the required 60% quorum.
2. A previous nominee for the Board of Directors election has withdrawn his name for consideration. So, during the election we will have at least one new nominee who will be on the ballot. We asked for nominations from the floor at the meeting, but got no other volunteers. If you have an interest in serving, please contact a Board Member before the election.
3. Attached are the minutes from the annual meeting. They will also be posted on the HOA website (www.bohicketlanding.com). If you have any questions about the minutes, please contact the association Secretary, Ms. Barbie Shedd.
4. Since our last newsletter, we’ve had 5 new neighbors move into 200, 210 & 212 Dorovan Ct and 504 & 507 Newhan Ct. Please welcome them to the neighborhood when you have an opportunity.
5. On a personal note, this is my last newsletter. I’m not running for re-election and I’ve served on the Board in some capacity since 2014. In the last seven years, I’ve learned a lot about how successful HOAs operate and the state and local regulations that govern them. But perhaps the most important thing that I’ve learned about successful HOAs is that they also have a large percentage of members that participate. So, I ask that you support the new HOA Board members as they manage the day-to-day operations of a nonprofit corporation and work to preserve the appearance of the neighborhood. Upon my departure from the Board, I plan on still being an active member and participating when asked to or where I see a need. I encourage every Bohicket Landing Home Owner to do the same.

The 2021 annual meeting was held yesterday, 31 JUL 21. The meeting minutes will be prepared and distributed to all members, but the following are some of the highlights.
1. There were not enough members present or voting by proxy to have the required quorum for the Board of Directors (BoD) election. We needed 24 of 40 eligible members and only had 20 (11 lots attending and 9 proxies). The election has been rescheduled for 28 AUG 21 at 0900. The election will be held in the driveway at 203 Dorovan Ct. No other business besides the election will be held at that meeting. If you can not attend that election, please submit a proxy letter. If you submitted a proxy for the original election, your proxy is still valid and you do not need to resubmit a proxy.
I will send out several email reminders about the election, but as NCGS 55A and the association by-laws dictate, a formal notice will not be mailed, because the date, time, and place for the election was announced at the meeting before it was adjourned.
2. The budget was approved with no objections or changes. A copy of the budget was emailed to all members and can be downloaded at www.bohicketlanding.com.
3. We had additional volunteers for the Architectural Standards Committee (ASC). They will be formally appointed in the next few weeks and their appointments will be announced in separate correspondence.
Thank you to everyone that attended the meeting yesterday or submitted a proxy. As you know it’s extremely important to have input from the members in order for the HOA to operate and meet its obligations to the homeowners. If you’re not in the local area or cannot otherwise participate regularly in association meetings, then I urge you to email or write your BoD or ASC representatives so that your points of view can be heard. After my BoD replacement is elected at the upcoming election, I intend to do exactly that for the next several years. The HOA should be guided by a majority of the membership and not just a dozen or so members. If you want your opinion heard or you have issues with the HOA, please make an effort to attend, email, or vote by proxy.

Bohicket Landing Homeowners Association
Minutes of the Board of Directors Meeting of 19 SEPT 2021
Call to Order: The Board of Directors (BoD) President (Mark Freres) called the HOA Board of Directors meeting to order at 203 Dorovan Court and motioned that the meeting begin. The motion was seconded by the attending directors and the meeting began at approximately 17:00.
Opening Remarks: There were no opening remarks as the President (Mark Freres), Treasurer (Nicole Freres), Secretary (Barbie Shedd) and Director at Large (Angie Todd) were the BoD officers present when the meeting was opened. Vice President (Jack Tolman) was unable to attend due to conflict in his schedule.
Reading of Minutes from Last Meeting: The minutes from the last BoD meeting were not read in order to expedite the business of this meeting.
Old Business: There was no discussion of old business.
New Business: The floor was opened for new business. The following topics were discussed.
1. Possible lawsuit against HOA: There is a possibility of a homeowner suing the HOA. Minutes of a conversation between the BoD President (Mark Freres) and Secretary (Barbie Shedd) on 15 Sept 2021 were read. It was determined that the first course of action would be for Mark Freres to have a conversation with the homeowner. During this meeting the homeowner stated that he will not being suing the HOA. This issue is resolved as far as the HOA BoD is concerned.
2. HOA Dues: There is only one homeowner who has not paid annual dues for 2021/2022. This property currently has a lien placed against it for the non-payment of the Special Assessment. The annual dues amount was added to the current lien. It was noted by the Treasurer (Nicole Freres) that in the future the HOA BoD should try to avoid special assessment due dates close to annual dues date.
3. Non-Compliance Issues: There are currently 2 homeowners with con-compliance issues, and 2 homeowners who need variances filed. A courtesy letter is being sent to a homeowner as a reminder of the upcoming expiration of a variance. One homeowner has a yard/septic issue that is going need a compliance deadline imposed after a conversation is had with the homeowner to determine a feasible date.
4. Pools: A letter has been drafted and will be sent as a reminder that the above-ground pool season ends on October 1st, and pools must come down.
5. Trends: A letter will be sent out and posted on the website with trends in the neighborhood that could lead to non-compliance notices if not rectified. The list is as follows:
a. Trees/Bushes/Shrubbery – trim and remove dead items
b. Grass clippings – not blown into the roadway
c. Mildew on dwellings – power-wash or pressure-wash dwellings and outbuildings
d. Trashcan storage
e. Trailer and boat storage
f. Variances – needed for new homeowners with 6ft fences
6. Fences: All 6ft existing fences had to put in a variance with the HOA, and all variances must be filed at the Onslow County Courthouse. There are currently 14 total variances in the neighborhood that need to be filed with Onslow County. The courthouse must have the original documents with original signatures, but it is unknown if the homeowner can file or if the HOA must file these. HOA BoD must decide on one of three options:
a. Require all variances be re-done and homeowner files at the courthouse.
b. HOA hold on to the variances as has been done in the past since these are legal as far as HOA requirements.
c. Require new homeowners with 6ft fences file variance with courthouse and the current variances stay “as-is” until property is either sold or destruction of said fence.
This was tabled until it can be determined which party (the homeowner or the HOA) must file the variance at the courthouse.
7. Boat Ramp Code: The code will be changed within the next 2 weeks.
8. Adjournment: The President motioned that the meeting be adjourned. The motion was agreed to by the attending BoD officers and the meeting ended at approximately 18:40.

1. ANNUAL MEETING. The Bohicket Landing HOA (BLHOA) Annual Meeting will take place on Saturday, 31 JUL 2021 from 10:00 AM - 13:00 PM in the Multi-Purpose Room at the Swansboro Recreational Center (830 Main Street Ext.) in Swansboro.
This is your opportunity to elect your Board representatives, help decide the annual budget, and voice your opinion on HOA issues. I encourage all members to participate & attend. If you cannot attend, please designate a proxy to be present and vote/speak in your place. I’ve attached a Proxy Letter for your convenience. Proxy Letters may be mailed to the BLHOA business address listed at the bottom of this notice, filed in person with the Secretary (Ms. Barbie Shedd), or signed electronically and emailed to the HOA email address (hoa@bohicketlanding.com).
2. ANNUAL ASSESSMENT FOR 2021-2022. The annual assessment of $242.00 is due on 31 JUL 2021. Thank you to everyone who has already paid. We’ve only received one request for a payment extension. Since there was already a 60-day grace period, the Board of Directors (BoD) will not waive any late fees or interest this year unless you request an extension before the due date. As a reminder, late fees are 20.00 per month and interest is 10% per annum and begins to accrue on 01 AUG 21. If payment is not received by 31 JUL 21, then an additional $22.17 will be applied to your balance. Please make arrangements to ensure the payment is received before 01 AUG 21.
3. NOMINATIONS FOR THE BOARD OF DIRECTORS AND ARCHITECTURAL STANDARDS COMMITTEE (ASC). We’ve received three nominations to replace the three vacating Board positions. Election ballots will be distributed at the meeting. If you’re a nominee or intend to run for election on the Board, please be present at the meeting, so you can introduce yourself to the membership.
As per our association Bylaws, Board members terms are for three years, but they continue to serve after their term expires if a replacement is not elected. We can’t hold an election unless a 60% quorum of eligible lots cast a vote. Without the quorum, the election will be postponed until a later date. As per the record date set on 29 MAY 21, we currently have 40 out of 44 lots eligible to vote, that means we need 24 lots to vote in person or by proxy to have a quorum. So again, I’m encouraging everyone to attend the meeting or submit a proxy to designate someone to vote on your behalf.
We’ve only received one volunteer as a replacement for the two outgoing ASC members. Please consider volunteering for the ASC if you have the time to commit to this position.
4. BUDGET. Attached is a finalized copy of the 2021-2022 Proposed Budget. The budget and a listing of all expenditures in 2020-2021 will be presented and discussed at the annual meeting. As is required by the association bylaws, the members will vote to approve or reject the budget at that meeting. Note that the 2021-2022 shortfall (page 1) is about 1400.00 more than the shortfall that we predicted (page 4) at last year’s annual meeting even with the dues increase this year.
5. NEW NEIGHBORS. We have new neighbors at 505 Newhan. Please welcome them to the neighborhood.

4. LANDSCAPE MAINTENANCE – The BoD is accepting proposals for the mowing and maintenance of the common areas and Boat Ramp. Our current contract expires soon. We’re hoping to have another contract in place quickly with no interruption in service and at a cheaper rate than what we’ve spent in the past.
5. BOAT RAMP GATE CODE. The boat ramp gate code will be changed on 11 JUL 21. We’ve had some property transfers in the last few months and we also have some members whose access privileges have been revoked. If you’re a member in good standing and have a completed copy of APPENDIX C on file, the new code will automatically be forwarded to you.
6. NEW NEIGHBORS. Since our last newsletter, we have new neighbors at 208 Dorovan and 508 Newhan. Please welcome them to the neighborhood.

To all HOA Members:
Good evening. I hope that you and your families are doing well. Please see the following updates on recent events and reminders for upcoming events.
1. SPECIAL ASSESSMENTS: Thank you to everyone who has paid the recent special assessment. As a reminder, the special assessment is due on 30 APR 2021. As we mentioned in the notice, if you need additional time or would like to make a payment arrangement, please contact a member of the Board of Directors (BoD) prior to the due date.
2. COMPLIANCE ISSUES: The deadline for compliance issues also expires on 30 APR 2021. The BoD thanks everyone who has made the necessary corrections and is helping to maintain the appearance of the neighborhood.
If you received a final notice and corrective action is not completed by 30 April 2021 or if an extension was not requested, then the BoD will pursue the remedies permitted by North Carolina General Statute (NC GS) 47F-3-107.1. The BoD will convene a hearing soon after the deadline, to determine the amounts for fines (up to 100.00 per day), suspension of privileges, or other remedies. All compliance notices provided information on this hearing process. Resolution 15-01 (Architectural Standards & Guidelines) also provides information on the rights of HOA members to appeal fines or suspension of privileges. The BoD does not want to pursue any of those actions; however, some of these issues have been ongoing and ample opportunity and notice has been provided to correct them. Please contact a BoD member if you need additional time or have problems correcting a particular compliance issue.
3. BOAT RAMP LOCK CODE CHANGE: The majority of the repairs to the boat ramp road and parking area are completed. There are still some additional clean-up and other minor items that need completed. Once that is done, the code to the ramp gate will be changed. If you have previously completed a parking permit application, then the new code will be emailed to you as soon as it is changed. If you do not have a permit on file and wish to have the gate code, please complete the attached application.
4. ANNUAL MEETING, BoD ELECTION, and ARCHITECTURAL STANDARDS COMMITTEE (ASC) VACANCIES: The annual members meeting for the HOA will be held in JUN or JUL 2021. Once a date and time has been established, a formal notice will be sent to all members. At the meeting an election will be held for two directors whose terms are expiring. There will also be a request for volunteers for three expiring positions on the ASC.
Sometime next month, the BoD will send out a notice to all members requesting formal nominations for the BoD and ASC and explain the duties and time commitment for those positions. As a reminder, the person being nominated, must be a member in good standing and must formally accept the nomination (either in person or in writing) to be added to the election ballot or to be considered for an appointment.
5. CONVENANTS REVIEW COMMITTEE (CRC): The CRC is still reviewing the Declaration of Restrictive and Protective Covenants (DRPC). The date/time of the CRC’s next meeting will be posted on the Events page of the Bohicket Landing HOA website (www.bohicketlanding.com). In the meantime, if you have a change or recommendation for the DRPC that you’d like the CRC to consider, please forward it to CRC@BohicketLanding.com.

Good afternoon. I hope that you and your families are doing well.
As I’m sure many of you are already aware, and as was posted to the Bohicket Landing HOA (BLHOA) Facebook page, a zoning and environmental enforcement officer from the Onslow County Planning and Development Office of Land Use was in the subdivision today and issued citations to many residents for “unpermitted structures”. First, I want to assure all members that this was not a result of any action by anyone representing the BLHOA and/or the Board of Directors (BoD) in any official capacity. If the BoD has an issue with something on your property, we will contact you directly, either by email or U.S. Postal Service, so that there is a written record as is required by the association By-Laws. The BoD (at least while I’m on the Board) will NOT call any county or state zoning or building enforcement official.
The BLHOA Architectural Standards Guidelines (Resolution 15-01) only requires ASC approval for a storage building with a dimension greater than 12 feet. This corresponds to the state building regulations that also require a county “building permit” for a structure greater than 12 feet. Numerous residents called or visited me today indicating that the enforcement officer was issuing citations for any storage building (called an accessory building by the county) regardless of the size.
I called and spoke to the county Chief Land Use Enforcement Officer, Mr. Kendrick Stanton, who confirmed that a county “zoning permit” is required for all storage buildings regardless of the size. I have attached a copy of the Onslow County Zoning Ordinance and Summary of the Ordinance, that confirms Kendrick’s statements. These documents may also be downloaded from the Onslow County website (https://nc-onslowcounty.civicplus.com/1105/Codes-and-Ordinances).
Kendrick also informed me that the county does not actively enforce this regulation unless called to do so or if it is otherwise brought to their attention. Kendrick went on to state the only reason the enforcement officer was here today was because of an anonymous tip. He did not elaborate on who filed the complaint and while I have heard differing stories on who might have filed it, I have no first-hand knowledge of it. In any event, it is sort of irrelevant at this point, as the county is now actively enforcing this requirement in Bohicket Landing.
The BoD will amend Resolution 15-01 in the near future to state that a county “zoning permit” is required for all storage or accessory buildings. The BoD (again, as long as I’m on the Board), will NOT be issuing any compliance notice(s) for any storage or accessory building that is installed as of today and may not have a zoning permit on file with the county. We will only require that the property owner be notified that he must obtain a zoning permit for any storage or accessory building installed after the date of this letter (03-30-2021). The requirement for ASC approval and for the property owner to provide a copy of the "building permit" for a storage building greater than 12 feet in any dimension remains in effect as written.
If you did not receive a citation from the enforcement officer today, then I think it’s best for each member to decide for themselves if they should complete a county zoning permit application or not. In case you want to file a zoning permit application with the county, I’ve attached one for your convenience. Kendrick and I also spoke in greater detail about this ordinance and while I think it is being interpreted correctly, I do not think it is being applied correctly. As I told Kendrick, my guess is that 90% of the storage buildings in Onslow County do not have a zoning permit. Likewise, when a property is zoned as residential, it should include the zoning for those structures consistent with a residential neighborhood without requiring additional zoning permits. He did not offer an opinion on that, but I will be contacting the Director of the Onslow County Planning and Development Office (Jessica_Rhue@onslowcountync.gov) and the county Board of Commissioners (BOC@onslowcountync.gov) about this issue. If you have an interest in this as well, I urge all residents to either attend one of the county meetings or contact the commissioners directly. The Onslow County Planning board meets the first Thursday of every month at 6:30 pm in the Commissioners' Chambers at 234 NW Corridor Blvd, Jacksonville, NC 28540. Normally, I send a copy of this letter to my fellow Board members to ensure they concur with the content before I send it out to the membership. In the case of this letter, I did not do that. Mainly because some of the BoD members received citations and I wanted to avoid any potential conflicts. So, the content of this letter entirely reflects my opinion as your HOA president. If you have questions, concerns, or other issues regarding this letter, please direct them to me. As always, if you don’t feel comfortable sending such information to me, you may send the information to any HOA representative that you desire. Good morning. I hope that you and your families are having an enjoyable and healthy new year so far. Please note the following updates since our last correspondence:
1. COMPLIANCE ISSUES: The timeline for the correction of compliance issues expired on 30 JAN 21. There have been many improvements, but there are still issues on some properties that need corrected. The Board of Directors (BoD) will be reviewing the compliance issues noted in the letters sent on 31 OCT 20. For those issues that have not been corrected, the BoD will send a final notice to the owner sometime after 16 FEB 21.
If you receive a final notice for compliance issues, please ensure that you make the appropriate corrections or the Board will consider this as a continued violation. North Carolina General Statue 47F-3-102, the Bohicket Landing HOA By Laws Section 2.4, and the Bohicket Landing HOA Architectural Standards and Guidelines (Resolution 15-01), Article VII identify the fines, penalties, and other remedies that the HOA may pursue for continued violations.
If there are circumstances that prevent you from making the necessary corrections, please contact the BoD prior to 16 FEB 2021. The BoD will make exceptions or extensions when reasonable, but some of the issues in the notices can be easily corrected, are clearly defined in the covenants, and/or have been ongoing for up to a year or more. 2. BOAT RAMP GATE: As noted in several previous emails and as posted in the news section of the HOA website (www.bohicketlanding.com), there is some construction taking place on the lot next to the boat ramp and on the boat ramp road. This has resulted in the clearing of the wood line along the western boundary of the road.
Our newest member and neighbor who owns that property has noted several persons, to include other HOA members, trespassing on his property to bypass the locked gate. As a reminder, the Bohicket Landing HOA Boat Ramp Rules (Resolution 14-01), Paragraph 2.1 identifies the boundaries of the boat ramp and the gate is the only means to access the ramp and/or road.
Please be respectful of our new member’s property. In addition to the owner possibly citing individuals for trespassing, the BoD can revoke the access privileges of any member who bypasses the gate and/or violates other Boat Ramp Rules.
3. BOAT RAMP ROAD: During the construction of the new owner’s home, it was discovered that the Boat Ramp Road infringes on their property. It appears that the road was placed there when originally constructed in the late 2013 thru early 2014 timeframe. There have been at least two new surveys done within the last 30 days that confirm that the road encroaches upon the new owner’s property. We’ve had several survey stakes placed to identify the correct boundaries and have already started to make the necessary corrections.
During our last correspondence on this topic from 01 NOV 20, I estimated that the BoD would not have to charge a special assessment to make the necessary corrections. However, since then we’ve not reached a favorable compromise and are expecting additional expenses that were not budgeted, so a special assessment may be necessary. If and when the BoD determines a special assessment is necessary, a notice will be emailed to all owners as per the Bohicket Landing HOA Adoption of Rules and Assessments (Resolution 19-01), Paragraphs 2.1 and 2.2. All owners will have the opportunity to comment on any proposed special assessment before the BoD approves it.
4. COVENANTS REVIEW COMMITTEE (CRC): The BoD appointed the CRC members on 31 DEC 20. They are tasked with reviewing the covenants and recommending any changes to the membership. A copy of the Bohicket Landing Charter for the CRC (Resolution 20-01) was distributed to all owners/members and is also available for download on the Resource Center pages of the HOA website.
I recently exchanged emails with one of the CRC members. They intend to hold their first meeting on or about 8 FEB 21 to elect the Chairperson, Co-Chair, and Secretary. The BoD will post the names of the committee members and the date/time of any future CRC meetings on the About Us and Events pages of the HOA website, as well as, post copies of the meeting minutes on the Resource Center pages.
