Moving into a property governed by a homeowners association can be a confusing ordeal, especially for those who have never before been involved with a homeowner association. The Bohicket Landing HOA would like your experience here to be a positive and enjoyable one. To help you, we have created this web page to outline some key areas of interest for all new HOA members. Detailed information can be found by following the links for the referenced documents.

In North Carolina there are several documents that govern the establishment and operation of a HOA. The three most referenced documents for our association are; (1) Declaration of Restrictive and Protective Covenants, (2) Association By-Laws, and (3) HOA Rules and Architectural Guidelines.
North Carolina HOAs are also governed by two important state laws; (1) The North Carolina Planned Community Act and (2) The North Carolina Nonprofit Corporation Act. The NC Planned Community Act provides for the establishment and regulation of a HOA, the responsibilities, authority, and rights of HOA members and directors, and other measures governing a HOA. The NC Nonprofit Corporation Act establishes that HOAs must operate as nonprofit organizations and imposes other state requirements.
All governing documents that pertain to the Bohicket Landing HOA are linked above and available for review at the HOA website’s Resource Center. Owners were given the opportunity to review the governing documents prior to moving into the HOA. Compliance with these requirements is also noted in your home’s deed and mortgage documents.
Notices of association or board meetings will be published as required by the association’s By-Laws. Annual dues and special assessment notices will be forwarded to members as specified by the Declaration of Restrictive and Protective Covenants and/or the association’s By-Laws.
Annual dues assessments are, as of 01 JUN 2020, billed at a rate of Two Hundred Twenty Dollars and 00/100 ($220.00) per lot and are due beginning 1 June of each year. This amount and/or date is subject to be changed as specified by Article VI of the Declaration of Restrictive and Protective Covenants
The association utilizes the U.S. Postal Service and electronic communications to keep its members informed of association events, updates and/or other announcements. Please provide your email address and contact information to a board member so that you can be added to the distribution list. If your property will be managed by a real estate agent or other individual acting on your behalf, please provide that contact information as well.

The website contains the association’s schedule, announcements, covenants & rules, board/ committee member contact information, and other useful information. Please visit the site regularly to stay informed. Please note that the majority of the association’s newsletters and community information will be emailed and posted on the website and will not be postal service mailed to homeowners.

The HOA maintains a boat ramp and launch area at 128 Laffite (Lot 36, Section III), for the use of all owners, their tenants and/or guests. The use of this common area is subject to the rules adopted by the association entitled; Boat Ramp Rules for Bohicket Landing Home Owners Association (boat ramp rules). A copy of these rules are linked above and are available for download at the HOA website’s Resource Center.
The boat ramp rules provide specific requirements for access to, prohibited activities, and other information related to the use of the boat ramp area. Please review these rules prior to utilizing or accessing the boat ramp area. Questions about the boat ramp rules can be forwarded to a HOA Director in person or at the email address/phone numbers listed on the HOA website's About page.
The combination to the boat ramp lock will be provided to new members upon submission of a completed and signed copy of the Application for Boat Ramp Access and Parking Permit – APPENDIX C. If it is necessary to update the lock combination, the new code will be forwarded from a HOA Director.
Architectural standards are another requirement of the Bohicket Landing HOA. Architectural standards are intended to create and maintain the aesthetics of the community, while providing owners with maximum flexibility in developing, maintaining, and personalizing their property. To accomplish this goal the Bohicket Landing HOA has adopted a set of rules and regulations entitled; Architectural Standard Guidelines, Application & Review Procedures, and Landscape & Exterior Maintenance Requirements for Bohicket Landing Homeowners Association (ASC Guidelines). A copy of these rules are linked above and are available for download at the HOA website’s Resource Center.
Please note that the ASC guidelines provide specific requirements for landscape maintenance, dwelling and structure modifications or additions, and exterior design or construction. Please ensure compliance with these rules and that you obtain approval (if required) from the Architectural Standards Committee (ASC) by submitting Appendix A – Application for Review by the Architectural Standards Committee prior to beginning any exterior construction or changes to your property.

The Board of Directors (BoD) may approve variances from the ASC guidelines and other governing documents provided they do not violate the intent of the Declaration of Restrictive and Protective Covenants. Variance requests should be submitted to the BoD utilizing the Request for Variance - Appendix B.
