FMLA: The Family Medical Leave Act (FMLA), allows eligible associates to take up to 12 weeks (Federal) unpaid, job protected leave of absence for specified family and medical reasons yourself or immediate family members for medical reasons, with continuation of group health insurance coverage under the same conditions as if the employee had not taken leave. (Maximum leave entitlement amounts may vary by state). You are eligible for an FMLA leave of absence provided you have been employed by OSJL for at least one year and have worked a minimum of 1,250 hours worked (during a 12-month period immediately preceding the requested leave). The FMLA covers leaves taken for:
The birth of a child and to care for a newborn child within one year of birth
The adoption or foster care placement of a child and to care for the newly placed child within one year of placement
To care for a spouse, child or parent who has a serious health condition
One’s own serious health condition
Any qualifying exigency arising out of the fact that a family member’s spouse, child or parent is a covered military member on “covered active duty;” OR
Twenty-six workweeks of leave during a single 12-month period to care for a covered service member with a serious injury or illness if service member is your spouse, child, parent or next of kin.
* Associates will be responsible for any benefit payments missed while out on leave.
Medical Leave of Absence: There are a variety of options for medical leaves of absences offered that comply with all federal and state regulations. Once hired, please connect with OSJL's benefits department for further assistance or information (benefits@osjl.com).
(In certain cases, either before or after use of another type of leave of absence, and regardless of the qualifications or eligibility for other leaves, an unpaid leave of absence may be a reasonable accommodation under the Americans with Disabilities Act. If an associate requires a leave of absence in connection with a disability as defined under the Americans with Disabilities Act (an “ADA Leave”), the associate should contact the Benefits Department.)
Personal Leave of Absence: If approved, associates are granted a maximum of 60 days during a single 12-month period. (an additional 30 days may be granted if needed). Full Time associates qualify for this leave after 90 days of employment. Part Time associates qualify after 6 months of employment. Personal leaves can be requested if:
The associate needs time away from work for some other non-medical personal reason or family emergency
The associate desires time out of work to attend school or another educational activity
The associate desires time out of work to visit family members residing in another country
Or such other reasonably necessary condition or circumstance or emergency as determined in the reasonable discretion of OSJL.
Military Leave – Unpaid leave for associates who are members of an armed forces unit and are in conformance with federal law guidelines (USERRA). *In compliance with all state leave laws
Upon an associates request, OSJL will apply paid accruals (sick, personal and vacation) during associate’s medical leaves of absence or personal leaves of absence.
