1.2 All prices are exclusive of GST unless otherwise specified.
2.1 We possess the expertise to provide the services described on our website and will do so professionally and promptly.
2.2 While we aim to meet project deadlines, we are not liable for delays caused by late provision of materials or delayed approvals from you.
2.3 We will protect the confidentiality of your information but are not responsible for data shared with external websites. Refer to our Privacy Policy for details.
2.4 Quotes or estimates for additional work will be provided before commencing. Our hourly rate for such work is $65/hour.
2.5 We will address post-launch issues to the best of our ability.
3.1 You confirm authority to enter this contract on behalf of your organization.
3.2 You agree to provide all required website materials (e.g., text, images, logos) in a usable format and by the agreed deadlines.
3.3 You will review and approve work at project milestones. Timely written approval is required for the project to proceed.
3.4 A written project brief or requirements document must be provided. Work related to this will be charged at $65/hour.
3.5 You agree to adhere to the payment schedule outlined in these terms.
4.1 Websites will be designed according to the brief you provide.
4.2 Includes up to two design concepts and three rounds of revisions. Additional revisions will incur charges of $65/hour.
4.3 You must supply digital images or purchase stock photos as needed. If we assist with sourcing, this is charged at $65/hour.
4.4 We do not proofread provided text unless agreed upon. Writing assistance is available at $65/hour.
4.5 You are responsible for ensuring materials you provide do not infringe copyright. We will remove any infringing materials upon discovery, and related costs will be your responsibility.
4.6 We may showcase your website in our portfolio and include a discreet credit on your website.
4.7 Communication will primarily be remote (e.g., email, screen sharing).
4.8 Websites will function on major browsers but may vary slightly in appearance. Optimization for mobile devices requires additional charges.
4.9 Compatibility or functionality of third-party software is not guaranteed.
5.1 Hosting is managed by umedia.
5.2 Web packages include one domain name. Discounts for existing domain names are not offered.
5.3 Monthly hosting fees are based on selected features.
5.4 If you cease hosting with us, we can provide a static "front-end" of your website, excluding functionality or third-party software.
5.5 We aim to maintain optimal website performance but are not liable for external server issues.
6.1 Email services use Google’s Gmail and are subject to its Terms of Service.
6.2 Emails can be forwarded to another address you own.
6.3 We are not liable for business losses due to email issues.
7.1 Costs are based on written project requirements.
7.2 A 1/3 deposit is required before work begins. Remaining payments are invoiced upon project completion.
7.3 Full payment is required before the website launch.
7.4 Invoices are due within 7 days unless otherwise stated.
7.5 Work stoppage by your request will incur charges for completed work at $65/hour.
7.6 Late invoices incur a 5% monthly fee. Services may be suspended for overdue accounts.
7.7 Outstanding accounts may be referred to collection agencies, with associated fees passed on to you.
7.8 Additional payment processing fees (e.g., PayPal) are your responsibility.
8.1 Ownership of designs, code, and materials transfers to you upon full payment. You may not resell or modify them without our consent.
8.2 We do not guarantee copyright clearance for materials created for you.
9.1 We cannot guarantee error-free functionality of your website.
9.2 We are not liable for delays or damages due to circumstances beyond our control.
9.3 Complaints must be submitted in writing within 21 days of service delivery.
9.4 Any unlawful or unenforceable provisions will not affect the validity of remaining terms.
9.5 Pricing structures may change if necessary.
10.1 We are not liable for incidental, indirect, or consequential damages, including loss of profit, data, or business relationships.
11.1 We do not guarantee increased website traffic, search engine rankings, or business outcomes following the website launch.
