Title VI of the Civil Rights Act (1964)
No person in the United States shall, on the ground of race, color, or national origin, be excluded from partiicpation in, be denied the benefits of, or be subjeted to discrimination under any program or activity receiving Federal financial assistance.
Lau v. Nichols, 414 U.S. 563 (1974)
The US Supreme Court ruled: discrimination on the basis of language proficiency is discrimination on the basis of national origin under Title VI of the Civil Rights Act of 1964. Treating people with different needs in the same way is not equal treatment.
Castaneda v. Pickard, 648 F.2d 989 (5th Cir. 1981)
School systems must regularly assess their treatment of limited English proficient students. They must provide a sound approach to the educaiton of these students, a reasonable implementation of the approach, and outcomes that relfect the approach is working.
A Language Instruction Educational Program (LIEP) plan is a required written service outline for every school district in Minnesota. It shows how school districts support English Learners (EL). Districts must create this plan under Minnesota Statute 124D.61 to detail instruction levels, staff qualifications, and student entrance or exit criteria
The presentation provides ML program definitions, services provided, Ellevation information for general education teachers, as well as other ML programs offered at Faribault Public Schools
RAEL is a K-12 student identified as an English learner who first enrolled in a U.S. school on or after April 15th of the previous school year. A student can be classified as RAEL one time in their school career.
NEWCOMER is often used synomously with RAEL, as it is a broader term used that does not have an exact calendar cutoff date like RAEL.
English Learner students are screened to determine the appropriate language services provided by the district. The screener is called WIDA screener assessment. There are a selected amount of states who are also in the WIDA consortium where if a student is coming from another WIDA state, we can accept their scores without having to rescreen.
