According to the law of foreigners/Dublin, detention may be based on several grounds:
Most likely, the authorities presume that the person concerned might escape or disappear
Another reason is the lack of cooperation in the event of expatriation.
If we are contacted by a client in detention, please refer him / her to the detention team immediately: detention@asylex.ch
General information on detention and conditions can be found here on G-Drive.
For more information and documentation on the detention project of AsyLex or ask the team members (detention@asylex.ch). There is also a separate manual regarding the relevant aspects to consider when leading a detention case.
For German speaking volunteers: Make sure to also watch the detention video.
In case of a criminal conviction (mostly Strafbefehl) of your client, reach out to the Criminal law team immediately (crimmigration@asylex.ch) and ask for support. In the meanwhile, you may already prepare a opposition against the charge (Einsprache gegen Strafbefehl) with this Bryter tool.
Please note that in criminal proceedings, only qualified lawyer may represent clients. Therefore, please also keep a qualified lawyer (e.g. Lea) in the loop to make sure they can submit the opposition in due course (deadline: 10 days).
