Fair Use is using copyrighted material for a limited and “transformative” purpose. Fair Use can be a defense for fighting copyright infringement claims. Making content with comments, critique, or parody is protected in Fair Use. Comments and criticism allow the person to use copyrighted material to critique and have an opinion about the material. Parody allows the person to use copyrighted material for humor and comedic purposes.
Copyright Law is a form of protection from the U.S. Constitution to protects original works of authorship and used to form expression. The copyright law protects published and unpublished works of media, literature, technology, and art. It is different from a trademark, where it protects the authorship of names and symbols. Once you create material, is protected under copyrighted laws. Not all copyright claims cover most countries in relation to the United States.
Creative Commons is for people to have public permission to use a creator's work under copyright law. They can distribute, remix, or create within the material with any medium.
The Four Factor Test are four factors that dictate if this material is "fair to use" under copyrighted laws.
These factors include:
The purpose and character of the use (Using the material for nonprofit educational purposes, not for commercial uses.)
The nature of the work (Dictating on how the material work is being used, and for the law to look over its fair use based on its characteristics or attributes.)
The amount and substantiality of the portion used (The law to look over the amount and length of its use of the copyrighted material.)
The effect of the use on the market or potential market for the original work ( The law to evaluate the purchase or license of the copyrighted work.)
There are consequences when violating copyright laws. Cease and Desist letters are for you to take down the material and its searches you do not know. The law could also confiscate it if necessary You may have to pay damage fines for using the material without permission and sued for stealing. If not pay, or depending on the sentences, jail time could happen. In education or job intuition, you can be expelled or fired for cheating and using copyright infringement.
To follow laws and guidelines with using copyrighted material, I research its original owner. Check to see if they have the creative commons label for people to use their work. Using citations to show where I found the sources protect me from not getting in trouble with the law. I am using three memes to poke fun at Fair Use and Copyright Law. By adding my name and CC license, I am protected under the law to use the meme photos for fair use (parody).
