It is the policy of Superior Industries that any unwelcome sexual advance, request for sexual favors, or other verbal or physical conduct of a sexual nature by a male or female constitutes sexual harassment when:
1. Submission to such conduct is made either explicitly or implicitly as a term or condition of employment.
2. Submission or rejection of such conduct by an individual is used as a basis for employment decisions affecting such individuals.
3. Such conduct has the purpose or effect of unreasonably interfering with an employer’s or an employee’s work performance or creating an intimidating, hostile, or offensive working environment.
Neither sexual harassment, nor reprisals or retaliation in violation of this policy, will be tolerated. Those found to have engaged in such prohibited conduct will face appropriate disciplinary action which may include, among other things, immediate discharge.
Those employees who believe they have been victims of sexual harassment must take the steps outlined above in the section titled “Complaint Procedure”. A prompt, fair investigation will take place and appropriate action will be taken based on the investigation.
