The examiner issued a Claim Rejection based on the fact that it is a closed system and the assumption that the capsule cannot fly into the air :
"The closed system as disclosed by the applicant is in contradiction with the Energy Conservation Doctrine that disallows a perpetual motion machine of the first type that operates without consuming any energy supplied from outside the system."
"In this particular case the magnetic buoyant assembly floating on the surface of the liquid enclosed in the second tubular means cannot transfer itself, against the gravity force, from the second tubular means to the first tubular means."
An Energy Conservation Doctrine is not a law. A simple permanent magnet has been violating conservation doctrine for well over a year in my office as it has been suspending steel balls against gravity, without consuming any input.
If the capsule is roughly less than half as dense as the enclosing fluid it will leave the surface of the water after having been submerged.

Appologies for the ordering of the preceeding. I have the intention to license the above patent to the world. If possible each sovereign state will have the right to develop within its territory the aforementioned device as each sees fit. I have had a most difficult time finding the appropriate channel to pursue with this so at this time please excuse me and forgive the quote "may the force be with you" to find an alternative to some of the pressing energy issues.
If at any time in the future there is consensus about the value of this invention it would be greatly appreciated if I could receive 50 million USD at July 4, 2007 exchange rates adjusted for inflation in Russian roubles, half of it to be payed as tax to the U.S. Treasury. If currency is not appropriate any other sort of guaranteed far eastern livelihood akin to 50 acres in the land of many rivers would be fine providing the labors of such land wouldn't be too difficult.
As an aside, quite possibly another appropriate use of the above device would be to use it as a way to irrigate arid regions of the world by means of using clean pipes.

During the course of contacting the above people and organizations I have been unable to secure the funding and interest that would have been necessary to enter the PCT process through WIPO with a view to entering the national phases in Russia, China, India, Europe, Japan, Brazil.
Therefore I must hereby have this serve as the informal and de facto proof of priority and letter of intent regarding the international protection of the Electricity Generator with Buoyant Magnet Assembly.
As stated in the previous post I am hopeful that the device can be licensed to each sovereign state to be developed as each sees fit. How this can be accomplished by an individual inventor with no financial resources and backing I suppose is anyones guess.

A few interesting points to note about what had occurred prior to and around my filing of this patent in 2007:
From early 1995 to early 1997 I lived outside Hilo, Hawaii studying marine science at UHH, and at some point, I think late 1996, I had called my step father in Miami to run an idea across him to see if it made sense. Frank Van Rensselaer, my step father, has a degree in engineering and has worked for NASA and other MIT science related firms so I naively thought it would be wise to get his input. I had few thoughts about eavesdroppers or other real world concerns, I was just so happy to have finished physics 101 with good marks.
Was the call from me on GTE Hawaiian Telephone Company to Frank on AT&T in Miami confidential? Most likely not.
It wasn't until the time that I filed the patent in 2007 that I realized the exchange valve would solve the issues associated with
the buoyant magnet generator idea, so it is Interesting to find when I was filiing in 2007 that in 2002 a similar device had already been patented by Shin, Ernest Eun-Ho that envisioned a different exchange valve:

That E. Shin filed his patent from Napa Valley a device that is macro physics and not related to his research is odd seeing that
he has published papers that are tied to the University of Miami, Harvard, MIT and micro physics phenomenon.
When I moved from Hilo, Hawaii to Miami, Florida in 1997 I had shipped my computer FedEx with insurance, and it was lost. I called to inquire about the lost package, a Macintosh Performa 550 (registered by me with Apple), and FedEx said that "Oakland Security had lost the package", and that was that. They paid the value that I insured the package for.
In the fall of 2000, after finishing my degree in International Relations from FIU (B.A. '99), I was in a bit of a crisis after loosing my father to cancer in 1998, and my half brother to AIDS in 1999 (both in NY state), and was trying to find a way to get into fashion design school. I was driving to Austin, Texas to visit a friend and I was arrested in Jefferson County Texas for driving across a grassy median separating Interstate 10 near the Louisiana border. This was odd enough, but the laptop I had purchased with the FedEx insurance (a Compaq Presario 1020 registered by me with Compaq) also went missing after I had picked up what was in my Budget rental car after being released from jail a few days later.
My credit report now has two address listings in Colorado Springs round about the time that this happened. Who was trying to
pose as me? I never went west of Austin, Texas from 2000 to late 2005.
At the same time that I shared with my step father that I had already begun filing a patent, he and my mother got separated.
I think it was right around valentines day 2007.
In the late summer of 2007 after finishing the patent filing, I needed a vacation and decided to visit Sweden. Once back in Miami in mid September, my mother tells me that of all the clutter in one of the closets, she decided to get rid of my Apple Imac G3 333 (registered by me with Apple). Was it she who decided to get rid of the Imac?
Anyway...
My patent attorney said to me after one of our first meetings, "You know they don't like these sort of things."
I said, "Exactly."
I didn't think I needed to ask who the they he was referring to was.
