“May it please Your Excellency! In obedience to your Excellencys Command to report on the Petition of Benjn Fairchild Junr in respect of the Interference, which a Lot he prayed for, might have upon the necessary Reserve of the Crown; I did on the 29th September last report to your Excellency, that as you had been pleased to remove the Reserves from the Road leading to the Thames; I saw no objection, in respect of them, to the granting of the Petition, altho the description given of it by Benjamin Fairchild was rather inexplicit—On the 19th Inst I received the Return of Grants made by the Honble the Executive Council, wherein I find, that Lot No 50 in Ancaster was granted to Michael Showers Junr on the 10th July last, which, consequently precludes the necessity of further Report (beyond the foregoing Circumstances) from this office, respecting that Lot—All which is submitted to your Excellencys Wisdom—[Signed] D W Smith Actg Sur Genl” Read in Council on 24 May 1794. “Humbly Sheweth That your Petitioner and all His Fathers Family were ever Stedfast in His Majesty’s Interest, and your petitioner was in Actual service in His Majestys Forces during the war—Wherefore your petitioner prays your Excellency will plese to consider the improvements your Petitioner has made in this Province and if you may please to think him deserving of your notice, he is consious you will deal with him accordingly—Your Petitioner has a Family and never drew but 200 Acres of Land and your Excellency may conceive that he is, (from improvements already made &c) deserving of a further grant, he prays your Excellency will deal with him in like manner as thro’ your goodness you have done to many Loyallists in the like situation with your Petitioner—Your Petitioner has made improvements on Land Centrical between Burlington Bay and the Mohawk village, to amount of £250—and described Five lots, and returned their numbers in the Surveyor Genls offices and hopes your Excellency will confirm the same to him, or such other relief as thro’ your Goodness may seem meet and your Petitioner will ever pray—Benjn Fairchild” Received at the Executive Council Office on 12 Aug 1795 and read in Council on 12 Aug 1795. Upper Canada Land Petition of William Hare, Sarah Willard (formerly S. Hare), Mary Fairchild (formerly M. Hare) and Elizabeth Hare dated at Newark (Niagara-on-the-Lake) on 2 Apr 1793

“Most respectfully Sheweth That Your Petitioners are the Children & Heirs at Law of the late Captain John Hare of the Indian Department. That the said late Captn John Hare gave the most unequivocal proofs of his Loyalty from the first Appearance of rebellious Commotions in America, by taking a decided & active part for Government, and was one of those who accompanied Sir John Johnson in Spring 1776 thro the woods from the Mohawk River to Join the Royal Standard in Canada—That the said late Captain John Hare having been ordered to Join the Division of the British Army, destined to form a Diversion by the way of Fort Stanwix under Brigr General St Leger, was killed on the 6th of August 1777 in the Action fought at Oriska between a Detachment of the said Army & a strong Party of the Rebells commanded by their General Harkemer. That Your Petitioners hope that the right which the said late Captn John Hare held to Lands from the Crown, according to the Rank of his Commission, agreeable To His Majesty’s Proclamations and Orders on that Head was nowise diminished by the Sacrifice of his life in the Service of his Country—Wherefore Your Petitioners pray that Your Excellency would be pleased to grant them as Heirs to the said late Captn John Hare and in his right, Three Thousand Acres of the waste lands of the Crown to be divided among Your Petitioners as in right and equity may appertain and Your Petitioners as in duty bound will ever pray &c—for self & other Heirs [Signed] Willm Hare” Read in the Executive Council and ordered granted. “Sir, Pursuant to the orders of Lieut Governor Gore bearing date the 23rd February 1810, respecting Claims to Land, I have the honor to state to you for the Information of the Honorable the Committee of Council, that according to the 43rd Claim of the Niagara Commission in May 1803, Joseph Felker appears to claim & to have been allowed the South halves of Lots No 33 & 34 in the 5th Concession of Gainsborough as containing 200 acres from John Felker the original nominee. The minutes of search made thereon by this office stated, that the Lot No 33 in the 5th Concession had been described for George Miller; & the Secretary of the Province has reported that the Patent for this Lot has been completed – The minutes of search further stated that the south halves of No 34 & 35 in the 5th Concession of Gainsborough had been described for John Felker, under the authority of an order in Council of the 20 october 1796 – in which year the Description issued – but I am not acquainted with the State of the Patent upon this Description. “Humbly Sheweth That your Petitioners elder Brother Joined General Burgoynes Army near the beginning of the American War, and as his Father Died previous thereto, the Estate was considered as the property of his said Brother, contrary to any Laws but such as were Fabricated by Men of designing and bad Principles, who meant to entail Poverty and Misery on the infants of Men who fled to His Majestys Standard to evade the Merciless Hands of Rebellious Americans—Your Petitioner was a Boy in the American War, therefore could render no service to His King but he is now a Man, and both ready and willing to give proof of His Loyalty. “most humbly sheweth, That your humbly petitioner is and always was a true and loyal subject to our sovereign lord the King that your humble petitioners Father showed him in his infancy the dangerous consequences attending disloyalty to a prince or Sovereign and was so strongly attached to the brittish Government that he took the earliest opportunity in his power after the declaration of the rebel war in the Colonies to Join his Majesties Forces and inlisted into his Majesties 1st Battallion of New Jersey Volunteers and served in the same upwards of seven years, and in consequence of which his estate real and personal was confiscated by the rebels and left your humble Petitioner with an aged Mother and some small brothers and sisters in a most deplorable circumstance without any other means to subsist by than what your humble petitioner could acquire by days works and that he your petitioner was often deprived of his liberty because would not Join with the rebel party, (all which your petitioner can make appear to the satisfaction of your Excellency and Honors if required). That your petitioners family Consists of a wife and two children one boy and one girl. “State of Faits relative to the Subscribers first settling at Long Point. In the Year of 1790 I went from Fort Erie and explored the Land in the vicinity of Long Point where I found a man had settled by name of Asa Holmes who lived in a Cabin and had cultivated about one Acres of Ground, he had come from Detroit and settled on the Premises, & he was Anxious to leave the Premises place, therefore I bargained with him for his Improvement and paid him £50 NYC. —In the Spring following 1791 I removed my Family (having immediately after purchase put up a House) with an expectation to have no dispute about the Land, as I had applyed to Colonel Hunter when I first came into the Province in 1788 and he told me to explore the Country and wherever I found Land to suit me I should have granted provided it did not interfere with any prior Grants; and immediately after I had purchased the Improvement of Holmes, I reported the same to certain members of the Land Board who were then nominated to Grant Land to applicants as was Generally understood by the Inhabitants, they approved of the purchase and Received permission from John Alavan Esquire to possess the premises. When I removed, there came a man with me named Foryea and settled so near to me that I supposed the Front between us was not sufficient to accommodate both of us he then went about ¾ of a mile below me and made an improvement which has fell on Lot No 22 which he sold to a man named Samuel Brown, and then removed back on the Lot which I occupied and forcibly settled on the same and said he would hold it in dispite of me—After the Land (or Front was Surveyed) I applied by Petitioner for the Lot, which Petition was given to the Clerk of the Honorable Executive Council but have never received an Answer, notwithstanding I applyed to His Excellency the Governor when he was at Long Point, and he said I sould have the Lot. I have expended considerable of Money in improving the Premises, have Erected a Grist Mill Black Smith Forge &c &c and as a man that has ever been obedient to the Laws &c of the Country and a peaceable Citizen, I must refer to the Certificates herewith delivered; and hope the Surveyor General may be perfectly informed of my situation after which have not the least doubt but Justice will done me, as Foryea has made use of every means to have the matter misrepresented and in some [……] has done me much injury notwithstanding I have shewn him the greatest Friendship and in Sickness when his life was despaired of, have taken him into my House and used every means in my Power for his recovery little expecting to receive ingratitude as a compensation [Signed] John Troyer” [Upper Canada Land Petitions LAC “T” Bundle 2, Petition Number 73]

Upper Canada Land Petition of John Troyer of Walsingham dated at York (Toronto) on 27 Jan 1801

“Humbly sheweth – That a joint claim having some time ago subsisted between your Petitioner & John Foryea for Lot No 20 in the front concession of Walsingham—which was on the 7 of March 1797 – determined in favor of your Petitioner for the whole Lot by an order of Council of that Date but in the interim, and before your Petitioner had lodged a warrant therefor in the Surveyor Generals office, a Description has passed in the name of Foryea for the half of said Lot; Your petitioner therefore humbly prays your Excellency would be pleased to order that the Deed to Foryea for the one half of said Lot (which now) lied [in] the Secretarys office) may be cancelled upon your Petitioner paying the fees on said Deed – and that a Description may issue to your Petitioner agreeable to the before mentioned order in Council, and Your petitioner as in Duty bound shall ever pray—[Signed] John Troyer” Received at the Executive Council Office on 27 Jan 1801. Ordered reference being had to the Order of Council dated the 7th March 1797 whereby the whole of Lot No. 20 in front of Walsinham was ordered to the Petitioner in consideration of certain proceedings of John Foryea therein stated whereby he forfeited his claim to the half of that Lot formerly promised him and reference being also had to certain papers signed by the said John Foryea whereby he acknowledges to have received from the Petitioner a valuable consideration for and to have totally relinquished his claim for the half in question – recommended that the deed lying in the Surveyor’s Office to Foryea for the half of the said Lot No. 20 be cancelled and a Deed issue to the Petitioner for the whole of Lot No. 20 in front of Walsingham agreeable to the Order of Council dated the 7th of March 1797 – he paying the Expence of both deeds under the old Regulations. “The Petition of William Francis, Quarter Master in the Kings late American Dragoons, in behalf of himself, Richard Bowlby and Sons amounting to Twelve Families; Inhabitants of Wilmot, County of Annapolis & Province of Nova Scotia. Humbly Sheweth That your Petitioner desirous of becoming settlers in this Province, prays your Excellency will please to grant them an Allotment of Land in the vicinity of Long Point on Lake Erie. Their Loyalty is well known for which your Excellency shall have sufficient Vouchers—The subscriber served in the Regiment of Dragoons in America, returned with the Regiment to England after which came out again and was promoted to be a Quartermaster in the Kings American Dragoons, from which Commission he leaves it to your excellency`s superior Judgement to ascertain the Lands that he is entitled to, and if a grant can be obtained, he will make the necessary arrangement to remove his own and the other Families to this Province—Or please to grant such other relief as your Excellency may seem meet, & your Petitioner will ever pray—[Signed] Wm Francis” Received at the Executive Council Office on 28 Jun 1793 and read in Council on 28 Jun 1793. Upper Canada Land Petition of John Freeman dated at Niagara on 13 Aug 1796 [Requesting a location in the Long Point Settlement but did not settle there]

“Humbly sheweth- That your Petitioner served as a volunteer in the Troops commanded by Sir John Johnson during the American war- as is well known to several officers of Butlers Rangers- That your Petitioner is lately arrived in this Province with four Sons and a Daughter prays your Honor would be pleased to grant him as a Settler 300 acres of Land in the Long Point Settlement and your Petitioner as in Duty bound will ever pray—” [Unsigned] Appended note of Thomas Ridout, N. P.: “I do hereby certify that John Freeman applied personally to me for the above petition—[Signed] T Ridout N. P. Frey, Hannah

Upper Canada Land Petition of Hannah Frey, wife of Capt. Bernard Frey of the four mile Creek, Newark, dated at Newark (Niagara-on-the-Lake) on 24 Feb 1797

“Humbly shews- That your Petitioner is a sister of Edward McMichael of the Settlement of Long Point, who served His Majesty during the american war as did also another of her Brothers, who was made a prisoner, and died in prison- That your Petitioner and her mother during part of that war (her father having died previous thereto) lived on the Susquehana and there rendered assential services to distressed Loyalists—that in the year 1778 your Petitioner came into this Province and afterwards married her present Husband who was a Capt in Butlers Rangers—by whom She has one Child born in 1789—That her said Husband has recd the whole of his military Land but having no claim to family Land except it may be for his wife—Your petitioner prays your Honor would be pleased to grant her 200 Acres in her own right and as in duty bound she will ever pray—[Signed] Hannah Frey” Read in the Executive Council on 17 Mar 1797. Upper Canada Land Petition of Edmund Frost dated at Newark (Niagara-on-the-Lake)on 17 Aug 1795

“Humbly Sheweth That your Petitioner served his Majesty during the American War in Canada; Four Years of which he was a Corporal in the Corps commanded by Major McAlpine and two years in Major Jessups Corps; he has Located Three Hundred acres of Land in this Province, and as he was ever firmly attached to His Majesty and in almost all the Battles with General Burgoyne, hopes your Excellency will please to give him an Additional Grant of 200 Acres or such further relief as thro’ your Goodness may seem meet; and your Petitioner will ever pray—[Signed] Edmund Frost” Received at the Executive Council Office on 19 Aug 1795 and read in Council on 20 Aug 1795. “Humbly Shews that Where as your Petitioner Having Served his Majesty as Apears by his Discharge Six years in the Rangers under Colo Butler And he Also Served As a Soldier in the Royal Americans in the Fourth Battn for the Space of Five years And Six months in the Last French War Before the Rebelion And being Old and Worn Out in the Serves he Begs your Exelency will Take this Mater into your Consideration And Grant him Leve to Removed on his Place at Long point. He also Hopes your Exelency Will Not Consider him As a trance Gresser For Setling there As he Moved on that Place in Jun 1792 Before your Exclency Arived into this Place and Leave of the Athorety of the Place at that time And he must inavoidably Sufer if he is Obliged to Leve his improvements Now and begin a New As he has Nothing to Depend on But Labour And is Not Able to Do but Very Litle of that.
