West Virginia's Approach to AI

West Virginia takes a collaborative approach to artificial intelligence, with two key bodies working closely together to guide its use in state government. The AI Task Force, established under §5A-6-9 of the West Virginia Code, partners with the WVOT cybersecurity office to develop policies and procedures that ensure responsible adoption of AI. By setting strategic direction, encouraging cross-sector collaboration, and upholding strong ethical standards, this joint effort seeks to improve the efficiency and quality of public services across the state.

Acceptable Use Policy and Ethical Guidance Policy

The WVOT provides guidance on the responsible use of AI and maintains a list of approved tools. However, the use of AI within your agency is ultimately subject to your internal policies. Please review your internal acceptable use policy to determine which AI tools and practices are permitted. Your agency’s Information Security Administrator (ISA) can provide additional guidance and clarification as needed.

AI Software Guidelines

All other AI software, including open-source AI tools, must be approved by WVOT before use.

Prohibited AI Software

▪️ChatGPT

▪️DeepSeek

▪️Any AI model that transmits data outside of the United States

▪️Any AI model that is banned in the FCC Secure Networks Act
