Welcome to Blink. These Terms of Service ("Terms") constitute a legally binding agreement between you and Blink ("we," "us," or "our") governing your access to and use of the Blink mobile application (the "App") and any related services.
Please read these Terms carefully. By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.
1. Age Requirement and Eligibility
Blink is strictly intended for an adult audience. You must be at least eighteen (18) years of age or older to create an account or use the App.
By using Blink, you represent and warrant that:
You are at least 18 years old.
You have the legal capacity to enter into a binding agreement.
You have not been previously suspended or removed from the App.
You are not a convicted sex offender and are not restricted by any legal mechanism from using social or chat applications.
If we discover or receive a report that a user is under the age of 18, we will immediately terminate the account and delete all associated data without notice.
2. User Accounts and Security
Registration: To use certain features of the App, you must register for an account using a valid email address. You agree to provide accurate, current, and complete information during registration.
Account Responsibility: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at zenithcyx@zenithsoftwork.com if you suspect any unauthorized use of your account.
3. User-Generated Content (UGC) and Conduct Rules
Blink allows users to upload, post, and share content, including short videos, photos, text messages, and voice records ("User-Generated Content" or "UGC"). You retain ownership of your UGC, but you grant Blink a worldwide, royalty-free, perpetual, non-exclusive license to host, store, display, reproduce, and distribute your content for the purpose of operating and improving the App.
Prohibited Content and Conduct
You agree that you will not upload, share, or transmit any content, or engage in any behavior, that:
Depicts, describes, or references minors in an exploitative, sexual, or harmful manner, including any Child Sexual Abuse Material (CSAM) or Child Sexual Exploitation and Abuse (CSAE). We maintain a zero-tolerance policy for CSAE.
Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
Promotes hate speech, violence, discrimination, or illegal activities.
Contains unauthorized commercial communications, spam, scams, or deceptive financial schemes.
Infringes upon any third-party intellectual property, copyright, trademark, or publicity rights.
Impersonates any person or entity or misrepresents your affiliation with any person or entity.
Safety Mechanisms: Reporting, Blocking, and Moderation
To maintain a safe community environment, especially as a platform incorporating video, chat, and voice features, Blink implements strict User-Generated Content controls:
Reporting System: We provide built-in reporting tools on user profiles, video feeds, and chat interfaces. You can report any content or user that violates these Terms. The reporting options include a dedicated label for "Underage User" to immediately flag accounts suspected of being operated by individuals under 18.
Blocking System: You have the absolute right to block any user at any time. Once blocked, the restricted user will not be able to view your profile, watch your uploaded videos, or send you text or voice messages.
Enforcement Actions: We reserve the right, but assume no obligation, to pre-screen, monitor, review, or remove any UGC at our sole discretion. Violations of our conduct rules may result in warning flags, temporary account suspension, or permanent termination of the account without a refund, and reporting to law enforcement authorities where appropriate.
4. Important Offline Interaction Disclaimers
Blink is an online social application meant for virtual video sharing, IM chatting, and interaction. We do not conduct background checks, criminal screenings, or identity verifications on our users.
OFFLINE SAFETY NOTICE: If you choose to meet or interact offline with any individual you connected with through Blink, you do so entirely at your own risk. We strongly advise you to exercise extreme caution, meet exclusively in public places, inform friends or family of your whereabouts, and prioritize your personal safety. Blink explicitly disclaims all liability for any interactions, disputes, physical harm, damages, or incidents arising from offline arrangements or meetings between users.
5. VIP Memberships and Paid Subscriptions
Blink offers certain premium features through paid subscriptions (e.g., Monthly, 3-Month, and 12-Month VIP plans). Terms governing subscriptions, billing, auto-renewals, and cancellations are fully detailed in our VIP Membership Agreement, which is incorporated into these Terms by reference.
No Guarantee of Results: All paid services and VIP tiers are provided solely for enhanced features within the platform (such as increased visibility or access to specific app functions). Blink does not guarantee any specific social outcome, connection, response rate, or relationship success from purchasing a subscription.
6. Limitation of Liability and Disclaimers
As-Is Basis: Blink is provided on an "as-is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability: To the maximum extent permitted by applicable law, Blink, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses resulting from (i) your use or inability to use the App; (ii) any conduct or content of third parties or other users on the App; or (iii) unauthorized access, use, or alteration of your content.
7. Governing Law and Jurisdiction
These Terms and your use of Blink shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator of the App is incorporated, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located within that jurisdiction.
8. Terminations and Modifications
We reserve the right to modify these Terms at any time. Changes will become effective immediately upon posting inside the App or on our website. Continued use of the App following any changes constitutes acceptance of those updates. We may also suspend or terminate your access to Blink at any time, with or without cause, without prior notice.
