The Verandah Community Association (VCA) was incorporated on September 19, 2002.
The Declaration of Covenants, Conditions, and Restrictions for Verandah (the primary Governing Document) was signed on December 22, 2002. Governing Documents is a collective term referring to the Declaration and associated documents such as By-Laws and Articles of Incoporation.
The Verandah Community Association Advisory Committee (VCA-AC) was formed by Board of Directors Resolution in March 2010. Composed of Neighborhood Representatives, its purpose is to recommend policies and procedures to the Board.
The Community’s original Developer was the Bonita Bay Group (BBG). Verandah continues to be developed as a Mixed Use Planned Development (MPD) as approved by Lee County in 2002/2003. BBG sold Verandah Development and its assets to the Kolter Group in late 2012. KH Verandah, LLC then became and remains today as the Developer of record; also known in our Governing Documents as Declarant.
The community encompasses over 1,456 acres and at full buildout will have 1,636 homes, both single and multi-family. At the end of 2020, 1283 homes had been completed.
The VCA must be turned over to the homeowners, terminating the Declarant’s Class B membership, upon the earlier of: three months after 90% of the maximum units which may be created have been conveyed to Class “A” members other than builders, OR when, in its discretion, the Declarant so determines and declares in a written instrument recorded in the Public Records.
The Declarant has chosen to turn over the VCA to the homeowners prior to reaching the 90% buildout threshold and will do so at a time it so determines and declares in the first 6-9 months of 2021.
The turnover process does not encompass review of the privately owned entity known as The Club (golf courses, restaurants, tennis courts, etc.) except as pertaining to any property easements, shared use agreements or covenants to share costs.
