Industrial design refers to the features of shape, configuration, pattern, or ornamentation applied to an article by any industrial process or means. These features are visually appealing and assessed by the eye. A registered industrial design is protected for 5 years from the filing date. The protection can be renewed for four additional terms of 5 years each, making the maximum protection period 25 years.
Eligible Applicants:
The original creator of the industrial design.
Applications can be made by individuals or companies.
If the applicant is not the creator, a statement justifying the applicant's right to the registration must be submitted during the filing.
Registrable Industrial Designs:
Must meet the definition of an industrial design.
Must be new in Malaysia or elsewhere.
Must not contradict public order or moral principles.
Non-Registrable Industrial Designs:
Methods or principles of construction.
Features dependent on the appearance of another article.
Differences based on non-material details or common trade features.
Features determined solely by their function.
