Geographical Indication or GI is a sign used on products that have a specific quality, reputation, or characteristics linked to their geographical origin. Protection is granted even if the GI is not registered. The protection also applies to GIs produced within their actual region but misleadingly presented as products from a different area.
Against Public Order or Morality: GIs that contradict public order, morality, or traditional customs of the region.
Invalid Registration: If the GI is no longer registered in its country of origin.
Non-Usage: If the GI is no longer used in its country or region of origin.
Only producers operating within the specified geographical area and adhering to the registered quality, reputation, or characteristics can use the registered GI for business purposes. The use of the products must comply with the specifications registered in terms of quality, reputation, and distinctive characteristics as stated in the registration certificate.
Protection lasts for 10 years from the filing date.
It can be renewed every 10 years to remain registered and protected.
The one who are eligible to apply are:
Individual Producers: Operating within the designated geographical area related to the product listed in the application.
Local Authorities: Representing the geographical area.
Business Organizations or Associations: Related to the production, trade, or promotion of the product.
