Tallmark Terms of Use
Version 1.0
Effective date: 10 October 2026
Last updated 10 October 2026
In short
Tallmark is a free height journal and habit game for people aged 13 and over. It is not medical advice and not a crisis service.
Your Predicted adult height is an estimate with a likely range. It is not clinically calibrated and it is not a promise.
Your records live only on your phone. We cannot back them up or get them back for you, so exportå them if you want to keep them.
Community is optional. If you join, you post under a made-up nickname, you follow the Community guidelines, and what you post is stored on our server and can be removed if it breaks them.
Chat with Tally is optional too. Its answers are written by AI: they can be wrong, they are not medical advice, and you should not rely on them for anything important. If you turn it on, a summary of your records goes with each question (Privacy Policy section 5).
Please use the app for yourself, and do not copy or resell it.
Your rights under consumer law in your country still apply, whatever these terms say.
These terms are an agreement between you and New Version Ltd, a New Zealand company ("we", "us"). Contact: tallmark.support@newversion.studio.
They are written in plain language. Where a legal term is needed, we explain it.
1. Accepting these terms
By downloading or using Tallmark, you agree to these terms, our Privacy Policy (https://sites.google.com/view/tallmark/privacy-policy) and our Health disclaimer (https://sites.google.com/view/tallmark/medical-disclaimer). If you do not agree, please do not use the app, and delete it from your phone.
2. Who can use Tallmark
You must be 13 or older. The app will not let anyone younger set it up.
New journals can be started between ages 13 and 19.
If you are under 18, please read these terms with a parent or guardian, and make sure they are happy for you to use Tallmark. There is a page for them: For parents and guardians (https://sites.google.com/view/tallmark/parent-and-guardians).
In some countries the age at which you can agree to terms yourself is higher than 13. If that applies to you, your parent or guardian agrees to these terms for you.
Community has the same age rule. Tallmark does not verify age beyond the date-of-birth question at setup.
3. What Tallmark is, and what it is not
Tallmark lets you record your height and some everyday habits (movement, meals, sleep, water, mood and weight), shows you an approximate adult-height range, and gives you general information, daily quests, streaks, XP and badges. Tally the giraffe keeps you company. It also has Community, an optional tab where teens post short notes about everyday habits (section 8A), and Chat with Tally, an optional chat on the Coach tab whose answers are written by an AI model (section 10A), and optional photo analysis of a meal, where an AI model reads a meal photo or description and guesses its nutrients (section 10B).
Tallmark is not a medical device, a doctor, a dietitian, a personal trainer or a counselling service.
4. Health and medical disclaimer
The full version is our Health disclaimer (https://sites.google.com/view/tallmark/medical-disclaimer), which is part of these terms. The key points:
Not medical advice. Nothing in Tallmark is a diagnosis, treatment or medical advice. Talk to a doctor about any worry about your growth, health, eating or mood.
The estimate is approximate and uncalibrated. Your Predicted adult height, its likely range and the year-by-year path on the Growth tracker are worked out from published population methods (Khamis-Roche, the CDC 2000 growth charts and mid-parental height). We have not tested how often it is right, so we make no claim about its accuracy. Your adult height may be different, and outside the range. It is not a guarantee.
The percentile is a comparison, not a judgement. "Taller than N% of teens your age" compares one measurement with a US reference (CDC 2000). It is not a score or a target.
Nothing makes you taller. No exercise, food, supplement, sleep or posture habit makes bones longer or adds centimetres. Healthy habits support the growing you already have coming.
General guidance only. Sleep, activity and nutrient figures are general guidance for large groups of people, with sources listed on Health information sources (https://sites.google.com/view/tallmark/health-source).
5. Exercise safety
The exercises in Tallmark are general movements with drawn demonstrations. You do them at your own risk and within your own limits.
Warm up, move with control, and stop straight away if anything hurts.
If you have an injury or a health condition, or have been told to avoid some activity, check with a health professional first.
Exercise with enough space around you, and use sturdy equipment (for example, a bar that is properly fixed before you hang from it).
6. Food and nutrition information
Tallmark describes what you logged. It does not grade meals, set calorie targets or tell you what to eat. Nutrient figures you enter or see are estimates. If you have allergies, a medical diet or worries about eating, follow advice from a health professional, not the app.
7. Safety: Tallmark is not a crisis service
Nobody at Tallmark reads your records, so we cannot notice if you need help. Community posts are checked by an automatic filter and, when reported or held, by a person, but we do not watch Community around the clock, and nobody reads the chat. The Coach and Tally have a few safety answers that point you to real help, and the Community post box shows a link to the same help if you type certain words, but none of these is a substitute for it.
If you are in danger or might hurt yourself, call your local emergency number now. Helplines by country are on If you need help now (https://sites.google.com/view/tallmark/safety-resources).
8. Your licence to use Tallmark
Tallmark is free to download and free to start. We give you a personal, non-exclusive, non-transferable, revocable licence (permission) to install and use the app on phones you own or control, for your own non-commercial use, under these terms and the rules of the store you got it from.
You agree not to:
copy, sell, rent, lend, share or publish the app or any part of it;
reverse-engineer, decompile or take the app apart, except where the law says you are allowed to;
remove any copyright or trademark notices;
use the app to break any law, or to harm anyone;
present Tallmark's estimate or information as medical advice to other people.
8B. Tallmark Plus (optional subscription)
Logging is free and stays free: you can record your height, weight, meals, water, sleep, mood and movement, see your history, and use the daily quest, the Today and Week views of your trackers, the first exercise in each Train category, Community, exporting your data and the safety pages, without paying. Tallmark Plus is an optional subscription that unlocks your predicted adult height and growth chart, the Coach, every other exercise and routine in Train, and the Month view of your trackers. You never need it to record anything, and help and the sources are never behind it.
The estimate is approximate and not medical advice whether or not you have Plus. Plus does not make it more accurate and does not make anyone grow.
Plans. Monthly and yearly, shown in your own currency in the app before you buy. The price you see on the store's purchase sheet is the price you pay.
Free trial. The yearly plan may start with a 7-day free trial if you have not used one before. You are not charged during the trial. If you do not cancel at least 24 hours before it ends, the yearly price is charged when it ends and the subscription renews each year until you cancel. We send a reminder two days before the trial ends if you allow notifications.
Payment and renewal. You buy through Apple (charged to your Apple ID) or Google Play (charged to your Google account). Subscriptions renew automatically unless cancelled at least 24 hours before the period ends. Tallmark never sees your payment details.
How we check your subscription. To let the Coach know you have Plus, the app sends our server a reference to your App Store or Google Play purchase together with a random id made on your phone. The server asks Apple or Google whether the subscription is active and keeps only a coded link between that id and the subscription. It does not receive your name, email, Apple ID or Google account. “Reset all my data” unlinks it. See the Privacy Policy (https://sites.google.com/view/tallmark/privacy-policy).
Under 18. If you are under 18, ask a parent or guardian to help you subscribe. They may need to approve the purchase.
Cancelling. Manage or cancel in your Apple ID subscription settings or in Google Play, under Payments & subscriptions. Cancelling stops the next renewal; you keep Plus until the end of the period you paid for. Deleting the app does not cancel a subscription.
Refunds are handled by Apple or Google under their own policies.
Under 18. If you are under 18, ask a parent or guardian before you buy, and use a payment method you are allowed to use.
Restore. "Restore" on the Plus screen brings Plus back on a new phone that uses the same Apple ID or Google account.
A one-time offer. We may offer the yearly plan at a lower price once, for a stated period. The end date shown is real.
Changes. We may change prices or what Plus includes. A price change never applies to a period you have already paid for, and the stores tell you before a renewal at a new price.
8A. Community
Community is optional. Nothing is sent to our server until you tap Join Community and agree to the Community guidelines (https://sites.google.com/view/tallmark/community-guidelines), which are part of these terms.
You post as a nickname and an animal. Please do not post your real name, school, phone number, links, handles or photos. There are no private messages, no photos and no links.
Keep to the guidelines. Be kind; keep it about habits; do not compare heights or weights or promise that anything makes anyone taller; no medical advice, ads or selling.
What you post is visible to other members. It is stored on our server (in the United States) until you delete it, it is removed, or it is deleted automatically after 90 days. You are responsible for what you post. You keep ownership of your own words, and you give us permission to store and show them to other members in Community for as long as they are there.
We filter and moderate. An automatic filter checks every post and reply. Anyone can report or block. Items reported by three different members are hidden until a person has reviewed them, and posts that mention things like supplements, hormones or surgery are held until a person has reviewed them. We may remove a post or reply that breaks the guidelines. Each removal by us is a strike, and repeated strikes can pause your access to Community. Being reported does not by itself count as a strike.
Limits. There are limits on how much you can post in a day (5 posts and 30 replies).
Leaving. You can delete your posts and replies, or use Settings › Community › Leave Community and delete my posts, at any time. Reset all my data also removes you from Community. Community is not a crisis service (see section 7).
Reporting a problem. Use ⋯ › Report on a post or reply, or email tallmark.support@newversion.studio.
9. Intellectual property
Tallmark, the Tally character and his artwork and animation, the exercise figures, the app's design, text, tips and Coach answers, and the Tallmark name and logo belong to New Version Ltd or the people who licensed them to us. The licence in section 8 does not give you any ownership of them.
Tallmark includes open-source software. Its licences are listed in the app under Settings › Help & legal › Open-source licences, and those licences apply to that software.
Your records are yours. We do not claim any rights over what you enter in your records. What you post in Community is covered by section 8A.
10. Your data and your responsibility
Your records are stored only on your phone. We have no copy.
They are not included in iCloud or Google Drive backups, or in Android phone-to-phone transfers. This protects your privacy, but it means if you lose, reset or replace your phone, or delete the app, your records are gone and we cannot get them back.
If you want to keep them, use Settings › Your data › Export my records and save the file somewhere safe. There is no import yet.
Reset all my data permanently deletes everything. It cannot be undone.
Anyone who can unlock your phone can open Tallmark. Keep your phone locked if your records are private to you.
There are two exceptions to the list above, and each is off until you agree to it.
Community. What you post there is stored on our server, in the United States, and shown to other members. It never includes your records: your height, weight, age, logs and estimate are never sent. See section 8A and the Privacy Policy.
Chat with Tally. If you turn it on, each question you ask goes with a summary of your records (your age, heights, latest weight, the app's estimate and the last week of logs — never your name, birthday, parents' heights or notes) through our server to an AI provider, so the answer fits you. Our server keeps none of it; the AI provider keeps it for up to about 30 days. See section 10A and the Privacy Policy section 5.
If a future version adds another online feature, it will be off by default and will ask you first.
10A. Chat with Tally (AI answers)
Chat with Tally lets you ask Tally questions in your own words on the Coach tab. It is optional, and off until you turn it on in the app. The quick questions on the Coach tab are answered by the app on your phone and are not part of this section.
The answers are written by an AI model, not by a person, a doctor or us. In the chat, Tally is an AI character, and he will say so if you ask.
They can be wrong. An AI can misunderstand a question, get a fact wrong or sound more certain than it should. We tell it to stick to growth, sleep, food, water, movement and the app's routines, never to promise height, and never to make its own height prediction, and our server checks its answers for heights that are not in your records — but we cannot check everything it says.
They are not medical, nutrition or mental-health advice, and section 4 applies to them exactly as it does to the rest of the app. Do not rely on a chat answer for a decision about your health, your eating, an injury, a medicine or how you are feeling. Check anything important with a doctor or a trusted adult.
Some questions are not sent. Questions that mention self-harm, suicide, an eating disorder, pain or medicine are answered by the app on your phone with helplines for your country (section 7). Everything else you type is sent.
Use it for yourself, and use it kindly. Do not use the chat to try to make it break its rules, to get it to say harmful, hateful or sexual things, to ask about anything illegal, or to send it anyone else's personal information. Do not try to reach our server other than through the app, or to get round its limits.
Please do not type your name, school, address or anyone's contact details into the chat.
Limits. To keep the chat available for everyone, there is a limit on how many messages one phone can send in a day. When you reach it, Tally will say the server is busy or ask you to come back tomorrow. We may change the limits, pause the chat, or change the AI model behind it at any time.
Turning it off. Settings › Chat with Tally, at any time. Reset all my data turns it off too.
10B. Photo analysis of a meal (AI estimates)
Photo analysis lets Tallmark read a meal from a photo, or from words you type into Describe it. It is optional, and off until you turn it on in the app. Type it in is not part of it and stays on your phone.
The numbers are an AI's estimate from a photo or a sentence, not a measurement. They can be wrong by a lot, and the app lets you change every one before you save. section 4 applies: they are not medical, nutrition or dietary advice, and Tallmark does not score or grade your meals.
Photograph only the meal. What you photograph or describe is sent to the AI model; keep faces, documents, addresses and other people's details out of it, and do not type your name, school, address or anyone's contact details into a description.
Limits. There is a limit on how many meals one phone can have read in a day. When you reach it, type the meal in instead. We may change the limits, pause photo analysis, or change the AI model behind it at any time.
Use it for yourself. Do not use it to try to break the app's rules, or to reach our server other than through the app or round its limits.
Turning it off. Settings › Meal photos, at any time. Reset all my data turns it off too.
11. Availability, changes and ending
We may update Tallmark, change or remove features, or stop offering it. We will try to give notice in the app or on this website before removing anything important.
Updates may be needed for the app to keep working on newer phones.
You can stop using Tallmark at any time by deleting it.
If you seriously break these terms, your licence ends and you must delete the app. Because the app keeps your records on your phone, we cannot switch the app off for you; this is about your permission to use it. In Community, we can pause your access or remove your posts (section 8A).
Sections 4, 8A (as to content already posted), 9, 12, 13 and 14 continue to apply after your use ends.
12. Our responsibility to you
Your rights under consumer law come first. Nothing in these terms takes away rights you have under laws that cannot be excluded, including:
in New Zealand, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986;
in Australia, the Australian Consumer Law;
in the United Kingdom, the Consumer Rights Act 2015;
in the European Union, the consumer-protection laws of your country, including those on digital content;
similar laws where you live.
Subject to those rights:
Tallmark is provided free, "as is" and "as available". We try hard to make it accurate and reliable, but we do not promise that it will be error-free, always available, or that its estimates or information will be right for you.
We are not responsible for decisions you make based on the app instead of on advice from a health professional.
We are not responsible for what other members post in Community, though we filter it and act on reports (section 8A).
We are not responsible for decisions you make based on an AI answer in Chat with Tally instead of on advice from a health professional (section 10A).
We are not responsible for losing records because a phone was lost, reset, replaced or broken, or the app was deleted, since the app deliberately keeps no backup (see section 10).
We are not liable for loss that was not reasonably foreseeable, or for loss of profits, business or opportunity.
Where our liability can be limited by law, our total liability to you for everything to do with Tallmark is limited to NZ$100, or the amount you paid us for the app (which is nothing), whichever is greater.
These limits do not apply to death or personal injury caused by our negligence, to fraud, or to anything else the law does not let us limit.
If you use Tallmark in the course of a business (which we do not expect), the Consumer Guarantees Act 1993 does not apply, to the extent the law allows.
13. Governing law and disputes
These terms are governed by the laws of New Zealand, and the courts of New Zealand can hear disputes about them.
If you live outside New Zealand, you still have the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in your local courts if your local law gives you that right.
If you have a problem, please email us first. Most things can be sorted out quickly.
14. Apple App Store terms
This section applies if you downloaded Tallmark from Apple's App Store. If it conflicts with the rest of these terms, this section wins for App Store users.
1. Agreement. These terms are between you and New Version Ltd only, not Apple Inc. ("Apple"). New Version Ltd, not Apple, is solely responsible for Tallmark and its content.
2. Scope of licence. Your licence to use Tallmark is limited to using it on Apple-branded products that you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions. Tallmark may also be used by other accounts associated with you through Family Sharing, as those rules allow.
3. Maintenance and support. New Version Ltd is solely responsible for any maintenance and support for Tallmark, as described in these terms or as required by law. Apple has no obligation to provide any maintenance or support for Tallmark.
4. Warranty. New Version Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed. If Tallmark fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Tallmark (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Tallmark. Any other claims, losses, liabilities, damages, costs or expenses due to a failure to conform to a warranty are New Version Ltd's responsibility.
5. Product claims. New Version Ltd, not Apple, is responsible for addressing any claims by you or any third party relating to Tallmark or your possession or use of it, including (a) product liability claims; (b) any claim that Tallmark fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation.
6. Intellectual property claims. If a third party claims that Tallmark or your possession and use of it infringes that third party's intellectual property rights, New Version Ltd, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
7. Legal compliance. You confirm that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer name and address. Questions, complaints or claims about Tallmark go to: New Version Ltd, New Zealand; tallmark.support@newversion.studio.
9. Third-party terms. You must comply with any applicable third-party terms when using Tallmark (for example, your mobile network's terms).
10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. When you accept these terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
15. Google Play terms
This section applies if you downloaded Tallmark from Google Play.
These terms are between you and New Version Ltd only. Google is not a party to them and is not responsible for Tallmark or its content.
Your use of Google Play is governed by Google's own terms, including the Google Play Terms of Service. If these terms conflict with Google Play's terms in a way that affects Google, Google's terms apply to that part.
Tallmark is free to download. Tallmark Plus (section 8B) is bought through Google Play, and refunds for it are handled under Google Play's policies.
Support for Tallmark is provided by us, not Google.
16. Changes to these terms
We may update these terms, for example when the app changes or the law changes. We will update the version number and date at the top, and if a change matters to you, we will tell you in the app before it applies. If you keep using Tallmark after a change applies, the new terms apply. If you do not agree, please stop using the app and delete it.
17. General
If a court finds part of these terms cannot be enforced, the rest still applies.
If we do not enforce a right straight away, we can still enforce it later.
You may not transfer these terms to anyone else. We may transfer them to a company that takes over Tallmark, as long as your rights are not reduced.
These terms, the Privacy Policy and the Health disclaimer are the whole agreement between you and us about Tallmark.
