The University values proper conduct of students inside and outside the premises of the school. It is important that all students are aware of their rights and privileges as well as their limitations with respect to the rights of other students and personnel of the University. As we are guided by the Student Handbook 2012 Edition, please read in the succeeding pages the New Student Code of Discipline for this will properly guide you during this time of your study. Also, you may avail of our services simply by following some steps.
Orientation on the New Student Code of Discipline
Students need to be aware of the provisions of the New Student Code of Discipline even though they are mostly at the comfort of their homes. The full context of the policy is presented on the succeeding pages.

NEW STUDENT CODE OF DISCIPLINE

INTRODUCTION
When a person registers as a student and is accepted in DMMMSU, a contract is established where he submits himself and agrees to comply with the rules and regulations of the University. Upon his enrollment, he assumes all responsibilities appertaining to his status as a student specifically towards the administration, staff, faculty members and fellow students.
Every student must value and exercise self-discipline to earn due respect from fellow students, staff, faculty members, stakeholders and the administration. He should conduct and present himself in a decent manner and abide with generally accepted norms of behavior at all times. He should observe courtesy and proper decorum in dealing with his fellow students, faculty, personnel and the administration.
ARTICLE I. GENERAL PROVISION
Section 1. Every student shall obey the laws of the land, the rules and regulations of the institution and the standard of a good society.
Section 2. Every student must be provided a copy of the DMMMSU Student Handbook and be knowledgeable of its contents. This handbook will serve as his constant reference and guidance in his conduct in the University.
ARTICLE II. RULES AND REGULATIONS ON STUDENT CONDUCT AND DISCIPLINE
Section 1. The provision of this code shall apply to all bona fide students of the Don Mariano Marcos Memorial State University.
Section 2. At all times, every student must observe, follow, and abide by all the laws of the land and all policies and regulations adopted by the University. These policies and regulations shall be presented during the orientation program for first year students and transferees.
Section 3. All school personnel are mandated to enforce and supervise overall compliance to the provisions of this Code in their respective areas of responsibility. For the purpose of implementing University policies; rules and regulations and the provision of this Code, the President, Vice Presidents, Chancellors, Directors, Deans, Chairpersons, Faculty Members and Non-Teaching Personnel are deemed persons in authority. SBO officers are also deputized in the implementation through the guidance of their respective advisers.
Section 4. A student under suspension shall not earn any credit during the period of his suspension. As such, he shall be marked absent in all affected classes. He shall not be allowed to join and participate in any student activity, nor he/she shall be permitted to enter the school premises or avail of school facilities
Section 5. A student who shall be found to be pregnant shall be advised to take a leave from her classes until after her childbirth, primarily to save the gestating mother from the stress of school activities for the benefit of the unborn child.
Section 6. A student, even when outside the University premises, shall be subjected to corresponding disciplinary action and penalties under any of the following circumstances:
6.29 Fighting, use of physical force or violence to settle issues, or infliction of physical injuries upon another student, faculty member, non-teaching employee, or stranger whereby the offender/s are students. Provided, that self-defense or defense of relative or stranger or defense of property shall exempt a proper party from punishment
6.30 In case of multiple offenses, the offense which carries the higher/highest penalty shall be imposed.
Section 7. Offenses which violate the accepted norms of conduct and which are not provided for in this code shall be left to higher authorities for appropriate action.
Section 8. Implementation of the sanctions to the offenses shall be done within official school days.
Section. 9. All notice of offenses and punishments shall be duly signed by the implementing authority and the offender. A copy of which shall be furnished to the parents and the SAS Office.
Section 10. The procedure for the redress and settlement of complaints and grievances in the University shall conform to due process of law in order to ensure the highest degree of fairness and justice to all concerned. To the greatest extent, however, all concerned should seek all remedies through counseling, arbitration and amicable settlement of conflicts. In every case, the ultimate aim shall be the restoration of impaired human dignity and, where necessary, restoration of material damages. Sanctions and punishment shall be meted out sparingly, taking into considerations the capacity of individual to learn and profit from their mistakes. (Adopted from Sec. 17. ARTICLE III. COMMITTEES AND PROCEEDINGS
Section 1. Student Discipline Committees
The Student Discipline Committees shall be formed at the start of the school year. The designation of all members shall cover a period of one (1) year. In case the student leaders (Governor, Mayor, and Captain) are parties of the case, the rule of succession shall apply.

CC shall be formed in all campuses, and it shall be under the General
Supervision of the SAS Head.

and a Staff preferably with legal background)
Two (2) student leaders, the CSBO Regional Chairperson and SBO Governor of the student who committed the offense. However, if there are two (2) or more student respondents and they belong to different colleges, their SBO Governors shall become members of the committee

Section 2. Jurisdiction
All cases involving discipline of students under these rules shall be subject to the jurisdiction of the DC,CoC/IC, CC or UC depending on the degree or circumstances of the offense or the frequency the offense is committed.
2.1 Department
a) Reprimand and/or an offense with a penalty of one-week suspension
b) First offense as applicable
c) Students involved belong to the same department
2.2 College/Institute Committee
a) Reprimand and/or an offense with a penalty of one-week suspension
b) First Offense as applicable
c) Students involved belong to different departments in the College/Institute
2.3 Campus Committee
a) Offenses with a penalty of more than one-week suspension
b) 2nd, 3rd offenses
c) Special cases
d) Students involved belong to different Colleges/Institutes
2.4 University Committee
a) Student(s) involved belong to different campuses.
b) The findings and recommendations of this Committee will be forwarded to the University President for appropriate action.
Section 3. Filing of Charges
a) All complaints and violations involving discipline of students shall be filed in writing at the Office of the Chancellor through Student Affairs and Services (SAS).
b) The SAS Head shall notify the student concerned of the complaint filed against him/her, providing a copy of the same with specific instruction to submit a written reply within 72 hours or three (3) days upon receipt thereof. If the third day falls on a Saturday, Sunday or holiday, the same shall be submitted the next immediate school day.
c) The SAS Head notifies the Preliminary Investigation Committee (PIC) to evaluate the merits of the written complaints or reported violations. If necessary, or upon the request of the student/s being complained of, the Committee may summon both parties for possible mediation.
d) The report of the Committee shall be submitted to the Office of the Chancellor within 2 days. Should a probable cause exist, the PIC recommends that a formal charge be issued by the Chancellor. Otherwise, the case shall be dismissed.
e) The Chancellor shall notify the student of the formal charge filed against him/her, providing a copy of the same with specific instruction to submit a written reply within 72 hours or three (3) days upon receipt thereof.
f) The Chancellor shall then refer the matter to the Committee with appropriate jurisdiction.
Section 4. Admission of Guilt
If the respondent admits his guilt, the Committee recommends the corresponding penalty to the Chancellor who implements the decision. However, the Chancellor or the President as the case may be, has the authority to amend, modify or nullify the penalty as recommended.
Section 5 . Trial
If the respondent does not admit his guilt, trial of the case by either the DC/Co/I C/CC/ UC shall commence. The DC/Co/I C shall resolve the case in three (3) days and the CC/UC in five (5) days after receipt of the written answer by the Committee Chairperson.
Summary Procedure. This scheme is being followed to expedite the resolution of cases without sacrificing due process as provided by the law wherein notice and hearing are afforded to both parties. Recommended penalties by the Student Discipline Committee shall be implemented by the Chancellor, although the latter is authorized to modify the penalty before its implementation.
Section 6. Finality of Decision
The penalty of suspension not exceeding 30 calendar days is non-appealable and shall immediately become final and executory.
Section 7. Appeal
Only cases of dismissal from the University or suspension for more than 30 calendar days may be given cognizance for reconsideration or appeal. All pleadings to this effect shall be filed with the Office of the President within 15 days from receipt of the decision. Otherwise, the decision becomes final and executory.
