Welcome to SoleMare Analytics. Please read these Terms & Conditions ("Terms") carefully before accessing our website or using our Pine Script® tools, indicators, and educational publications (collectively, the "Services").
By accessing our website or using MarketMastery™ tools available through the TradingView Marketplace, you agree to be bound by these Terms, our Privacy Policy, our Risk Disclaimer & Financial Notice, and applicable TradingView terms and policies.
1. General Provisions & Acceptance
Operator: SoleMare Analytics ("we," "us," or "our") operates this website and develops market analysis tools published under the author handle dgtrd on TradingView.
Agreement: Accessing or using our Services constitutes your agreement to comply with these Terms, our Privacy Policy, our Risk Disclaimer & Financial Notice, and applicable TradingView terms and policies.
Modifications: We may update these Terms from time to time. Updated versions will be posted on this page with a revised Effective Date.
2. Subscriptions, Payments & Access
MarketMastery™ tools are distributed through the TradingView Marketplace under the subscription and access terms presented by TradingView.
Marketplace Processing: Subscription payments, billing, renewals, and subscription management are handled through TradingView.
No Direct Billing: SoleMare Analytics does not collect or process subscription payment information.
Access: Access to the applicable tools is managed through TradingView based on the relevant subscription or entitlement.
Cancellation & Refunds: Subscription cancellations and refund requests are subject to TradingView's applicable terms, billing policies, and Marketplace procedures.
SoleMare Analytics does not issue off-platform refunds or manage TradingView subscription accounts.
3. Usage Rights & Intellectual Property
Subscribers may use MarketMastery™ tools available through TradingView for their own trading and market analysis, subject to these Terms and applicable TradingView policies.
You may not:
Redistribute or Publish: Share, sublicense, publish, or redistribute the scripts, modified versions, or derivative tools.
Reverse-Engineer: Decompile, unpack, reverse-engineer, or attempt to extract the underlying Pine Script® source code or proprietary implementation.
Commercial Exploitation: Copy, adapt, or use the scripts or their underlying implementation to create competing commercial products without prior written permission from SoleMare Analytics.
Circumvent Access Controls: Attempt to bypass, disable, or circumvent access controls or other technical restrictions applied to the tools.
Unauthorized reproduction, redistribution, code extraction, or other misuse may constitute a violation of these Terms and/or applicable TradingView policies and may result in action under those applicable policies.
4. Technical Performance & Data Dependencies
MarketMastery™ tools depend on TradingView's platform, infrastructure, market data, and, where applicable, third-party data sources.
Certain features, including volume-, flow-, and Open Interest-based components, may depend on the availability and quality of the relevant market or derivatives data.
SoleMare Analytics does not guarantee the availability, accuracy, completeness, timeliness, or uninterrupted delivery of data provided through TradingView or third-party data providers.
SoleMare Analytics is not responsible for TradingView outages, platform interruptions, data-feed issues, connection problems, or other technical limitations outside our control.
5. Educational & Risk Disclaimer
MarketMastery™ tools and publications are provided for educational, informational, and analytical purposes only and do not constitute financial, investment, or trading advice.
Trading involves substantial risk, and no guarantee is made regarding the accuracy, performance, or future results of any tool, analysis, signal, or market observation.

6. Intellectual Property
SoleMare Analytics retains all applicable rights in its original MarketMastery™ scripts, source code, proprietary implementations, visual designs, documentation, and branding.
MarketMastery™ tools may incorporate established market concepts, methodologies, terminology, and analytical techniques. Such concepts and principles are not claimed as proprietary merely because they are implemented within our tools.
References to third-party concepts, methodologies, or terminology are for descriptive or analytical purposes only and do not imply affiliation with, sponsorship by, or endorsement from any third party.
7. Updates, Modifications & Availability
MarketMastery™ tools may be updated, modified, enhanced, replaced, or discontinued over time.
Features, visuals, calculations, or components may change as the tools evolve.
Updates and improvements may be made available through TradingView, subject to applicable Marketplace terms and platform functionality.
Continuous availability or any specific feature set is not guaranteed.
8. Termination of Access
Access to MarketMastery™ tools may be suspended or terminated where permitted under these Terms or applicable TradingView policies, including in cases involving:
Violation of these Terms.
Breach of applicable TradingView terms or policies.
Unauthorized redistribution, code extraction, or other misuse of the tools.
Suspension, termination, or material changes to the relevant TradingView Marketplace service.
Where access is suspended or terminated by TradingView, the timing and conditions of such action are governed by the applicable TradingView terms and policies.
SoleMare Analytics does not control TradingView's account, subscription, or script-access mechanisms.
9. Limitation of Liability
To the maximum extent permitted by applicable law, SoleMare Analytics shall not be liable for:
Trading losses, lost profits, or missed opportunities.
TradingView or other platform-related disruptions, outages, errors, or data issues.
Decisions or actions taken based on information, signals, calculations, or outputs generated by the Services.
Any indirect, incidental, special, or consequential damages arising from the use of or inability to use the Services.
Users are responsible for their own trading decisions and for evaluating the Services before relying on their outputs.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
10. TradingView Terms & Policies
Use of MarketMastery™ tools through TradingView is also subject to TradingView's applicable Terms of Use, Marketplace terms, House Rules, and other relevant policies.
In the event of any conflict between these Terms and applicable TradingView terms governing the use of the Services through TradingView, the applicable TradingView terms prevail.

By accessing this website or using MarketMastery™ tools available through the TradingView Marketplace, you confirm that you have read, understood, and agreed to these Terms and the applicable TradingView terms and policies.
