# Terms of Service

Please read these Terms of Service ("Terms") carefully before using the SelfAware mobile application ("App") operated by James Kirkham ("we", "us", or "our").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

## 1. Use of the App
SelfAware is a personal AI assistant app that helps you manage your daily life, including health insights, trip planning, event discovery, smart scheduling, and more. You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.
You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials.
## 2. Accounts
To access certain features, you must create an account using email, Apple Sign In, or Google Sign In. You agree to provide accurate information and keep your account details up to date. You are responsible for all activity under your account.
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have violated these Terms.
## 3. Subscriptions and Payments
SelfAware offers a free tier with limited functionality and a premium subscription ("SelfAware Pro") that unlocks additional features.
- **Billing**: Subscriptions are billed through Apple's App Store. By subscribing, you agree to the pricing displayed at the time of purchase.
- **Renewal**: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- **Cancellation**: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
- **Price changes**: We may change subscription pricing from time to time. Any price change will take effect at the start of your next billing period following notice.
- **Free trials**: If offered, free trials automatically convert to a paid subscription unless cancelled before the trial ends.
Payment processing is handled entirely by Apple. We do not store or have access to your payment information.
## 4. AI-Generated Content
The App uses artificial intelligence to provide suggestions, recommendations, and insights. AI-generated content is provided for informational purposes only and should not be relied upon as professional advice (including medical, financial, legal, or travel advice).
We do not guarantee the accuracy, completeness, or reliability of AI-generated content. You use such content at your own risk and discretion.
## 5. Health Data
The App may access Apple Health data (with your permission) to provide personalised health insights. Health data is processed locally on your device and via our secure servers to generate insights. We do not sell your health data to third parties.
Health insights provided by the App are not medical advice. Always consult a qualified healthcare professional before making health-related decisions.
## 6. Third-Party Services
The App integrates with third-party services including but not limited to:
- **Apple Health** — for health and fitness data
- **Google Places** — for venue and location information
- **Ticketmaster** — for event discovery
- **Amadeus** — for hotel and flight search
- **Google Calendar** — for scheduling
- **Google / Apple Sign In** — for authentication
Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content provided by third-party services.
## 7. Intellectual Property
All content, features, and functionality of the App (including but not limited to text, graphics, logos, and software) are owned by SelfAware and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes.
## 8. Prohibited Uses
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App or its servers
- Use automated systems to access the App (bots, scrapers, etc.)
- Impersonate any person or entity
- Use the App to harass, abuse, or harm others
- Resell or redistribute access to the App
## 9. Limitation of Liability
To the fullest extent permitted by law, SelfAware and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the App.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
## 10. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
## 11. Indemnification
You agree to indemnify and hold harmless SelfAware and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App or violation of these Terms.
## 12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or by other reasonable means. Your continued use of the App after such changes constitutes acceptance of the updated Terms.
## 13. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App ceases immediately.
## 14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
