Waiver and Release of Liability

1. Agreement and Acknowledgment

By participating in any program, event, activity, membership, or service offered by Roots & Soul Foundation (“we,” “our,” or “us”), you acknowledge and agree to the terms of this Waiver and Release of Liability.

This agreement applies to all participants, including parents, guardians, and minors under their supervision.

2. Assumption of Risk

You understand and acknowledge that participation in our programs involves inherent risks, including but not limited to:

• Outdoor and environmental hazards (uneven terrain, steep hills, cliffs, weather conditions)

• Exposure to animals, insects, and wildlife (including snakes)

• Physical activity and movement-related risks (falls, injuries)

• Interaction with other participants and members of the public

• Participation in farm-based and nature-based environments

You voluntarily assume full responsibility for any risks, injuries, damages, or losses that may occur.

3. Public and Shared Environment Acknowledgment

You understand that activities may take place in:

• Public parks

• Farms and outdoor environments

• Community spaces and partner locations

You acknowledge:

• Non-members and members of the public may be present

• We cannot verify or control all individuals in shared environments

• We are not responsible for the actions or behavior of third parties

4. Parental Responsibility and Supervision

• Parents and legal guardians are fully responsible for supervising their children at all times

• Roots & Soul Foundation is not a childcare provider

• Children are not to be left unattended unless explicitly stated in writing

5. Health, Medical, and Allergy Disclaimer

You acknowledge that:

• You are responsible for disclosing any relevant medical conditions or allergies

• We cannot guarantee an allergen-free environment

• Exposure to food, environmental elements, or other participants may occur

You agree that Roots & Soul Foundation is not responsible for allergic reactions, medical conditions, or related incidents.

6. Release of Liability

To the fullest extent permitted by law, you hereby release, waive, and discharge Roots & Soul Foundation, including its:

• Directors

• Officers

• Volunteers

• Representatives

• Affiliates

from any and all claims, liabilities, damages, or causes of action arising out of or related to:

• Participation in programs or events

• Use of facilities or locations

• Interaction with other participants or third parties

• Injury, illness, loss, or death

7. Indemnification

You agree to indemnify and hold harmless Roots & Soul Foundation from any claims, damages, or liabilities resulting from:

• Your participation or actions

• Your child’s participation or actions

• Violation of organizational policies or agreements

8. Media and Photo Release

You acknowledge and agree that:

• Photos and videos may be taken during events

• Media may be used for community, promotional, or informational purposes

You understand:

• Other participants may independently take and share media

• We cannot control third-party distribution

9. Third-Party Services and Locations

Activities may involve third-party venues or services, including but not limited to:

• Farms

• Parks

• Community spaces

• Event hosts

We are not responsible for:

• Conditions of third-party locations

• Actions or negligence of third parties

• Third-party policies or safety measures

10. Right to Refuse or Revoke Participation

We reserve the right to:

• Deny or revoke participation or membership at any time

• Remove individuals who do not comply with our agreements, policies, or safety expectations

No refund is guaranteed in such cases.

11. Acknowledgment of Understanding

By participating, you confirm that:

• You have read and fully understand this Waiver

• You voluntarily agree to its terms

• You understand that you are giving up certain legal rights

12. Governing Law

This Waiver shall be governed by and interpreted under the laws of the State of California.
