Pursuant to Article 5, Section 2 of our CBA, a grievance is “a written and filed dispute … arising out of or involving … alleged violation of this Agreement.”
A violation of the contract occurs.
Within 30 days, RWU may file a grievance of contract violation.
RAICES management agrees to meet with the RWU Grievance Committee within 5 business days of receiving the grievance.
At the meeting, RWU will propose a plan for resolving the grievance.
If the grievance is not resolved in this meeting, RAICES management has 10 business days to respond in writing with their proposed resolution. (If RAICES does not respond in this time, the proposal by RWU is deemed accepted.
If the matter is deemed arbitrable, RAICES and RWU go to mediation.
If there is no resolution at mediation, the parties go to binding arbitration.
The Arbitrator’s decision is final and binding.
