How to know if a land is under government acquisition

To identify the status of land and know if it falls within the government-acquired zone, what is required is a land information certificate that clearly indicates the status of the land and states whether it is committed acquisition or otherwise.

What is land acquisition?

Firstly before you proceed, I will like to let you know all land belongs to the government of the day.

And if you read on to the end I will be breaking down the different classes of land and how to know government acquisition land and the best places to buy land in Lagos and Ogun state Nigeria, so you would not be misinformed.

Please do note that in anything land matters only a Land surveyor is to be contacted and consulted, not even a lawyer and that is why land information is given by the office of the surveyor-general and not by a judge or in court.

Note: In any zone that land falls within an original survey plan is needed to proceed to process any other titled document in the process of land regularisation, which is to change the land situation so that it follows the rules of laws, on land ownership in Nigeria.

I am saying this because most people don't know that lawyers are trained and licensed to prepare, manage, and either prosecute or defend a court action as an agent for another and who also give advice on legal matters and not land matters. In the case of land matter, your lawyer will only defend if a Survey Plan that represents you as the landowner has been produced and can be presented in court.

To help you better understand the types of land we have in Lagos and Ogun State Nigeria, we will refer to the traffic light system as an analogy, Where Red means stop and yellow means ready but some things have to be in place before it turns green, and green means go now let break it down.

How to know the acquisition of land

Committed government acquisition land 

In our analogy of the traffic light a committed land is in red, and red means stop and it is dangerous to buy or build on this type, this is the land popularly identified as a land acquisition but this is committed land acquisition.

This land has already been allocated for use and is sometimes sold as cheap land just to attract unsuspecting buyers in the shortest time possible.

In the case you buy any of these lands, you still need a survey plan to identify you as the official owner of the land to avoid a dispute with omo-onile, real estate companies and other individuals and also in the case where a pardon is possible you will be the first in line to be attended to.

At this point, an original land survey should be carried out and avoid people who advise backdated survey plan which is a fraudulent way to mimic the system at the expense of the landowner because the plan will not have a file number nor will the unique pillar numbers be requested in the name of the owner because the ministry mandatory payment wouldn't be paid in the process of these fraudulent activities.

Some committed areas have been zoned for airports, roads, and schools for the development of each state.

And in some cases, the lands are also zoned for residential development. In these instances, they build on the land and sell it to the people of the state.


For example, we have such residential development in lands under government acquisition managed by Lsdpc in the following areas of Lagos state: Amuwo, Ikorodu, Ikoyi, Ilupeju, Lekki, Ogba, Ogudu, Surulere And Victoria island.


Some other areas such as Ajah, Ibeju Lekki and Epe also have areas gazetted for residential and re-settlement schemes amidst many other purposes for the development of the state.


Uncommitted Government acquisition( Free from commitment but not excised). 

Now before we proceed to the land in yellow, please do remember I said all land belongs to the Government, inclusive of the ones located In a free zone, that is because the Land Use Act, Laws of the Federation of Nigeria 1990, Chapter 202 states that :

An Act to Vest all Land compromised in the territory of each State (except land vested in the Federal government or its agencies) solely in the Governor of the State, who would hold such Land in trust for the people and would henceforth be responsible for allocation of land in all urban areas to individuals resident in the State and to organisations for residential, agriculture, commercial and other purposes while similar powers will with respect to non-urban areas are conferred on Local Governments. (27th March 1978) Commencement.


Now as you can see the land under acquisition is held in the trust of you the people and can be allocated to individuals for residential, commercial and any other purpose,

and these lead us to the lands in yellow. The government is similar to a bank holding our money but to withdraw it we have to identify ourselves and meet all requirements of the withdrawal phase. This leads me to answer a frequently asked question below

Can the government take your land in Nigeria?

This means the government can take your land in Nigeria, but if the land was acquired following the right process in the right location and awarded the right certificate then the landowner should be compensated in the fair market value of the property. 

These reasons listed below can lead to the government taking your land in Nigeria or reject an application for ratification but not limited to the following:



 

(a)   the alienation by the occupier by assignment, mortgage, transfer of possession, sublease, or otherwise of any right of occupancy or part thereof contrary to the provisions of this Act or of any regulations made thereunder;

 

(b)   the requirement of the land by the Government of the State or by a Local Government in the State, in either case for public purposes within the State, or the requirement of the land by the Government of the Federation for public purposes of the Federation;

 

(c)    the requirement of the land for mining purposes or oil pipelines or for any purpose connected therewith.

 

 

(a)   the requirement of the land by the Government of the State or by a Local Government in the State in either case for a public purpose within the State, or the requirement of the land by the government of the Federation for public purposes of the Federation.

 

(b)   the requirement of the land for mining purposes or oil pipelines or for any purpose connected therewith;

 

(c)    the requirement of the land for the extraction of building materials;

 

(d)   the alienation by the occupier by sale, assignment, mortgage, transfer of possession, sublease, bequest or otherwise of the right of occupancy without the requisite consent or approval.

The land in yellow has not been allocated for any purpose, yellow means ready in the traffic light system we use as an analogy but we will have to to proceed with caution and the land can be allocated and released as long as it meets the following criteria:


The subject site must not fall within a Committed Government Acquisition.

The subject site must not fall within an existing Forest Reserve or Agricultural Land Use.

The subject site must not fall on road alignment.

The appropriate Setback must be observed.

The appropriate distances from Drainage Systems, Canals, Oil and Gas Pipelines, Electricity Substation, High Tension Power Line, Electricity and Telephone poles, Water Pipelines, etc., as laid down by Physical Planning and Town Planning Laws must be observed.

The subject site must fall within the permitted Regularization Area

The land in yellow has not been allocated for any purpose, yellow means ready in the traffic light system we use as an analogy but we will have to to proceed with caution and the land can be allocated and released as long as it meets the following criteria:


The subject site must not fall within a Committed Government Acquisition.

The subject site must not fall within an existing Forest Reserve or Agricultural Land Use.

Phase 1 of identifying if the land is free from government  acquisition




Note: Surveyor's Physical visitation (Site and office work) is important to verify information on site even if survey plan is provided so as to verify if the information of the survey is associated to the land, and will only be excluded if a client insists we work with provided survey plan.


Phase 2 of identifying if the land is free from government  acquisition

An interim copy survey plan of the plot will be produced in 2 copies for the sole purpose of determining the status of the land


Phase 3 of identifying if the land is free from government  acquisition

Payments are made to the state's revenue account and land information on the land will be processed to acquire land status.



Phase 4 of identifying if the land is free from government  acquisition


A written report and state-authorized land information certificate will be delivered.
