The Legislative

Summary:

The Democratic-Republic of Boredesia has a legislature that consists of two bodies: The Maktei and The Senate. The Maktei is composed of 10 voting members from the 10 provinces of Boredesia, who are elected by the people every two years and six months. To run for the Maktei, a person must be at least 25 years old, a Boredesian citizen, and must have lived in Boredesia for at least 7 years. The elected members of the Maktei can be re-elected as many times as they want. The Maktei has the power to propose impeachment, and the Senate must be involved in the process. The Maktei also has the right to propose and approve a Declaration of War. The Senate also consists of 10 voting members, 1 from each province, and are elected every two and a half years. To run for the Senate, a person must be at least 25 years old, a Boredesian citizen, and must have lived in Boredesia for at least 3 years. They can be re-elected up to 4 times, with a maximum term of 10 years. In times of war or rebellions or if the legislative branch is down, a Provisional Government can be formed, consisting of ministers from the Presidential Federal Cabinet. The Maktei and the Senate will be temporarily suspended until the war or rebellion ends, or until the legislative branch is reformed. The president can announce "Nulla legislatores" to initiate a Provisional Government. The Constitutional Court must declare this constitutional or unconstitutional within 24 hours; otherwise, it will go into effect immediately 

Constitutional Article:

Section 1: The Legislature


All legislative power is vested In the National Assembly of The Democratic-Republic of Boredesia, which will consist of The Maktei and The Senate.


Section 2: The Maktei


The Maktei will consist of 10 voting members from the 10 provinces of The Democratic-Republic of Boredesia.

Each voting member will have 1 vote. The members of the Maktei will be Elected by the people every 2 years and 6 months in their respective Province. To run as a member of The Maktei must be of the age of 25 or older, they must also be a Boredesian Citizen that has lived in Boredesia for at least 7 years. The members of

The Maktei can be elected as many times as they want

When a Vacancy happens in the Maktei, the Representative will have a Secondary Representative who will become that Representative until the Normal Representative returns.


The Secondary President of the Democratic-Republic of Boredesia shall be the President of the Maktei. They will also take on the Presidency when the President is not in office (until they get back into office e.g: got injured and is in the hospital) died, is impeached, or resigns. They will not have a vote until there is an equal tie in the Maktei (Excluding a Declaration of War and an Impeachment trial).


The Maktei has the sole power to propose an impeachment, The Impeachment must have a reason and not because they are a political rival or they said something controversial. The Impeachment of the President will not just be confined to The Maktei, but the senate will also be involved. The Senate will gather inside of The Maktei building which will have 20 Seats inside of it (10 for a regular session of The Maktei and the other 10 for an impeachment trial). They will all give their reason of why and why not to impeach the president They'll all vote that day after they give their reasons. If there is a tie in the impeachment trial the president will stay in office.


The Maktei has the right to approve and propose a Declaration of War. The president has the power to propose a declaration of war to The Maktei. For a Declaration of War to pass, there must be a majority vote that approves the Declaration of War in The Maktei. If there is a tie, the Secondary President does not have the power to break the tie.


Section 3: The Senate


The Senate will consist of 10 voting members, 1 from the 10 provinces of The Democratic-Republic of Boredesia


Each member will have 1 vote. They will be elected by the people every 2 years and 6 months. To run as a member of The Senate you must be of the of the age 25 years or older, they must also be a Boredesian

Citizen that has lived in Boredesia for at least 3 years. They can be elected 4 times resulting in their maximum term to be 10 years.


Section 4: Provisional Government


A Provisional Government can only be formed during times of war, times of rebellion, or if the legislative branch is completely down or has collapsed.


During the formation of a Provisional Government the Maktei and the Senate will be Temporarily suspended until said war or rebellion ends or until the legislative branch is reformed.


A provisional government will consist of ministers from the Presidential Federal Cabinet.


For a Provisional Government to begin the president must announce "Nulla legislatores"


The Constitutional Court must either declare "Nulla legislatores" as constitutional or unconstitutional within 24 hours, if failed to do so it will go into effect immediately.
