These Terms of Service ("Terms") govern your use of the LoadMath iOS application ("the App"), developed and operated by [DEVELOPER_NAME] ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, whichever is greater, to use the App or to make purchases inside it. The App is intended for use by professional truck drivers, owner-operators, and small fleet operators.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use LoadMath on iPhone and iPad devices that you own or control, for your own personal or business use. You may not:
Copy, modify, distribute, sell, or rent the App;
Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent that applicable law expressly prohibits this restriction;
Use the App in any unlawful manner, or in a way that violates these Terms or Apple's App Store terms.
In addition to these Terms, your use of the App is also subject to Apple's Standard End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where Apple's Standard EULA conflicts with these Terms, Apple's terms control.
LoadMath includes optional Premium features that may be unlocked through a subscription or a one-time in-app purchase. All purchases are processed by Apple through the App Store.
Auto-renewing subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the period. Cancel in iOS Settings → [your name] → Subscriptions.
One-time purchases unlock the relevant Premium feature on Apple IDs that purchased it.
Pricing is shown inside the App at the time of purchase, in your local currency where supported by the App Store.
Refunds are handled by Apple, not by us, under Apple's then-current refund policy. To request a refund, visit https://reportaproblem.apple.com.
We may change Premium pricing or features for future purchases, but a change does not affect a subscription you have already paid for during its current billing period.
LoadMath performs arithmetic on the numbers you enter. The results — including cost per mile, profit per load, projected daily profit, and tax estimates — are estimates based solely on the data you provide. They are not financial advice, accounting advice, tax advice, or any other form of professional advice.
You are responsible for:
The accuracy of the cost and rate data you enter;
The business decisions you make based on the App's output;
Filing your own taxes, IFTA returns, and any other regulatory paperwork;
Consulting a qualified accountant, tax professional, or attorney before making material business decisions.
We make no guarantee that any load saved as "profitable" in the App will produce a profit in reality, or that any tax estimate matches your actual tax liability.
LoadMath does not collect or transmit your data. Everything you enter is stored on your device. See the Privacy Policy for details. You are responsible for backing up your device — if you lose your device or uninstall the App without a backup, your LoadMath data will be lost, and we will not be able to recover it.
You agree not to use the App in any way that:
Violates any applicable law or regulation;
Infringes the rights of any third party;
Attempts to gain unauthorized access to any part of the App or its underlying systems;
Introduces malware or any harmful code.
LoadMath, including its name, logo, design, source code, and content, is the property of [DEVELOPER_NAME] and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited license described in Section 2.
The App is provided "as is" and "as available", without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, secure, free of viruses, or that calculations will be free of bugs.
To the maximum extent permitted by applicable law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, in no event will [DEVELOPER_NAME] be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of revenue, loss of data, business interruption, or any damages arising from your use of, or inability to use, the App — even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of or related to the App or these Terms is limited to the greater of (a) the total amount you have paid to Apple for LoadMath Premium in the twelve months immediately preceding the event giving rise to the claim, or (b) US $50.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You may stop using the App at any time by uninstalling it. We may suspend or terminate your access to the App or to Premium features if you violate these Terms. On termination, the license granted in Section 2 ends, and you must uninstall the App.
We may revise these Terms from time to time. If we make a material change, we will update the "Last updated" date at the top of this page and, where appropriate, notify users inside the App. Your continued use of the App after a change indicates acceptance of the revised Terms.
These Terms are governed by the laws of [JURISDICTION], without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the courts located in [JURISDICTION].
If you are a consumer resident in the European Union, the United Kingdom, or another region with mandatory consumer-protection laws, the above choice of law and venue does not deprive you of the protections afforded by the mandatory laws of your country of residence.
