Terms & Conditions for GNZY™ 

Welcome to GNZY™! These Terms & Conditions ("Terms") govern your access to and use of GNZY™ ("the App"), operated by
SPIKE MEDIA PRIVATE LIMITED ("Company," "we," "us," or "our"). By accessing or using GNZY™, you agree to comply with these Terms. If you do not agree with any part of these Terms, please do not use the app. 

1. Eligibility & Age Restrictions

• Clause 1.1: Age Requirement
  To use GNZY™, you must be at least 13 years old, or the minimum age of digital consent in your country, whichever is higher. If you are under this age, you are not permitted to access, register, or use GNZY™. We do not knowingly collect or solicit personal data from children under 13, in accordance with COPPA and Apple’s child safety requirements.

• Clause 1.2: Parental Consent & App Store Compliance
  If you are between 13 and 17 years old, you must obtain verifiable parental or legal guardian consent before using GNZY™. By using the platform, you confirm that you meet these age requirements and have obtained any necessary consents. Failure to comply may result in removal of access or suspension of your account, and GNZY™ may remove content or data associated with the violation.

• Clause 1.3: False Declaration
  Any user found to have falsely declared their age or provided misleading information to gain access to GNZY™ in violation of these Terms may face account suspension, termination, and possible removal of associated user data, as required under Apple’s developer policy and applicable law.

2. Account Registration & Security

• Clause 2.1: User Account Information
  To create an account on GNZY™, you must provide complete, accurate, and current information during registration. You agree not to impersonate another person or entity, or to misrepresent your identity or affiliation in any way. Providing false, misleading, or incomplete information violates these Terms and may result in account suspension or permanent termination, in accordance with Apple’s policy against fraudulent or misleading behavior.

• Clause 2.2: Account Security
  You are solely responsible for maintaining the confidentiality and security of your login credentials, including passwords and authentication methods. You agree to take reasonable steps to prevent unauthorized access and to log out from your account at the end of each session if accessing the app from a shared device. GNZY™ is not liable for any unauthorized activity on your account unless the breach is due to our own negligence.

• Clause 2.3: Reporting Unauthorized Use
  If you suspect or become aware of any unauthorized access or use of your account, you must immediately notify us at hello@gnzy.in. While we will take appropriate steps to secure your account upon receiving such notice, GNZY™ cannot be held liable for any loss or damage resulting from failure to report unauthorized use in a timely manner.

• Clause 2.4: Device & Platform Responsibility
  You acknowledge that you are responsible for the security of your own device and for ensuring that your operating system and GNZY™ app are updated to the latest available versions. GNZY™ complies with Apple's best practices for secure data handling and encourages you to use device-level protections such as Face ID, Touch ID, or passcodes where available.

3. Acceptable Use Policy

By using GNZY™, you agree to use the platform responsibly and in compliance with applicable laws and App Store policies. You must not engage in any of the following prohibited behaviors:

Clause 3.1: Fraudulent Activities
You may not use GNZY™ to engage in fraudulent or deceptive behavior, including but not limited to:

• Creating fake accounts or placing fake orders.

• Impersonating individuals or entities.

• Committing identity theft or payment fraud.

Such actions are strictly prohibited under Apple’s App Store policies and may lead to immediate termination of your account and possible legal action.

Clause 3.2: Malicious Activities
You must not engage in any malicious, disruptive, or unauthorized technical activity, including:

• Attempting to gain unauthorized access to GNZY™’s systems.

• Distributing malware, ransomware, or spyware.

• Conducting phishing attacks, DoS attacks, or exploiting software vulnerabilities.

GNZY™ reserves the right to report such incidents to Apple and appropriate authorities.

Clause 3.3: Inappropriate or Harmful Content
Users are prohibited from posting or sharing any content that:

• Promotes hate speech, racism, sexism, or discriminatory ideologies.

• Contains threats, violence, or harassment toward individuals or groups.

• Displays or implies sexually explicit or adult content.

• Publishes personal information, including phone numbers, email addresses, or financial details.

• Spreads misinformation, defamation, or intentionally misleading claims.

• Violates Apple’s Objectionable Content Policy (App Store Review Guideline 1.1).

GNZY™ may remove such content, disable accounts, and report serious violations to Apple as required.

Clause 3.4: Software Tampering
You may not attempt to:

• Reverse-engineer, decompile, disassemble, modify, or tamper with GNZY™'s app or APIs.

• Interfere with the functionality or performance of the app, or access it in ways not intended by GNZY™.

Such actions are a direct violation of Apple's developer terms and may lead to device or account bans from the App Store ecosystem.

Clause 3.5: Manipulative Practices
You may not use bots, automation tools, scripts, or other mechanisms to:

• Artificially inflate likes, ratings, or app engagement.

• Post fake reviews or manipulate visibility in search results or recommendations.

GNZY™ actively monitors for manipulation and reserves the right to take corrective action, including removal of false data and permanent suspension of your account.

Enforcement and Consequences
Violations of this Acceptable Use Policy may result in:

• Content removal, temporary or permanent account suspension.

• Reporting to Apple for enforcement under their developer and user policies.

• Legal action where applicable under local or international law.

4. User-Generated Content (UGC) & Moderation

GNZY™ enables users to share content such as product reviews, images, and ratings to enhance the shopping experience. All UGC must adhere to the community standards, legal obligations, and the App Store’s content policies.

Clause 4.1: Content Rights & Limited License
By posting any form of content on GNZY™, you retain ownership of your intellectual property but grant GNZY™ a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, use, reproduce, modify, adapt, publish, translate, display, and distribute such content.
This license is granted solely for purposes of app operation, content moderation, marketing, analytics, and improving user experience, as permitted by Apple’s policies.

You represent and warrant that:

• You own the rights to the content you post or have permission to post it.

• Your content does not infringe upon any third-party rights (copyright, trademark, etc.).

Clause 4.2: Prohibited UGC
You are strictly prohibited from uploading or sharing content that:

• Violates any applicable law or Apple’s content policies.

• Contains obscene, defamatory, hateful, threatening, or violent material.

• Shares personally identifiable information (PII) such as phone numbers, email addresses, or home addresses in comments, reviews, or images.

• Infringes on third-party intellectual property, including unauthorized brand logos or product images.

• Is promotional, spam-like, or off-topic from the intended context of the product or service.

GNZY™ reserves the right to report serious violations to Apple and comply with legal takedown requests (e.g., DMCA claims).

Clause 4.3: Content Moderation Policy
GNZY™ employs manual and automated moderation mechanisms to enforce these content guidelines and ensure a safe user environment.

We reserve the right, at our sole discretion, to:

• Review, flag, edit, restrict, or remove any user content without prior notice.

• Disable or suspend accounts that repeatedly violate our UGC policies or upload inappropriate content.

• Collaborate with Apple in enforcement if content violates App Store Review Guideline 1.1 (Objectionable Content).

Note: Users under 13 are strictly prohibited from submitting any UGC. For users between 13–17, parental consent is required for any content submission, in accordance with COPPA and Apple’s developer policies.

5. Purchases, Payments & Refunds

All purchase activities made through GNZY™ must adhere to applicable laws, platform guidelines, and Apple’s payment policies.

Clause 5.1: Pricing & Availability
All product prices, availability, discounts, and delivery estimates displayed within GNZY™ are subject to change at any time without prior notice. GNZY™ makes no guarantee that products visible in the app will remain in stock or maintain their listed pricing.

We strive to display accurate information, but GNZY™ is not liable for pricing errors, mislabeling, or discontinued listings. Final prices and availability are governed by the respective brand or seller.

Clause 5.2: Secure Transactions & Data Handling
All purchases are processed using secure, PCI-DSS compliant third-party payment gateways. GNZY™ does not collect, store, or access any credit/debit card numbers or sensitive payment details directly.
Your payment information is securely transmitted to third-party processors such as Razorpay, Stripe, or Apple Pay (where applicable), in compliance with Apple’s App Store policies.

In-app purchases of digital goods (if any) will utilize Apple’s In-App Purchase (IAP) system, per App Store Guideline 3.1.1. For physical goods or services, transactions may be routed through third-party processors, and Apple will not be involved in the transaction.

Clause 5.3: Refunds, Returns & Dispute Resolution
Refunds are governed by the return policy of the individual seller or brand from whom the product was purchased. GNZY™ serves as a platform and does not directly fulfill orders.

Unless otherwise stated on the product page, GNZY™ enforces a 24-hour return window from the time of delivery confirmation. Eligibility is determined based on:

• Product condition,

• Proof of purchase,

• Compliance with the brand’s refund criteria.

Once a return is approved, refunds are initiated within 7–10 business days.
Timeframes may vary depending on the payment processor and bank involved.

Note: For purchases made using Apple’s IAP (e.g., digital subscriptions or downloadable assets), all refund requests must be made directly to Apple Support, per App Store refund policies.

Clause 5.4: Disputes Between Buyers and Sellers
GNZY™ is not legally responsible for disputes arising between users and sellers. However, we may offer voluntary mediation or support to help resolve issues related to payments, deliveries, or product quality.

For unresolved issues with app functionality, unauthorized payments, or refunds on digital goods, users may contact us at support@gnzy.in or escalate through Apple Support, if applicable.

6. Advertising & Third-Party Links

GNZY™ may include third-party content and advertisements to support the platform and enhance your shopping experience. This clause outlines how such content is handled in compliance with Apple’s developer policies.

Clause 6.1: Sponsored Content and Advertisements
GNZY™ may display advertisements, sponsored listings, or branded content throughout the platform. Such content may be presented based on your interests, browsing behavior, or general app engagement metrics, in accordance with our Privacy Policy.

• Sponsored or promoted content will be clearly labeled as such to distinguish it from organic content, as required by Apple’s transparency guidelines.

• GNZY™ does not guarantee the accuracy, quality, or reliability of third-party products or services advertised in the app.

• Advertisers are solely responsible for ensuring their content complies with applicable laws and Apple’s App Store Review Guidelines (1.1.7).

GNZY™ does not permit behavioral advertising or tracking-based ad targeting for users under the age of 18, in compliance with Apple’s App Tracking Transparency (ATT) framework.

Clause 6.2: External Links to Third-Party Sites
GNZY™ may provide links to third-party websites or services for informational, promotional, or transactional purposes. These links are provided solely for user convenience.

• GNZY™ does not control or monitor the content, privacy policies, or practices of these external sites.

• You acknowledge and agree that clicking on such links is at your own risk, and GNZY™ is not liable for any loss, damage, or harm resulting from your use of third-party services.

We strongly encourage users to review the privacy policies and terms of third-party websites before interacting with them.

Note: Any in-app purchases for digital content hosted externally must not circumvent Apple’s IAP system, per App Store Review Guideline 3.1.1. GNZY™ remains committed to full compliance with Apple’s commercial and ad delivery policies.

7. Privacy & Data Security

GNZY™ is committed to protecting your privacy and ensuring your personal data is handled in accordance with legal requirements, Apple’s developer policies, and industry best practices.

Clause 7.1: Data Collection & Usage
GNZY™ collects, processes, and stores personal data in accordance with our Privacy Policy and Apple’s App Store Privacy Guidelines. We only collect the minimum necessary data required for app functionality and personalization.

By using GNZY™, you consent to our data practices as outlined, including:

• User account data (e.g., name, email, gender).

• Usage analytics for app performance and personalization.

• Device information (e.g., IP address, OS version, device model).

We do not collect health data, biometric identifiers, or sensitive user content unless explicitly required for a feature and disclosed via the App Store’s Privacy Nutrition Label.

Clause 7.2: Security Measures
GNZY™ implements industry-standard encryption and access controls to protect your data, including:

• SSL/TLS encryption during data transmission.

• Secure cloud storage with limited access protocols.

• Regular audits and threat assessments.

While we take reasonable measures to safeguard your data, no method of transmission or storage is completely secure. By using GNZY™, you acknowledge the inherent risks involved with digital platforms and agree that GNZY™ shall not be held liable for breaches beyond our reasonable control.

Clause 7.3: Cookies, Tracking & App Tracking Transparency (ATT)
GNZY™ uses cookies, local storage, and similar technologies to enhance app performance, remember user preferences, and offer relevant content.

• Users can manage or disable tracking via device settings, in compliance with Apple’s App Tracking Transparency (ATT) framework.

• GNZY™ does not track users across third-party apps or websites without explicit consent obtained via Apple’s system-level ATT prompt.

• Users under the age of 18 are excluded from personalized ad tracking in accordance with Apple’s advertising policies and privacy regulations.

8. Account Suspension & Termination

To maintain the integrity, safety, and legal compliance of the platform, GNZY™ reserves the right to suspend or permanently terminate user accounts at its sole discretion, with or without prior notice, in the following circumstances:

Clause 8.1: Violation of Terms & Conditions
Your account may be suspended or terminated if you:

• Breach any provision of the GNZY™ Terms & Conditions, Acceptable Use Policy, or Privacy Policy.

• Violate community guidelines or usage restrictions outlined within the app or on the App Store.

Clause 8.2: Suspicious, Fraudulent, or Unauthorized Activity
GNZY™ has the right to take action, including immediate account suspension, if:

• Your account is involved in unauthorized use, suspected fraud, or payment chargebacks.

• You are found manipulating platform data, engaging in automation, or abusing promotional systems.

Suspicious behavior may be reported to relevant payment processors and Apple if necessary.

Clause 8.3: Harmful, Disruptive, or Illegal Behavior
Your account will be terminated or suspended without notice if you:

• Use GNZY™ to engage in abusive, threatening, or harassing behavior.

• Upload or distribute illegal, harmful, or offensive content, or violate any local or international law.

• Disrupt app operations, other users' experiences, or GNZY™ infrastructure.

Clause 8.4: Re-registration Restrictions
If your account is suspended or terminated, you are strictly prohibited from creating a new account without prior written consent from GNZY™. Attempts to bypass suspension (e.g., using a different email, phone number, or device) may result in:

• Permanent IP/device bans.

• Escalation to Apple for App Store violation enforcement.

Appeals & Support
Users may contact support@gnzy.in to request a review of any account action. While GNZY™ reserves full discretion in decisions, we are committed to fair evaluations and timely responses.

9. Limitation of Liability

To the fullest extent permitted by applicable law and Apple’s developer requirements, GNZY™ disclaims all warranties and limits its liability as described below:

Clause 9.1: No Guarantees or Warranties
GNZY™ is provided on an "as-is" and "as-available" basis. We make no representations or warranties, express or implied, regarding:

• The accuracy, reliability, or completeness of the platform’s content or functionality.

• The availability, timeliness, or uninterrupted performance of the app.

• The suitability, quality, or fitness for a particular purpose of any product or service listed.

We do not guarantee that the platform will be free from errors, bugs, viruses, or other harmful components. While we strive to deliver a secure and reliable experience, users acknowledge that no app can be completely immune to technical or operational issues.

Clause 9.2: No Liability for Third-Party Interactions
GNZY™ does not control and is not liable for any third-party activities, including but not limited to:

• Product fulfillment, quality, or accuracy of descriptions, images, and user reviews.

• Actions or inactions of third-party merchants, delivery agents, or payment processors.

• Losses or damages resulting from external links, advertisements, or integrations with third-party services.

• Disputes between users and sellers, or claims arising from use of third-party services facilitated via the GNZY™ app.

Clause 9.3: User Responsibility for Account Security
GNZY™ is not responsible for unauthorized access or loss arising from:

• Weak, reused, or improperly managed passwords.

• Voluntary sharing of login credentials or account access.

• Failure to log out from shared devices or use available security features (e.g., Face ID, 2FA).

Clause 9.4: Legal and Financial Limitations
In no event shall GNZY™, its affiliates, partners, employees, or licensors be held liable for:

• Indirect, incidental, special, consequential, or punitive damages.

• Any loss of profits, revenue, data, or goodwill arising from the use or inability to use GNZY™.

• Total liability exceeding the amount paid by you (if any) to GNZY™ in the previous 6 months.

Some jurisdictions (including under Apple’s global distribution obligations) may not allow certain warranty exclusions or liability limitations. In such cases, GNZY™’s liability shall be limited to the minimum extent permitted by applicable law.

10. Changes to Terms & Conditions

GNZY™ reserves the right to update, modify, or revise these Terms & Conditions at any time to reflect changes in legal requirements, platform policies, or service features. We are committed to maintaining transparency and user trust in line with Apple’s legal compliance policies.

Clause 10.1: Right to Modify Terms
GNZY™ may revise these Terms periodically, especially in response to:

• Updates to Apple’s App Store Review Guidelines.

• Changes in applicable local or international law.

• Modifications in GNZY™ features, partnerships, or platform structure.

Users will be notified of material or significant changes through one or more of the following:

• In-app notifications or pop-ups.

• Email communication to the address associated with your account.

• A clearly dated update posted in the Terms & Conditions section of the app or website.

Clause 10.2: User Acceptance of Updated Terms
By continuing to access or use GNZY™ following the posting of updated Terms, you acknowledge and accept the revised agreement. If you do not agree with the changes, you must discontinue use of the platform and may request account closure by contacting support@gnzy.in.

Failure to accept updated Terms where required may result in limited access to the platform or termination of your account, in compliance with Apple’s user consent requirements.

11. Governing Law & Dispute Resolution

GNZY™ is owned and operated from India. By using this app, you agree that any legal matters shall be handled under applicable Indian laws, with clearly defined resolution processes.

Clause 11.1: Governing Law and Jurisdiction
These Terms & Conditions, as well as any disputes arising from or related to your use of GNZY™, shall be governed and interpreted in accordance with the laws of the Republic of India, without regard to any conflict of law principles.

Any disputes not resolved through arbitration (as described below) shall fall under the exclusive jurisdiction of the competent courts of Mumbai, Maharashtra, subject to applicable Indian law.

Clause 11.2: Dispute Resolution and Arbitration
We encourage all users to first attempt to resolve any grievances or disputes with GNZY™ amicably by contacting our support team at hello@gnzy.in.

If a resolution is not reached within a reasonable time (30 days from the date of escalation), the matter shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with the following terms:

• The arbitration shall be conducted in English.

• The venue for arbitration shall be Mumbai, India.

• The arbitration panel shall consist of a sole arbitrator mutually appointed by both parties.

• Each party shall bear its own costs unless otherwise awarded by the arbitrator.

The arbitrator’s decision shall be final and binding on both parties and enforceable under applicable law.

Note: If you're accessing GNZY™ from outside India, you are responsible for ensuring compliance with local laws, and any disputes shall still be resolved under Indian jurisdiction unless required otherwise by mandatory local regulations. Apple is not a party to any user disputes.
