On January 29, Hon'ble Supreme Court in Jagdeep Chowgule v. Sheela Chowgule & Ors. (2026 INSC 92), stated that applications to extend the arbitral tribunal's mandate under Section 29A(4) of the Arbitration and Conciliation Act, 1996, must be filed only before the principal civil court of original jurisdiction, not High Courts or Commercial Courts
On January 28, Hon'ble Delhi High Court, Justice Mini Pushkarna in Anand Versha & Anr. v. Narender Kumar Sharma (Deceased) Thr LRS & Ors., stated that a registered Relinquishment Deed dated 30.11.2015 confers absolute title under Section 54 of the Transfer of Property Act, 1882, barring oral variations per Sections 91-92 Evidence Act.
Unregistered documents like a Will, GPA, agreement to sell, and affidavit dated 15.12.2015 failed to prove transfer under Section 63 Indian Succession Act and Section 68 Evidence Act due to lack of attesting witnesses. The court affirmed possession decree for plaintiff's legal representatives, rejecting oral family settlement claims. Full judgment available via Delhi High Court portal (search case details)
On January 29, Hon'ble Delhi High Court, Justice Amit Bansal in Neelam Bhatia & Ors. v. Ritu Bhatia & Ors., stated that a plaint claiming 50% share via unregistered 1981 Agreement to Sell, GPA, and Receipt discloses no cause of action under Order VII Rule 11(a) CPC, as only registered deeds transfer immovable property title per Section 54 TPA.
Plaintiffs neither sought specific performance nor impleaded vendors; unchallenged 1982 registered sale to defendants' predecessor prevailed after 40 years. Continuation would be vexatious per Suraj Lamp (2012) 17 SCC 656. Plaint rejected at threshold. Full judgment via Delhi High Court database.
