Welcome to Fasta Rides, a cab-hailing and parcel delivery service provided by Fasta Rides Inc. ("we," "us," or "our"). By accessing or using our mobile application ("App") or website ("Website"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use our services.
1. Eligibility
You must be at least 18 years old to use Fasta Rides.
By using the App, you represent that you have the legal capacity to enter into a binding agreement.
Users must provide accurate and complete information during registration, including name, email, and phone number.
2. Services
Cab-Hailing: Fasta Rides connects passengers with licensed drivers for transportation services.
Parcel Delivery: Fasta Rides facilitates the delivery of parcels through our network of drivers.
We act solely as a technology platform matching users with drivers and are not responsible for the actions of drivers or the condition of vehicles.
3. User Responsibilities
Passengers:
Provide accurate pickup and drop-off locations.
Treat drivers and vehicles with respect.
Comply with all applicable laws, including wearing seatbelts.
Do not engage in illegal activities, such as transporting prohibited items.
Parcel Senders:
Ensure parcels comply with our prohibited items list (e.g., no hazardous materials, illegal substances, or live animals).
Package items securely to prevent damage during transit.
Provide accurate sender and recipient details.
Users must pay all applicable fees as displayed in the App before or after the service, depending on the payment method selected.
4. Driver Responsibilities
Drivers must hold a valid driver’s license and vehicle registration.
Vehicles must be safe, insured, and in good operating condition.
Drivers must comply with Fasta Rides’ Driver Conduct Policy (see below).
Drivers are independent contractors and not employees of Fasta Rides.
5. Payment
Fares for rides and parcel deliveries are calculated based on distance, time, and demand, as displayed in the App.
Payments are processed through secure third-party payment providers.
Users authorize Fasta Rides to charge the registered payment method for all fees, including cancellations or damages.
Tips are optional and go directly to drivers.
6. Cancellations
Refer to our Cancellation Policy (see below) for details on cancellation fees and refunds.
Fasta Rides reserves the right to cancel a ride or delivery for safety or operational reasons.
7. Intellectual Property
All content on the App and Website, including logos, trademarks, and software, is owned by Fasta Rides or its licensors.
Users are granted a limited, non-exclusive, non-transferable license to use the App for personal use only.
Users may not copy, modify, or distribute any content without our written consent.
8. Prohibited Conduct
Users may not:
Use the App for illegal purposes.
Impersonate another person or provide false information.
Harass, threaten, or harm drivers, passengers, or Fasta Rides staff.
Attempt to reverse-engineer or hack the App.
9. Termination
Fasta Rides may suspend or terminate a user’s account for violating these Terms, at our sole discretion.
Users may terminate their account by contacting support@fastarides.com.
Upon termination, users must settle any outstanding fees.
10. Liability
Fasta Rides is not liable for any damages arising from the use of our services, including accidents, delays, or lost parcels, except as required by law.
Users assume all risks associated with interacting with drivers or sending parcels.
Our liability is limited to the amount paid for the specific service in question.
11. Dispute Resolution
Any disputes arising from these Terms will be resolved through binding arbitration, administered by the American Arbitration Association, unless otherwise required by law.
Users waive the right to participate in class-action lawsuits.
12. Governing Law
These Terms are governed by the laws of the republic of Kenya, without regard to conflict of law principles.
13. Changes to Terms
We may update these Terms at any time. Changes will be posted on our Website and App, and continued use constitutes acceptance.
Significant changes will be communicated via email or in-app notifications.
