The Waiting Times Guarantee [WTG] in Scotland is something of which the illusionist David Copperfield would have been more than a tad jealous. The legislation from which the WTG springs is the Patient Rights [Scotland Act] 2011. This Act has a clause [20] making it clear that no patient has ‘any right of action for specific implement’. In simple terms it means that patients cannot use the courts to enforce the terms of the Act. Equality Here, Now checked to see if government was not just meeting the Waiting Time guarantee for everyone, but also to see what evidence was being gathered to check that people sharing a protected characteristic were not having to wait longer. This meant digging around in a data warehouse managed by Public Health Scotland.
