If you have received an Unfavorable Decision from an Administrative Law Judge, you will have 60 days plus 5 mailing days to file an appeal, in most cases. 

• Your unfavorable decision will be reviewed by the representative and then an appointment scheduled to go over the findings of this review to determine if a Request for Review should be filed.

• This step can take 15 to 20 months for a decision

• The Appeals Council will review your case to determine if there were any administrative errors of law made during the decision process of your claim.

• If you are denied a Request for Review, to proceed with your current claim a Civil Action claim will need to be filed.
