If you have received an Unfavorable Decision from an Administrative Law Judge, you will have 60 days plus 5 mailing days to file an appeal, in most cases.
Your unfavorable decision will be reviewed by the representative and then an appointment scheduled to go over the findings of this review to determine if a Request for Review should be filed.
This step can take 15 to 20 months for a decision
The Appeals Council will review your case to determine if there were any administrative errors of law made during the decision process of your claim.
If you are denied a Request for Review, to proceed with your current claim a Civil Action claim will need to be filed.
