Rider Terms and Conditions
Effective Date: July 1, 2026
These Rider Terms and Conditions (“Agreement”) govern access to and use of the ehatud platform by delivery service providers (“Rider”).
The Platform is owned and operated by ehatud, a duly registered sole proprietorship under the laws of the Republic of the Philippines, with principal business address at 32 Purok Papaya, Pondol, Hinunangan, Southern Leyte, Philippines.
References to “ehatud,” “we,” “us,” or “our” refer to the registered sole proprietorship operating under the business name ehatud.
By registering and using the Platform, the Rider agrees to be legally bound by these Terms and by our Privacy Policy, which explains how we collect, use, and protect Rider information, including location and financial data, and is incorporated into these Terms by reference.
1.1 The Rider is engaged strictly as an independent contractor.
1.2 Nothing in this Agreement creates an employer-employee relationship, partnership, joint venture, or agency.
1.3 The Rider acknowledges that:
They control their own working time and availability;
They may freely accept or reject delivery requests;
They determine the means, method, route, and manner of delivery;
They provide their own vehicle, tools, and resources;
They may engage in other work, including competing platforms.
1.4 ehatud does not control the manner of work, only the outcome of completed deliveries.
2.1 ehatud operates solely as a technology platform connecting Riders, Merchants, and Customers.
2.2 ehatud does not employ Riders, assign schedules, guarantee delivery opportunities, or provide wages or benefits.
2.3 Platform access is non-exclusive, revocable, and conditional.
3.1 To register and maintain an account on the Platform, the Rider must:
Be at least 18 years of age;
Possess a valid government-issued identification and a valid driver's license appropriate for the vehicle type used;
Own or have lawful access to a registered, roadworthy vehicle;
Possess a functional smartphone capable of running the ehatud Rider application with an active mobile data connection;
Successfully complete the ehatud onboarding and verification process.
3.2 Riders must provide accurate, current, and complete registration information (including profile photo, contact details, and vehicle details) and use only their own registered account.
3.3 Account sharing, renting, or unauthorized use of another Rider's account is strictly prohibited.
3.4 ehatud may suspend, restrict, or deactivate access to protect Platform integrity if any eligibility requirements are violated or if false details are provided.
4.1 The Rider independently performs delivery services.
4.2 The Rider is solely responsible for:
Route selection and timing;
Operational costs (fuel, maintenance, data, etc.);
Compliance with laws and safety regulations (including mandatory helmet use), and local ordinances.
5.1 The Platform may facilitate COD transactions where Customers pay in cash upon delivery.
5.2 The Rider acknowledges that they may advance payment for goods to Merchants at their own risk at pickup, and are solely responsible for collecting the corresponding payment from Customers.
5.3 The Rider bears full financial liability for Customer refusal to pay, short collection, and fraudulent or invalid transactions. ehatud is not a guarantor of payment and is not a party to the transaction.
5.4 Cash collected on COD transactions remains the sole responsibility of the Rider. The Rider must remit the Platform's designated commission share of the delivery fee and surcharge to ehatud in accordance with Section 11.
6.1 The Rider earns on a per-delivery basis. Earnings are variable and depend on demand, availability, and performance metrics. No minimum earnings or guaranteed income is provided.
6.2 The delivery fee and any applicable surcharges (combined as the "Delivery Base") for each completed delivery are split between the Rider and ehatud on a 70/30 basis:
The Rider retains a 70% share of the Delivery Base as their earnings.
ehatud is entitled to a 30% platform commission/service fee of the Delivery Base.
6.3 For online payment transactions, the Rider's 70% share is credited to their account for scheduled payout. For COD transactions, the Rider collects the entire delivery fee and surcharge in cash and is holding ehatud's 30% commission, which accumulates as an outstanding balance to be remitted to the Platform.
7.1 ehatud may implement a system-based prioritization mechanism.
7.2 Riders with higher performance metrics may receive priority access to delivery opportunities, increased visibility, and eligibility for incentives.
7.3 Performance indicators may include completion rate, timeliness, customer feedback, and reliability, as further described in our Privacy Policy.
7.4 This system does not impose quotas or schedules, does not guarantee orders, and does not constitute employment control.
8.1 The Rider is free to accept or reject any delivery, work with other platforms, and engage in other business activities.
9.1 Riders must act with honesty and professionalism, treating Customers, Merchants, and support staff with respect.
9.2 Prohibited conduct includes fraud, collusion, fake bookings, order tampering, consumption or damage of deliverables, creating duplicate accounts, and misrepresentation of ehatud's pricing or policies.
9.3 Violations may result in restriction, suspension, or permanent deactivation of Platform access.
10.1 The Rider is responsible for all financial losses arising from their transactions, including COD discrepancies, uncollected balances, and negligence.
10.2 The Rider authorizes ehatud to deduct or offset such amounts from any earnings, incentives, or receivables.
10.3 If earnings are insufficient, the Rider agrees to settle the balance upon notice.
10.4 This authorization survives termination of access, except with respect to amounts already settled or refunded as part of an approved account deletion request under Section 17.
11.1 ehatud implements a Rider Float system to track financial transactions. The Rider Float reflects the outstanding balance owed to the Platform, representing the accumulated 30% platform commission share from COD deliveries, less any remittances made by the Rider.
11.2 The Rider is responsible for remitting outstanding balances on their Rider Float in a timely manner. ehatud may set limits on the maximum allowed float balance; exceeding these limits may result in temporary suspension of order matching until a remittance is processed.
11.3 The Rider authorizes deductions from the Rider Float balance for valid claims, transaction discrepancies, or administrative offsets. Remaining positive balances at termination will be returned subject to settlement of all outstanding obligations.
12.1 ehatud may place temporary holds on earnings related to disputed transactions, COD discrepancies, or suspected fraud.
12.2 Holds shall be limited to reasonable amounts and lifted upon resolution.
13.1 ehatud may implement a tiered access system based on performance.
13.2 Tiers may affect order allocation priority and incentive eligibility.
13.3 Tier placement does not impose work obligations or employment status.
14.1 Riders shall not bypass the Platform to transact directly with Customers or Merchants introduced through ehatud.
14.2 Violations may result in termination and recovery of damages.
15.1 Platform data, including GPS location, timestamps, and activity logs, shall serve as evidence in resolving disputes. How this data is collected, used, and retained is described in our Privacy Policy.
16.1 The Rider assumes all risks arising from delivery activities.
16.2 ehatud is not liable for delivery outcomes, Customer disputes, or loss or damage of goods.
16.3 The Rider agrees to indemnify ehatud from claims arising from their actions.
16.4 The Rider is responsible for securing any insurance coverage.
17.1 Either party may terminate this Agreement at any time.
17.2 ehatud may suspend or deactivate access for violations, risk management, or Platform protection. Suspension or deactivation, whether initiated by the Rider or by ehatud, does not by itself constitute deletion of the Rider's account or data.
17.3 The Rider may separately request deletion of their account and associated personal data at any time, through the in-app Account Settings menu or via the web request channel listed in our Privacy Policy.
17.4 A deletion request will be blocked if there are active deliveries assigned to the Rider. Before a deletion request can be finalized, any active earnings hold, disputed COD transaction, or outstanding balance on the Rider Float under Sections 10–12 must first be fully resolved and settled.
17.5 Once a deletion request is successfully submitted, the Rider will be signed out, and the account will enter a 30-day grace period. The Rider can log back in at any time within this 30-day window to cancel the deletion request and restore access. If the grace period expires without cancellation, ehatud will delete the Rider's profile and location/performance data, while retaining delivery, COD, and financial records for the period required for dispute resolution and applicable tax, accounting, and regulatory compliance, as further described in our Privacy Policy.
18.1 Rider data, including location, identity, camera/photo access, and financial information, shall be processed in accordance with the Data Privacy Act of 2012 (RA 10173) and our Privacy Policy.
These Terms shall be governed by the laws of the Republic of the Philippines. Disputes shall be filed in the proper courts of Maasin City, Southern Leyte, Philippines.
